3 FOOD/BOOTH INFORMATION FOOD CATEGORY: Please select ONLY ONE category for your Restaurant/Food Truck to be judged for the Best of the Best Awards. The selection of multiple categories for judging will disqualify your Restaurant/Food Truck from being considered. o Appetizer o Fast Casual Entree o Fine Dining Entree o Dessert o Brunch MENU: o Vegan o Vegetarian o Gluten-free o Nut-Free Do you require a space that will accommodate a grill? A basic outlet will be provided at each Restaurant/Food Truck space. If you need additional voltage/amps please indicate yes o and a representative of Temp-Power will contact you for details. 3

4 RESTAURANT/FOOD TRUCK AGREEMENT Please read through each statement below carefully and initial each one to acknowledge receipt of the provided rules/regulations of Restaurant/Food Truck participation. 1. I understand that s (Manager s Name) consent to each of the statements below on behalf of (Restaurant/Food Truck Name) is binding and required for participation in Taste of Arlington on May 21, I understand that the hours of Taste of Arlington are from 12-6pm and this event is rain or shine. 3. I understand that there will be a registration fee associated with participation this year; $500 per Restaurant booth up to two booths and $750 per Food Truck. Food Trucks can choose to work out of a Restaurant booth if they prefer. All Restaurant booths and Food Truck spots will be assigned on a first come, first serve basis. 4. I understand that we are solely responsible for all food, labor and supply costs related to participating in Taste of Arlington. I understand that the event organizers will ONLY provide each Restaurant tent with 1 tent, 2 tables, 2 chairs and access to electricity (if required and noted by the restaurant). Food Trucks will be provided with adequate space and access to electricity. 5. I understand that we are allowed to serve tastings priced up to $5 maximum. I understand we can serve multiple tasting options, including non-alcoholic drink options, and we are responsible for all money collection related to the sale of our tastes. 6. I understand that the event will be fenced in this year and an admission fee will be charged for entrance. Each Restaurant/Food Truck will be provided 5 complimentary admissions; additional admission tickets can be purchased for $5/each. 7. I understand that submitting a contract for Taste of Arlington is a binding agreement to participate in the Event as scheduled on May 21, 2017 from 12-6pm. BallstonGives understands that circumstances may require a Restaurant/ Food Truck to cancel their participation from the Event. However, I understand that any cancellations of participation received prior to April 21, 2017 will be refunded 50% of the registration fee; cancellations after May 1, 2017 will not be afforded a refund of the registration fee. I also understand that this will also apply to any Restaurants/Food Trucks that are a no-show the day of the event. 8. I understand that a health permit application must be submitted by my Restaurant/Food Truck in order for us to serve food to the public at Taste of Arlington. I understand that this application is due to the Health Department no later than May 10, If I fail to turn in this application by the deadline my Restaurant/Food Truck will not be allowed to serve food at Taste of Arlington and this will be considered a late cancellation of my Restaurant s/food Truck s participation. Fully completed health permits should be ed to samantha@ballstonbid.com no later than May 10, 2017 to ensure it is processed in time for the event. 4

5 TERMS AND CONDITIONS In the event, by causes outside the control of the host, it is necessary to postpone or cancel the Event, BallstonGives will notify the Restaurant/Food Truck immediately using the contact information on this Contract. The Restaurant/Food Truck has read and agrees to the terms and conditions of this agreement. LIMITATION OF PARTICIPATION Unless otherwise provided, the Restaurant/Food Truck benefits described in this Agreement are related solely to the 2017 Taste of Arlington. LICENSE AND USAGE Restaurant/Food Truck hereby grants BallstonGives a limited, non-exclusive license to use Restaurant s/food Truck s trade names, trademarks, service marks and other proprietary information [the Proprietary Information ] owned by the Restaurant/ Food Truck. BallstonGives agrees that the Proprietary Information will be used only in connection with the Event to provide the benefits set forth in the Restaurant/Food Truck Contract and Agreements and such other benefits as the Restaurant/Food Truck and BallstonGives may agree. TERMINATION BallstonGives may terminate this Agreement on 30 days written notice for any reason in its sole discretion. AMENDMENTS This agreement may be amended only by a written instrument executed by both parties. MISCELLANEOUS This agreement is governed by Virginia law and is binding upon all of the parties successors and assigns. In the event that BallstonGives incurs attorney fees in the collection of any amounts due under this Agreement, the Restaurant/Food Truck agrees to pay BallstonGives actual attorney fees incurred in any such action. UNDER THESE CONDITIONS, The Restaurant/Food Truck agrees to indemnify and hold harmless BallstonGives, its consultants, and Arlington County from any and all liability for damage, injury or loss to any person or goods for any reason. The Restaurant/Food Truck is solely responsible for their booth space and booth operation. By signage of this contract you are pledging the fact that your organization will be present the day of the event, fully prepared to participate rain or shine and you agree to abide by the terms of the contract. BallstonGives is a subsidiary of the Ballston Business Improvement Corporation. BallstonGives mission is to support the charitable deeds of the Ballston Business Improvement Corporation. 5
