1 2016 Sydney Mini Maker Faire Terms and Conditions Event Details 2016 Sydney Mini Maker Faire Powerhouse Museum, 500 Harris Street, Ultimo 13 & 14 August 2016, am 5.00 pm Application Process All project applications (henceforth referred to as stallholders or stalls ) are to be submitted via the online form available at makerfairesydney.com, including all relevant supporting materials and images/samples as attachments. Following review by an expert panel, all applicants will be notified of the outcome of their application. Stallholder participation is subject to compliance with the Stallholder Terms & Conditions. Unsuccessful applicants may be placed on a waiting list, to be notified of any stallholder opportunities that arise in the event of cancellation, etc. Deposit All projects accepted into the 2016 Sydney Mini Maker Faire ( the Faire ) will be required to pay a refundable $50 deposit within two weeks of receiving their confirmation letter to secure their place. The deposit is payable to the Museum of Applied Arts and Sciences ( MAAS or the Museum ) either by EFT or in person by EFTPOS. Failure to pay the deposit within this timeframe may lead to the stallholder(s) forfeiting their place at the Faire. The deposit will be refunded to the stallholder(s) nominated bank account after the completion of the Faire, and is subject to the Terms and Conditions below. Selection Criteria Competition for a stall at Sydney Mini Maker Faire will be high. Stallholders must submit an application form which provides information on all aspects requested. The decision to approve stalls will be assessed by a panel of experts and based on the following criteria: The extent to which the stall demonstrates its relevance to Maker culture. Interactivity for audiences of all ages Innovation and clarity of concept WOW factor Note: Electrical or mechanical products are required to have relevant licenses and approvals including safety tagging and compliance. Selection Panel The selection panel for the 2016 Sydney Mini Maker Faire will be made up of staff from the Museum of Applied Arts and Sciences and independent experts from the wider aker community.
2 Stallholder Terms & Conditions Stallholder participation is subject to compliance with the following Terms and Conditions: 1. Sydney Mini Maker Faire trading hours are Saturday 15 August & Sunday 16 August 2016, am 5.00 pm. 2. If approved, a stallholder enters into a Stallholder s Agreement with the Museum of Applied Arts and Sciences. 3. Once accepted, all projects will be required to pay a refundable $50 deposit within two weeks of receiving their confirmation letter to secure their place. The deposit is payable to the Museum of Applied Arts and Sciences by EFT or EFTPOS. Failure to pay the deposit within this timeframe may lead to the stallholder(s) forfeiting their place at the 2016 Sydney Mini Maker Faire. 4. The deposit will be refunded upon the completion of the Faire, and is subject to compliance with the Terms and Conditions within this document. 5. Participation in the Sydney Mini Maker Faire is free for stallholders designated as non-commercial. Any stallholder selling merchandise or products on the show floor (including but not limited to memberships, or the operation of terminals providing internet-based sales) is designated as a Commercial Maker. 6. The fee for Commercial Maker stallholders is $200 (GST inclusive) and must be paid two weeks in advance by either cheque or money order made payable to the Museum of Applied Arts and Sciences. The Museum will invoice stallholders prior to this date. This amount is non-refundable. 7. $20 million worth of Public Liability Insurance cover is compulsory for all projects. The Sydney Mini Maker will not negotiate insurance on behalf of exhibitors, and without insurance exhibitors will not be included in the program. A valid certificate of currency must be provided to the Museum a minimum of two weeks prior to the Faire. Please refer to conditions points 33 through 38 for more information. 8. Stalls are rented to approved stallholders on a one-off basis only. 9. Being granted a stall does not create any form of tenancy or imply a future Right or Licence. 10. Stall allocation is totally at the discretion of the Museum of Applied Arts and Sciences or its agents. 11. Approved stallholders are required to operate their stall for the entire duration of the Faire Saturday 15 August & Sunday 16 August 2016, am 5.00 pm Sydney Mini Maker Faire stalls can not be transferred, sold or sublet. 13. Stalls must be attended at least 30 minutes prior to Faire commencement, at 9.30am. Stalls not attended by this time will be re-allocated by the Museum s staff or their agents, and the stallholder may forfeit their $50 deposit. 14. All visitors and customers of the Museum must be treated with courtesy at all times and in accordance with fair trading practice consistent with Consumer Law. Stallholders must not insult or intimidate other stallholders, customers, visitors or staff. Failure to comply will result in closure of the stall. 15. Stallholders must comply with all reasonable requests from the Museum s staff or their agents in carrying out their work. 16. Stallholders are required to remove all rubbish and materials from their stall at close of trading and to return any equipment to designated storage areas. 17. Stallholders must comply with the laws governing workplace health and safety, including the completion of a SWMS (Safe Work Method Statement), to be submitted with the formal stallholder agreement document. 18. Any damage caused by a stallholder or stallholder s property to Museum of Applied Arts and Sciences property or structures must be paid for. 19. Stallholders have no right of recourse against the Museum or its agents for any loss, damage or changes to Faire operations. No compensation is payable, outside of that required by law.
3 Products 20. Sydney Mini Maker Faire is not a trade fair and the primary activity of Non-Commercial Makers must not be the sale of products. Those wishing to sell merchandise at the 2015 Sydney Mini Maker Faire must be registered as a Commercial Maker. Please refer to conditions 54 through 56 for further information. 21. All products must comply with relevant safety and compliance standards. 22. A stall may represent the products of several makers having regard to size and nature of product. Stall set-up 23. Each stallholder must store all materials and equipment safely within their designated stall area. 24. Stall display must be in keeping with the image of the Museum of Applied Arts and Sciences. 25. Public access ways, emergency exits and fire hydrant access must be kept clear at all times. All merchandise, equipment, signs and furniture within stall boundaries. 26. All stall equipment shall be firmly secured to protect personal and public safety. 27. No permanent hanging devices or adhesives may be attached to Museum of Applied Arts and Sciences property or structures. 28. Each stallholder will be allocated a bump-in, set-up and bump-out time by Museum of Applied Arts and Sciences staff or their agent. These times must be strictly adhered to. Failure to comply can result in the reallocation of a stall and the forfeiture of the stallholder s deposit. 29. Opening hours are restricted to the advertised hours of Sydney Mini Maker Faire (Saturday August 13 and Sunday August , am 5.00 pm). Stall furniture and rental 30. Furniture at Sydney Mini Maker Faire is provided under the stallholder agreement and will be available for stallholders to organise their display with merchandise. 31. Storeholders can utilise trestle tables supplied by The Museum. These tables are molded plastic, with heat resistant tops and locking legs. Size is 1.8m (L) x 0.75m (W) x 0.94 (H). The max load for the table is 100 Kgs. A request must be listed within the Stallholder expressions of interest (EOI). 32. Sydney Mini Maker Faire will occupy a variety of locations throughout all four public levels of the Powerhouse Museum. The Museum will allocate the stalls according to the Sydney Mini Maker Faire design plan, providing a safe and interesting environment for all, and designed to maximise opportunities for conversations between stallholders and visitors. Insurance 33. $20 million Public Liability Insurance is compulsory for all stallholders. 34. If you already possess Public Liability Insurance in line with Point 33, a valid Certificate of Currency for Public Liability Insurance, up to $20 million for conducting of business outside of normal premises must be produced at Registration two weeks prior to the Faire. Your current insurer can supply this to you. 35. Skincare or consumable (e.g. edible or perishable) products are required to have an additional $10 million Product Liability Insurance. 36. Stallholders have full responsibility for all licences and insurances, including but not limited to workers compensation and WH&S. 37. Stallholders are required to have any other licences and insurances required to operate their business, and all products should comply with relevant safety and compliance standards. 38. Stallholders are encouraged to make their own enquiries regarding insurance for loss or damage to all
4 belongings, products, stock or equipment either owned, hired or borrowed, during Sydney Mini Maker Faire. Cancellation 39. Sydney Mini Maker Faire will continue to trade in wet weather. However, the Museum or its agents reserves the right to cancel the event if weather and operational conditions are deemed too dangerous. 40. Cancellations by accepted stallholders prior to the completion of the Faire will result in a forfeit of the $50 deposit fee. MAAS staff and their agents reserve the right to waive this condition on exceptional circumstances. 41. Commercial stallholders who cancel after registration will still be charged for full stall rental. ABN 42. Stallholders are not required to have an ABN in order to participate in the 2016 Sydney Mini Maker Faire. Parking and traffic 43. There is no on-site parking at the Powerhouse Museum. There will be a designated point for unloading and loading your merchandise and/or equipment, but under no circumstances will vehicles be permitted to remain onsite. 44. The Museum has discounted parking options available with certain providers in the Darling Harbour precinct. For more details visit: Stallholders are not permitted to drive vehicles into the Powerhouse Museum loading dock without the prior written permission of the Powerhouse Museum or its agents. 46. Stallholders shall obey all local traffic and parking regulations. They shall not inconvenience local residents or members of the public, and shall respect their premises and property. Equipment/storage/signage 47. Stalls can include provision of trestle tables and (as outlined in condition 30), one or more chairs. Stallholders should bring: display, signage and promotional materials; a change float to suit your product pricing and suitable means to secure cash (if required); and tablecloth, fabric or similar to cover table. 48. Any additional stall furniture and/or equipment must have the prior written approval of the Museum or its agents. This will be available at Registration. 49. The Museum can not provide EFTPOS and credit card facilities for stallholders. Stallholders wishing to make use of such facilities must make their own arrangements. Contact your bank for details. 50. There is no facility for cash storage or change available on the day from the Museum or its agents, including the MAAS café and The Junction. 51. All storage must be accommodated within the designated area of the stall. 52. All additional signage must have the prior written approval of the Powerhouse Museum or its agent. This will be available at Registration. Additional conditions applicable to Commercial Stallholder applications 53. The Sydney Mini Maker Faire is not a trade fair or craft market, and that priority will be given to novel, innovative and unique products and exhibitors willing to demonstrate their creative processes throughout the two days. Commerical Maker applications purely with the goal of soliciting sales are strongly discouraged.
5 54. Applicants must make clear the type of stall ( Non-Commercial or Commercial ) they intend to operate in their EOI form. Any products offered for sale must be approved by the Powerhouse Museum prior to being offered for sale at the Faire. Please make clear any products intended for sale on the Stallholder EOI form.
6 Additional information Important note regarding Stallholder selection process. The expert panel will assess all applications and both successful and unsuccessful applicants will be notified of the outcome of their application. No further correspondence will be entered into, and the Museum of Applied Arts and Sciences and its agents reserve the right not to explain why an application was unsuccessful. Privacy The creative organisation behind the Maker Faire concept, Maker Media, would like to collect contact details of Makers applying to be part of the Sydney Mini Maker Faire, to be included in their subscriber network. No personal information collected by the Museum of Applied Arts and Sciences as part of the stallholder application process may be forwarded to any outside party without your express consent.
