Since the introduction of the amendments to the Food Premises Regulation, Public Health Inspectors have not observed a change to the types of foods being offered during inspections of food vending caits locally, nor received many requests for expanding into non-traditional options. In retrospect, this may be the result of lack of awareness of the possibilities afforded under the amended Regulation. With the trend to providing healthier food alternatives, there may be some interest in promoting the opportunity for expanded food choices being offered by street vending carts in concert with the City of London Licensing By-law and current approval system that already includes approval by the local Medical Officer of Health. Health Unit staff are willing to review the need for any adjustments to this system with City staff and staff from municipalities in Middlesex County. Pollett, MD, FRCPC Medical Officer of Health and CEO DATE: 2009 February 19 STREET FOOD VENDING CARTS - EXPANDED FOOD CHOICES Recommendation It is recommended that the Board of Health forward Report No re Street Food Vending Carts - Expanded Food Choices, to London Ci@ Council and local municipal councils throughout Mddlesex County. Background Effective 2007 August 1, amendments to the Food Premises Regulation of Ontario (O.R. 562 under the Health Protection and Promotion Act) came into effect, related to street food vending carts. The amendments resulted in significant changes to the types of food allowed to be served from street food vending carts allowing for greater variety. Prior to these amendments, the Regulation had allowed only pre-cooked meat such as wieners and sausages to be served on a bun from those mobile food premises. Details Subject to compliance with the Food Premises Regulation, the following categories of food may now be sold at street vending carts: Ready to eat foods that are pre-packaged in another food premises. Non-potentially hazardous foods such as French Gied potatoes, fruit juices, non-dairy smoothies, corn on the cob, and whole hits from a street food vending cart. These foods must be brought to the street food vending cart in a prepared state after being prepared in another food premises OR be prepared and handled on the street food vending cart in a safe and sanitary manner that will prevent contamination and that complies with all applicable requirements of the Food Premises Regulation 562. (Appendix A) Foods that are pre-cooked in another food premise and are re-heated on the street food vending cart. This includes potentially hazardous food from a food premise that is inspected by public health (hazardous food includes foods with a higher risk of spoilage or contamination, such as pizza, samosas, burritos, beef patties, hamburgers or other foods containing meats, fish, eggs, dairy products). (Appendix B) Other foods that may be approved by the local Medical Officer of Health (MOH), based on a risk assessment process. (Permission in writing must be obtained from the MOH in this situation and the permission must be posted on the street vendor cart, in accordance with the Regulation).

3 2009 February Notification Requirements Operatorslvendors of street food vending carts need to meet specific requirements and the owner/operator/vendor must notify the Health Unit at extension 2300, prior to selling foods other than pre-cooked wieners or sausages to be served on a bun. In addition, every person who intends to operate a food premises shall give notice of the person s intention to the local MOH in which the food premises will be located, and shall provide information as the MOH requests in respect of the manufacturing, processing, preparation, storage, handling, display, transportation, distribution, sale or offering for sale of any food on or in the food premises in accordance with the Health Protection and Promotion Act. Municipal Licensing Requirements The City of London Licensing By-law requires that refreshment vehicles must be licensed by the City of London, and are subject to various approvals, including the local Medical Officer of Health. Section 18.8 (a) requires that Every person to whom a Refreshment Vehicle Licence is issued under the provisions of this by-law shall, at all times in respect of the premises or the vehicle for which the licence has been issued hereunder keep the same, together with all utensils and equipment, in a clean and sanitary condition to the satisfaction of the Medical Officer of Health. Health Unit staff do not see the need to change the current wording in the by-law, as to the satisfaction of the Medical Officer of Health...means complying with the Food Premises Regulation. Thames Centre licenses mobile food premises that are only allowed in industrial and commercial areas. Strathroy- Caradoc issues permission to vendors requesting to operate a food cart. Southwest Middlesex is currently working on a policy with a view to including health unit approval and license. North Middlesex has a zoning by-law that prohibits street vendors. Lucan-Biddulph and Middlesex Centre rely on the Food Premises Regulation. Conclusion Since the introduction of the amendments to the Food Premises Regulation, Public Health Inspectors have not observed a change to the types of foods being offered during inspections of food vending carts locally, nor received many requests for expanding into non-traditional options. In retrospect, this may be the result of lack of awareness of the possibilities afforded under the amended Regulation. With the trend to providing healthier food alternatives, there may be some interest in promoting the opportunity for expanded food choices being offered by street vending carts in concert with the City of London Licensing By-law and current approval system that already includes approval by the local Medical Officer of Health. Health Unit staff are willing to review the need for any adjustments to this system with City staff and staff from municipalities in Middlesex County. As a point of interest, the City of Toronto has initiated a pilot project to establish street vending carts which provide an expanded choice of foods that may reflect the local cultural diversity and availability of healthier options, in a safe and sanitary manner that meets the requirements of the Food Premises Regulation. Pollett, MD, FRCPC Medical Officer of Health and CEO This report addresses Requirement 7 of the Food Safety Ontario Public Health Standard that states the board of health shall inspect food premises and provide all the components of the Food Safety Program within food premises as defined by the Health Protection and Promotion Act and in accordance with the Food Premises Regulation (0. Reg. 562).

5 APPENDIX B The following list contains examples of potentially hazardous foods. - Pizza - samosas - burritos beef patties - hamburgers - sandwiches incorporating meat products (e.g. chicken, turkey, beef, fish) baked goods with creamldairy-based products wieners or similar sausage products Potentially Hazardous Foods - as defined in the Food Retail and Food Services Code means: Any food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish (edible mollusca and crustacean), or any other ingredients, in a form capable of supporting growth of infectious andlor toxigenic microorganisms. This does not include foods which have a ph level of 4.6 or below and foods which have a water activity of 0.85 or less.
