2 rural property land and farms livestock and machinery tax valuations compensation claims agricultural law planning and development finance sourcing GENERAL CONDITIONS OF SALE 1.1 Every Vendor, Bidder and Purchaser shall be deemed to have full knowledge of the Composite Conditions and to agree to be bound by them All livestock is sold subject to these conditions, ("the Conditions"), the Livestock Auctioneers Association Conditions of Sale (2017 edition) ("the LAA Conditions") and, in the case of any pedigree livestock, any special conditions expressly applicable ("the Special Conditions") (all together "the Composite Conditions") If there is any conflict or inconsistency between the elements comprising the Composite Conditions the order of precedence shall be first, the Special Conditions, secondly the Conditions and thirdly, the LAA Conditions A copy of the LAA Conditions and any Special Conditions is available for inspection upon request All other lots are sold subject to these conditions, ("the Conditions"), and any special conditions expressly applicable ("the Special Conditions") (all together "the Composite Conditions") If there is any conflict or inconsistency between the elements comprising the Composite Conditions the order of precedence shall be first, the Special Conditions and secondly, the Conditions A copy of any Special Conditions is available for inspection upon request. 2. All lots are accepted for sale on the terms the Vendor warrants his right to sell the same and undertakes to indemnify the Auctioneers against all actions, proceedings, claims, costs, charges and expenses to which they may be exposed or which they may incur by reason of any defect in the Vendor's title. 3. The Auctioneers act in all respects only as agents for the Vendor and it shall be deemed that no condition or warranty expressed or implied has in any circumstances been given by the Auctioneers or any servant of the Auctioneers, whether as to title, description, the quality of any lot sold or otherwise. The Auctioneers and their servants shall not incur any liability to the Purchaser in respect of any defect of title, error of description or imperfection or in respect of any announcement or statement relating to or affecting any lot offered for sale whether made orally or in writing and whether given before, during or after the auction, nor shall they incur any liability in relation to any dispute between any Purchaser and Vendor. 4. The Auctioneers reserve the right to refuse to accept bids from a Purchaser and they reserve on behalf of themselves and of the Vendor(s) the following rights: (a) to fix a reserve price; (b) to bid on behalf of a Vendor; (c) to re-arrange, consolidate or withdraw any lots or vary the order of sale; and (d) without giving any reason therefore, to refuse to accept the bids of any person. 5. The person making the highest accepted bid shall be the Purchaser. 6. No bid shall be retracted. 7. If a dispute arises as to any bidding, then at the discretion of the Auctioneers, either: (a) the lot to which the disputed bid relates shall immediately be put up again; or (b) the Auctioneers shall determine the dispute, and their decision shall be final and binding on all parties. 8. The Purchaser shall, when requested, give his name and address to the Auctioneers and unless otherwise agreed by the Auctioneers and the Purchasers shall pay for the lot(s) he has purchased ON THE DAY OF SALE. All lots are sold on condition that the ownership of the same shall remain with the Vendor and no property in the lots whether legal or equitable shall pass to the Purchaser and no lot(s) shall be removed from the premises unless or until: (a) payment in full has been made in cash, or by bankers draft, or by cheque not exceeding the amount stated on an accompanying valid cheque guarantee card; (b) the Purchaser has obtained a pass-out slip from the Auctioneers clerk. 9. Notwithstanding Conditions 8 and 10 each lot shall be at the absolute risk and at the expense of its respective Purchaser at the fall of the hammer and subject to Conditions 8 and 10 shall be removed from the sale premises at the Purchaser's expense within the time stated by the Auctioneers at the commencement of the sale. 10. If, notwithstanding Condition 8 above, the Auctioneer permits the Purchaser to remove his lot from the sale premises prior to payment in full having been received then: (a) Ownership of the same shall remain with the Vendor and no property in the lot whether legal or equitable shall pass from the Vendor to the Purchaser until payment of the full price has been received in cleared funds by the Auctioneer or the Vendor (as the case may be). Payment shall, unless otherwise agreed, be made to the Auctioneers. (b) the Purchaser undertakes to house the lot on his premises separate from his own and those of any other person and in such manner as makes it readily identifiable as the Vendor's; (c) the Purchaser's right to possession of the lot shall automatically cease immediately prior to his doing anything or failing to do anything which would entitle a Receiver to take possession of the lot(s) or which would entitle any person to present a petition for the winding up of the Purchaser; (d) the Vendor or the Auctioneers may for the purpose of examination or recovery of any lot remaining unpaid enter upon any premises, where it is housed or where it is reasonably thought to be housed; (e) if the Purchaser shall sell on the lot, then such part of the proceeds of such resale as equates to the full price of the lot remaining unpaid shall be held by the Purchaser in a separate bank account as trustee thereof on the Vendor's behalf. 11. Without prejudice to any other right or remedy of the Vendor or the Auctioneers, if the Purchaser shall be in breach of any other Composite Conditions, the Vendor or the Auctioneers shall have power to resell the lot(s) purchased by the Purchaser retaining any surplus and charging any deficiency or expense to the Purchaser. 12. Neither the Vendor nor the Auctioneers will be responsible for any accidents or injury, not arising out of their negligence, which happens to any person or property while on the sale premises. 3 FOREWORD The herd at The Hawkins Farm was started in 1962 and expanded to its present size. Over the last few decades it has been run as a flying herd, the last 5 years the herd has been sourced as freshly calved producing milk to supply Waitrose Dairy Farmers. The cows are milked through a 20/40 swing over Dairymaster herringbone parlour twice daily, fed a TMR ration of 40% grass silage 60% maize silage, fed to yield in the parlour and grazed in the summer as we have been on a Waitrose supply contract. A full vaccination programme has been in place. The herd is cubicle housed with loose housing for the transition group. Genus RMS has been used for the last decade with all cows being served to Charolais and all progeny being reared and finished. We - John, Jetta, John & Rachel - would like to thank everyone we have been associated with and who have helped us achieve our goals within the dairy sector. Payment Terms: STRICTLY PAYMENT ON THE DAY by Cash, Debit Card or Cheque. Cheques will only be accepted from persons known to the Auctioneers. Buyers not known to the Auctioneers and wishing to pay by cheque must contact the Auctioneers BEFORE the day of the sale to make arrangements. Agents: Customers are reminded that if they are bidding as agents on behalf of a third party they must produce to the Auctioneers before the sale commences a written authority from the person(s) on whose behalf they are bidding. If they do not, the Auctioneers will treat them as bidding on their own account and will invoice them personally for any purchase made. 3. Disclaimer of Liability: The Auctioneers and their clients accept no liability for any damage, injury or loss to persons or plant, and all attend the sale at their own risk. Vehicles are parked at their owner s own risk. WARRANTIES Note: The Breeding and Udder Warranties (1 and 2 below) DO NOT apply to cattle sold for less than 700 guineas ( 735). 1. Breeding: All the cows and heifers that are stated in the catalogue to have been served not less than ten weeks before the date of the sale or to have been running with a bull (the later of which is not less than ten weeks before the date of the sale) will be guaranteed by the vendor to be in-calf unless otherwise announced at the time of sale, but no guarantee will be given as to the date of calving or breed of calf. Any claim made under this guarantee must be made in writing and supported by a Veterinary Surgeon s Certificate to the Auctioneers within SEVEN WEEKS of the date of sale. Note: PD details for cows and heifers served less than ten weeks are statements of opinion and carry no guarantees. 2. Udders: Unless otherwise stated or announced, all cows in-milk or in-calf and heifers in-milk at the time of sale carry a guarantee that she is sound in the udder and teats at the time of sale. Any claim under this guarantee may be made by 12 noon of the day following the sale, or in the case of animals being left on the farm within 12 hours of the animals leaving the vendor s farm, which claim they may be made orally but must be received by the Auctioneers within that period. 3. Maiden Heifers: The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes to be free from any malformation which would render the animal incapable of breeding. The warranty from the date of the sale is a 5 DAY warranty if the malformation is patent, or a 6 MONTH + 5 DAY warranty if the malformation is latent. If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of a claim to the Auctioneers must be supported by a Veterinary Surgeon s Certificate. The purchaser shall have no right to claim damages from the vendor in respect of consequential loss. 4. Warranty claims will not be considered on unpaid accounts or stopped cheques.

5 4 5 DIRECTIONS The Hawkins, WR6 5TQ is situated 3 miles from Bromyard and 15 miles from both Worcester and Hereford, and is accessible from either the A44 Worcester to Leominster road or A4103 Worcester to Hereford road. It is situated ½ mile off the B4220 which runs between the A44 Worcester to Leominster road and the A4103 Worcester to Hereford Road. From the A44, proceed onto the Bromyard Downs and turn onto the B4220 for Malvern. Follow for approximately 2 miles and turn right and the farm can be found on the right after ½ mile. From the A4103, take the B4220 for Bromyard. After 3 ½ miles turn left and the farm can be found on the right after ½ mile. We are a team of specialist farm animal vets working with our clients in Herefordshire and surrounding counties.
