A person who produces and sells for his or her benefit wheat or white maize seeds shall pay a general levy of two comma six percent (2.6%) on an amount to be determined by the Namibian Agronomic Board from time to time, not exceeding the actual producer price or landed cost price of seeds or products so produced or sold. 2. Subject to paragraphs 3 and 4, a person who - (a) imports into Namibia wheat or white maize seeds, or agronomic products which were derived from the grinding, crushing or milling of wheat or white maize seeds; or (b) purchases wheat or maize seed from a person referred to in paragraph 1, shall pay a general levy of zero comma six five percent (0,65%) on an amount to be determined by then amibian Agronomic Board from time to time, not exceeding the actual producer price or landed cost price of seeds or products so imported or purchased. 3. The levy referred to in paragraph 2 shall not be payable on the importation of- (i) (ii) (iii) (iv) (v) (vi) breakfast cereals; durum wheat flour; industrial or household starches; maizena; pasta (the finished product); and popcorn; which were derived wholly or partly from the grinding, crushing or milling of wheat or white maize seeds. 4. The levies referred to in paragraphs 1 and 2 shall not be payable on the sale, importation or purchase of wheat and white maize seeds intended for planting purposes. 5. Any person who has paid a levy on behalf of another person, as contemplated in section 18(4) of the Agronomic Industry Act, 1992 (Act No. 20 of 1992), shall be entitled to recover the amount of that levy by deducting such amount from any amount due by him or her to the person on whose behalf the levy has been paid. 6. For the purposes of paragraph 2 "landed cost" means the purchase price of wheat or white maize seeds, including any taxes and duties, and transport costs to the final destination in Namibia, payable in respect thereof. 7. The levy referred to in paragraphs 1 and 2 shall be collected by the Board.

5 No Government Gazette 30 August MINISTRY OF AGRICULTURE, WATER AND RURAL DEVELOPMENT No AGRONOMIC INDUSTRY ACT, 1992: IMPOSITION OF A GENERAL LEVY ON CERTAIN CONTROLLED PRODUCTS Under section 18(1) of the Agronomic Industry Act, 1992 (Act No. 20 of 1992), I hereby impose, on the recommendation of the Namibian Agronomic Board, with effect from the publication of this notice, the general levies set out in the Schedule on the controlled products set out in the Annexure to the Schedule. Any person who produces and sells, excluding exports, for his, her or its benefit any controlled product, being agronomic crops, set out in the Annexure to this Schedule shall pay a general horticultural levy of one comma two percent (1,2%) on the selling price of the controlled product concerned. 2. Any person who imports into Namibia any controlled product set out in the Annexure to this Schedule shall pay a general horticultural levy of one comma two percent (1,2%) on the landed cost of the controlled product so imported. 3. Any person who purchases controlled products from a person referred to in paragraph 1 or 2, as the case may be, shall pay a general levy of one comma two percent ( 1,2%) on the selling price concerned or the landed cost concerned, as the case may be, of the controlled product so purchased. 4. Any person who has paid a levy on behalf of another person, as contemplated in section 18(4) of the Agronomic Industry Act, 1992 (Act No. 20 of 1992), shall be entitled to recover the amount of that levy by deducting such amount from any amount due by him, her or it to the person on whose behalf the levy has been paid. 5.
