1 Agenda Cover Memorandum Meeting Date: February 27, 2017 Meeting Type: COW (Committee of the Whole) City Council Budget Workshop Item Title: Modifications of an Ordinance amending Article 12, Chapter 6 of the Municipal Code and Regulations applicable to Package Liquor Licenses (Class P) and the Gourmet Beverage Endorsement Action Requested: Approval For Discussion Feedback Requested For Your Information Staff Contact: Cheryl Peterson Phone #: cpeterso@parkridge.us Background: Presently, Package liquor licensees are prohibited from selling any single container of refrigerated or chilled alcoholic beverage, except for full wine bottles, for off-premises consumption. This is a common regulation designed to prohibit the purchase of single bottles of beer for immediate off-premises consumption, which tends to be aimed at limiting vagrancy and loitering nearby package liquor stores. Package liquor licensees which have purchased a Gourmet Beverage Endorsement may offer a limited quantity of beer or wine for on-premises consumption either by the full container or as a flight. Currently, the limit on the volume of alcohol which may be served to any patron per day is 12 oz. of wine and 24 oz. of beer. Likewise, flights of wine are limited to a total of 6 oz. and flights of beer are limited to 12 oz. In response to an application from Beer on the Wall, the Liquor License Review Board considered three amendments to the regulations applicable to Package liquor licensees and the Gourmet Beverage endorsement. Specifically: 1. Allow the sale of single bottles of chilled beer for off-premises consumption; 2. Increase the volume of flights to 12 oz. of wine or 16 oz. of beer; and 3. Increase the total volume of alcohol which may be served for on-premises consumption per customer per day to 24 oz. of wine and 48 oz. for beer. The Liquor License Review Board considered the request on February 13, 2017, and voted to recommend the changes. The basis for their recommendation is described in the minutes of their meeting. The LLRB compared this request to the limitations described for Complementary Service liquor licenses rather than the limitations applicable to a Sampling endorsement. For the Complementary Service liquor license, on-premises consumption is limited to not more than three servings of alcoholic beverages by a patron during any single calendar day. For the Sampling endorsement, each serving may not exceed two ounces and the total quantity may not exceed a total of ten (10) ounces per customer per day. While these changes were applied for by Beer on the Wall, they would be generally applicable to all similarly situated licensees. The other Gourmet Beverage endorsement was issued to Winestyles. 2 CITY OF PARK RIDGE ORDINANCE NO AN ORDINANCE AMENDING ARTICLE 12, CHAPTER 6 OF THE MUNICIPAL CODE OF PARK RIDGE TO AMEND REGULATIONS APPLICABLE TO PACKAGE LIQUOR LICENSES AND THE GOURMET BEVERAGE ENDORSEMENT WHEREAS, the City of Park Ridge is an Illinois home rule municipal corporation organized and operating pursuant to Article VII of the Illinois Constitution of 1970; and WHEREAS, the City has adopted certain liquor license regulations designed to protect the health, safety and welfare, which regulations are codified at Article 12, Chapter 6 of the Park Ridge Municipal Code ( Liquor Code ); and WHEREAS, the Illinois Liquor Control Act, 235 ILCS 5/1-1. et seq. ( Act ), describes the minimum regulation of liquor license establishments in the State of Illinois; and WHEREAS, Section 4-1 of the Act, 235 ILCS 5/4-1, empowers the Mayor and City Council to establish such conditions, regulations and restrictions upon the issuance of local liquor licenses not inconsistent with law as the public good and convenience may require; and WHEREAS, the Mayor and City Council desire to update and revise the City s Liquor Code to amend the regulations applicable to Package liquor licenses and the Gourmet Beverage endorsement, as described in this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Park Ridge, Cook County, Illinois, pursuant to its home rule authority provided under Article VII of the Illinois Constitution of 1970 as follows: SECTION 1: Paragraph I.A of Section , Descriptions and Restrictions of Chapter 6, Alcoholic Liquors, of Article 12, Businesses and Occupations, of the Park Ridge Municipal Code is hereby amended as follows:

3 I. Class P License (Package) A. Prohibitions 1. Consumption on the premises (except pursuant to the appropriate endorsement). 2. Delivery or offer of delivery of single containers of refrigerated or chilled alcoholic beverages; except for bottles of win containing at least 750 ml and except pursuant to the appropriate Endorsement). 3. Delivery of alcoholic beverages in any container other than its original sealed and unopened package (except pursuant to the appropriate Endorsement). 4. Gasoline sales (except pursuant to the appropriate Endorsement). 5. Delivery at any place other than retail food stores and drug stores with not less than ten thousand (10,000) square feet of retail sales area (except pursuant to the appropriate Endorsement). SECTION 2: Paragraph (A)(9) of Subsection V, Endorsements, of Section , Descriptions and Restrictions of Chapter 6, Alcoholic Liquors, of Article 12, Businesses and Occupations, of the Park Ridge Municipal Code is hereby amended as follows: 9. Gourmet Beverage Endorsement. This shall allow a Class P Licensee to offer wine or beer for on premise consumption. Regulations specific to a Gourmet Beverage Endorsement: a. A Gourmet Beverage Shop license shall be available only in B-1 and B-4 zoning districts. b. No "spirits" as defined by this chapter, may be delivered. c. Glasses or flights of wine or beer may be delivered on the licensed premises under the following conditions: i. Hors d'oeuvres must be available for consumption with the wine.

4 ii. No more than twenty-four (24)twelve (12) ounces of wine or forty-eight (48)twenty-four (24) ounces of beer may be served to any individual during any day. iii. A glass or flight of wine may contain no more than six (6) ounces; and a glass or flight of beer may contain no more than sixteen (16)twelve (12) ounces. d. The area restrictions set forth in (i)B shall not apply to a gourmet beverage shop whose primary business is the sale of beer and wine. e. Infused beverages may be delivered, but only in accordance with state regulations. f. One single bottle per customer per day of refrigerated or chilled beer may be delivered for off-premises consumption. SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. SECTION 4: The City Clerk is hereby authorized and directed to publish said Ordinance in pamphlet form according to law. Acting Mayor/Liquor Commissioner Maloney called the meeting to order at 6:15 p.m. I. Roll Call Deputy Clerk Peterson read the roll-call. The following members indicated their presence: Comm. Baldi, Bowles, Flyke, Svanascini, and Liquor Commissioner/Acting Mayor Maloney Comm. Greisbach was absent. II. Approval of Minutes A. January 9, 2017 Moved by Comm. Flyke. Seconded by Comm. Svanascini. Motion carried; voice vote. III. Citizens Present Wishing To Be Heard On a Non-Agenda Item None. IV. Non-Member Aldermen Wishing To Be Heard On a Non-Agenda Item None. V. Administrative Report None. VI. Approve to recommend the issuance of a Class S-4 Specialty (complementary service) Liquor License for Bottle and Bottega located at 424 Touhy Avenue Moved by Comm. Svanascini. Seconded by Comm. Bowles. Neenu Gupta is the current business owner of a Subway establishment in Park Ridge located in the South Park area. Her new endeavor involves opening her second business in the City, Bottles and Botega, a franchise founded in Chicago Bottles and Botega offers a night of artistic fun with friends while enjoying wine or beer which the patron provides (BYOB). In regards to the insurance, Deputy Clerk Peterson reported that the insurance provided by the applicant was acceptable according to City Attorney Simon. The applicant indicated that her commercial build-out has been initiated. She plans to have a soft opening at the end of March 2017 and a Grand Opening during the last week of April. Allow the sale of single bottles of beer OR open single bottles for sampling purposes; 2. Increase the volume of glasses or flights of beer from 12 oz. to 16 oz.; and 3. Increase the amount of alcoholic liquor for on-premises consumption from 24 oz. to 48 oz. Ryan Tracey, owner of Beer on the Wall, explained the three (3) changes that he is requesting. He clarified that he would like to allow for the sale of single COLD bottles of beer OR open single bottles for sampling purposes under 750 ml., increase the volume of glasses or flights of beer from 12 ounces to 16 ounces to accommodate the flight boards, increase the amount of alcoholic liquor for on-premises consumption from 24 oz. to 48 oz. of beer. When questioned by Comm. Bowles about increasing the amounts of beer, Mr. Tracey welcomed increasing the wine consumption amount from 12 ounces to 24 ounces for consistency purposes, as suggested by Bowles. Comm. Bowles was supportive with increasing the amounts; there would be consistency with the type of License proposed for Bottles and Botega. Comm. Baldi questioned the intent of the package license. He asked why the applicant did not apply for an R (restaurant) license. Acting Mayor Maloney explained that since the City does not have Liquor Stores, this type of establishment and Winestyles are a hybrid. Mr. Tracey explained how other towns have Restaurant, Tavern, and Package type Liquor Licenses. Mr. Tracey has a Gourmet endorsement, exclusive for package stores. The possibility of holding a Class R and Class P type license simultaneously was discussed. It was Mr. Tracey s understanding that this was not an option. Comm. Svanascini believes that changing the code for one business could be time consuming on all involved. With a Gourmet endorsement, hors d'oeuvre must be served; full meal service must be offered with an R Class license. Tracey inquired whether it would be allowable to hold a Class R and P type license. Deputy Clerk Peterson indicated that she would check with the City Attorney on Thursday. Comm. Flyke had no objections to the modifications suggested. Based on an inquiry from Comm. Svanascini, the applicant indicated that he does currently provide hors d'oeuvres. Ald. Mazzuca was in attendance and indicated that he looks forward to further discussion on the topic as a Proceeds and Regulations agenda item on February 27, He believes input from the Board will be helpful. RECAP: The sale of single bottle COLD beers; can an establishment hold a P and R Class license simultaneously; on site consumption of beer increased from 24 to 48 ounces and wine from 12 to 24 ounces. Acting Mayor Maloney asked Deputy Clerk Peterson to remind Winestyles and Beer on the Wall about the meeting on February 27. B. Consideration of Licensing Options for a Chamber of Commerce Special Event Gail Haller, Executive Director of the Chamber of Commerce, spoke about the details of a new Chamber event. Many other municipalities have hosted similar events know as a Wine Walk or Wine Stroll. The Chamber of Commerce would be responsible for selling tickets to those 21 years of age and older. The ticket purchaser would receive a wristband allowing them to visit participating Chamber merchants tasting 2-3 ounce pours of wine which would be served with chocolates or snacks. The Chamber would charge each member establishment with a participation fee. The Chamber would secure the Special Event permit and provide Host Liquor Insurance as an umbrella policy for all involved so that individual merchants do not need to apply Page 2 of 3

Wine would be provided to the stores, possibly distributed by Winestyles. Comm. Flyke appreciated the information provided in the packet which included information from neighboring towns who host Wine Walks. He liked the concept. Acting Mayor Maloney requested that Deputy Clerk Peterson to arrange for a meeting with herself, Ms. Haller, and the City Attorney to work out the details of the temporary license. VIII. New Business Deputy Clerk Peterson reported that she received another Liquor License application today for a new Steakhouse restaurant. The Board arranged to meet at 6:45 p.m. on February 20 to review the new application. IX. Adjournment The meeting adjourned at 6:48 p.m. Page 3 of 3
