1 City Council Agenda Item #13C(2) Meeting of October 24, 2016 Brief Description Recommendation On-sale brewer s taproom and Sunday liquor license, and off-sale liquor license (for growlers) for Unmapped Brewing Company, LLC,. Continue the public hearing and grant the licenses Background The city has received an application for an on-sale brewer s taproom and Sunday liquor license, and off-sale liquor license for, for use at. The applicant is proposing to establish a microbrewery at Excelsior Blvd. was founded in the spring of 2015 and the owners have been searching for a location to establish the microbrewery. (See pages 1-11). The site is currently occupied by Kraemer s Hardware. John Kraemer provided a letter to the city stating his desire to retire from the hardware business and re-purpose the space for the proposed brewery in the Glen Lake area. (See page 12). The brewery anticipates opening in April 2017, pending council approval. Business Ownership, is owned by John David (JD) and Megan Park. JD and Megan each own 31.25% of the business with various other investors accounting for the additional 37.5% ownership. None of the investors own greater than 10% of the business. JD and Megan are residents of Minnetonka. Business Operations The applicant is requesting to have a taproom and an off-sale license for growlers. The taproom will not include food, but patrons are allowed to bring in their own food or order takeout from area restaurants on the takeout menu. The proposed hours for the taproom will vary initially for the winter/summer months. (See page 3). The licensed premise will include an outdoor patio. The approval of the licensed premise is subject to the conditions of approval for the requested conditional use permit. The patio is required to have a cordoned area with at least one opening to an acceptable pedestrian walk. When a liquor license is involved, an enclosure is required and the enclosure shall not be interrupted; access must be only through the principal building.

All employees will attend and pass an accredited Alcohol Server Awareness Program. No staff member will be allowed to serve customers until completing this requirement. Other Similar Actions The council previously approved licenses for Lucid Brewing determining that a brewery offered a distinctive specialty service and as the only brewery in Minnetonka, the council granted on-sale taproom and off-sale liquor licenses (for growlers). In April 2016, Lucid Brewing expanded their business and established a facility in the North Loop area of Minneapolis. According to Minnesota statute, a brewery can only hold one brewer offsale and one taproom license at a time within the state, which canceled the Minnetonka licenses. Lucid Brewing holds a license at the state level for production of beer in Minnetonka, but there are no existing licenses for serving at a taproom or for growlers. Neighborhood Feedback The city has received one comment regarding the proposed liquor license. (See page 13). Recommendation Application information and license fees have been submitted. The police investigation is complete and will be provided to the council separately. Staff recommends that the city council continue the public hearing from September 26, 2016 and grant the license. 4 Unmapped Brewing Co. Business Plan Supplement Note: For the full Unmapped Brewing Co. Business Plan, please see the "Corporate Document" entitled, "UNM - FULL Investor Package." The information provided in this "Business Plan Supplement" has been arranged to more directly answer the required questions that are listed in the City of Minnetonka Liquor License - Part I application. I. Staffing Unmapped Brewing Co. plans to create the following staffing positions: Taproom Manager: The primary duties of the Taproom Manager are expected to be: Managing taproom operations and staff, opening, closing, bartending, merchandise sales, leading tours, taproom cleanup, dish washing. Some assisting with the brewing process such as cleaning or kegging may be required. This is expected to be a full-time position and will report to the President and CEO. Head Brewer: The primary duties of the Head Brewer are expected to be: Performing day-to-day brewery operations such as milling, brewing, cellaring, kegging, bottling, quality control, yeast management, and cleaning. The Head Brewer is also expected to manage the production schedule/keep records as well as supervise assistant-level brewery operations staff. Other duties may include taproom serving/retail sales, leading tours, and assisting with deliveries. This is expected to be a full-time position and will report to the President and CEO Part-time Positions: Taproom Servers and Assistant Brewers/Cellarmen may be added to support taproom and brewery operations. Taproom Servers would report to the Taproom Manager and Assistant Brewers/Cellarmen would report to the Head Brewer. Unmapped Brewing Co. does not plan to hire more than one of each role upon opening. As future operations needs dictate, the company may hire more of each of these positions. II. Safeguards Against Under-age Sales Unmapped Brewing Co. will implement two different types of safeguards to protect against underage sales; Staff Training and Taproom Procedures Staff Training: All Unmapped Brewing staff (including non-taproom positions) will be required to attend and pass an accredited "Alcohol Server Awareness Program" at the expense of Unmapped Brewing Co. No staff member will be allowed to serve to customers before completing this requirement Taproom Procedures: Events/High Traffic ("Busy") Days: If high numbers of customers are expected for an event or possibly Friday night/saturday, all Unmapped Brewing patrons will be required to show their ID 2

5 to a staff member prior to entering the taproom. Each patron who has a valid 21+ ID will be given either a wristband or handstamp which will allow them to purchase alcohol in the taproom All Other Situations: For all other situations in which wristbands or handstamps are not being issued, patrons will be required to present a valid 21+ ID to a Taproom Server for each alcoholic beverage that they wish to purchase. III. Projected Food to Liquor Ratios Unmapped Brewing Co. does not plan to offer or serve any food sourced from the Unmapped Brewing premises. However, patrons are encouraged to order food to be delivered to them at the Unmapped Brewing Co. premises from local restaurants. Patrons are also encouraged to bring their own food with them to the Unmapped Brewing Co. premises. IV. 6 Hours/Days of the Week When Live Entertainment, Dancing, or Amplified Music is Present: Unmapped Brewing anticipates live or amplified musical events would occur rarely (once a week or less often). On weekdays, such events could occur between the hours of 7-lOpm. On Saturdays, such events could occur between the hours of 1-lOpm. On Sundays, such events could occur between the hours of l-8pm. As a non-negotiable requirement, all live or amplified music events will be required to end by 10pm regardless of the day of the week or taproom hours. V. Description of the Type of Entertainment Offered Food Trucks: Unmapped Brewing Co. may from time to time invite a food truck to occupy a designated space outside of the taproom during taproom hours. Events: Unmapped Brewing Co. may from time to time host outdoor events that may include live music, food trucks, and outdoor beer sales. All such events must be first approved by the Glen Lake Center landlord and the City of Minnetonka. Unmapped Brewing Co. will abide by all pertinent city ordinances for any such event. Live Music: Unmapped Brewing Co. may from time to time offer live music events that would be hosted inside the taproom with all exterior doors closed. Amplified musical acts ranging from 1 to 5 members would be allowed. Based on personal music taste, Unmapped Brewing ownership would attempt to source local singer/songwriters, acoustic/nonamplified musicians, and folk music artists/groups. VI. Unmapped Brewing Co. Menu Unmapped Brewing Co. will not serve any food on the premises. Therefore, the only "menu items" will be beverages. Unmapped Brewing Co. plans to offer seven "year-round" beers as well as two or three "limited and special releases" at any given time. The seven "yearround" beers are: 1. Topographic Wit, a Belgian-style Witbier 2. IVIinneSaison, a French-style Farmhouse/Saison 3. Disorientation, a Belgian-style Tripel 4. Quadruplication, a Belgian Dark Strong Ale 5. Middle of Anywhere, an American Pale Ale 6. No Trace, an American IPA 7. Late Watch, an American Barleywine Unmapped Brewing Co. will also offer non-alcoholic beverages such as local craft sodas. The company will offer water free of charge to all patrons as well 4

7 VII. Orderly Appearance and Refuse Control Unmapped Brewing Co. will employ a series of strategies to maintain an orderly appearance at all times. Most importantly, taproom staff will be vigilant in keeping the taproom and patio areas clean and free of used glassware while also cleaning any spills, litter, or other refuse. Restrooms will be checked every two hours for cleanliness, and if issues are discovered or reported, they will be dealt with immediately. At the end of each shift, a detailed and thorough cleaning of the taproom, bar/counter, and patio will be performed. The Taproom Manager or JD Park will be required to personally attest that the cleaning was completed properly as well as check for and address any property damage before leaving the premises each evening. Brewery staff (head brewer and assistants) will be required to keep the brewing area clean and sanitized to government standards at all times. At the end of each shift, all equipment and floor space that was in use during the brewing process will be thoroughly cleaned. All spent grains will be stored in the designated dry storage area until their proper removal. The Head Brewer or JD Park will be required to personally attest that the cleaning was completed properly at the end of each brewing shift. VIII. Sound and Noise Management Plan Sound equipment will only be located inside the taproom. There will be no speakers or amplification equipment on the patio. During operating hours, music will be played in the taproom at a volume that would allow conversations to be easily heard. Other scenarios such as live music performances or outdoor events have already been addressed in Section IV and Section V of this document. 5

8 Written Statement The portion of the Glen Lake Center building pertinent to this Conditional Use Permit application is located at the address of Excelsior Boulevard, Minnetonka, MN This Conditional Use Permit application is for a proposed use of "microbrewery" by. The address of Excelsior Boulevard, Minnetonka, MN falls within the boundaries of "B-2 Limited Business District" as defined in the City of Minnetonka Zoning Map. According to Section in the City of Minnetonka Code of Ordinances, the City of Minnetonka has defined "Microbrewery" as a conditional use of the B-2 Limited Business District zone. Therefore, as plans to operate at Excelsior Boulevard, Minnetonka, MN as a microbrewery producing less than 5,000 bbl per year without food service, the intended use falls within the guidelines of the conditional use of "microbrewery" in the B-2 Limited Business District zone as defined in Section in the City of Minnetonka Code of Ordinances. First, I'd like to say I am very excited about the possibility of this "re-purpose" of the space for the brewery. It will be a real asset for Glen Lake to have this kind of meeting place for families, cyclists, walkers and weary travelers! For a little clarification, I own the Kraemer s Hardware business myself and together with my siblings, own the real estate in Glen Lake. We recently decided to sell our Glen Lake properties. We sold the old hardware building to make way for the Prestige Academy and sold the BP station to the man that has been its tenant for the last 20 years or so and now have this proposal from Unmapped Brewery and Kriss Novak to buy the shopping center. Kriss offered to take over the hardware space for the brewery and since I have been planning to retire I accepted his offer. Although the hardware store is profitable, my kids have all gone off to bigger and better things and I could not find a suitable buyer for the hardware business. It is encouraging that the turnover to young families is beginning to take place in Glen Lake but it's a little too late for me I am afraid. So, I am looking forward to retirement. Needless to say it was a difficult decision to let go of the hardware store after being in our family for over 100 years. It has been a pleasure getting to know you during this long process and I am grateful to you for all that you have done during the planning phase of Glen Lake's latest re-incarnation. A few years ago there was a drug store in that exact location that did a good business. I wish the Park's the best in their endeavor, but they need a suitable location, and this is not it.
