Should multiple applications be received for the same location and meets the criteria outlined in the bylaw, and after consideration of the local vendors, a lottery will be held and non-competing vendors, a lottery will be held. If required the lottery will be held: The last business day of April - 10:00 a.m. Council Chambers Municipal Government Building th Avenue, Sylvan Lake, AB Wait List for Permits When the maximum number of Permits has been issued for a specific location on a specific time, the initial applicants for a Mobile Vending Business Permit that have not been awarded, will be placed on a Wait List. Applications received after the initial application period (April 1 st to April 15 th ) will be placed on the bottom of the Wait List should the specific location and specific time not be available. Should the Wait List be exhausted and the available Permits have not been issued, the Permit will remain available to subsequent applicants.

This includes: Fresh Fruit & Vegetable Vendor Recreational Vendor Handcrafted Goods Vendor Flower/Plant Vendor Mobile Vending Plaza 2 (MVP2) Artist Plaza (AP) Recreation Vendor only

6 SCHEDULE D BUSINESS CATEGORIES FOR MOBILE VENDING BUSINESS UNITS Permits will only be issued pursuant to this Bylaw for the following Business Categories: Mobile Food Truck a Unit that sells or distributes food or beverages other than fresh fruit and vegetables. These Units are a vehicle propelled by any power other than muscular power; Food Cart Vendor a Unit that sells or distributes food or beverages other than fresh fruit and vegetables. These units are propelled by muscular power; Fresh Fruit & Vegetable Vendor a Unit that sells or distributes fresh fruit and vegetables only; Recreational Vendor a Unit that provides recreational activities and/or equipment for rent; Artist/Photography Vendor a Unit that sells or distributes their original artwork or photography. This includes creating artwork and photography at the vending site; Handcrafted Goods Vendor a Unit that sells or distributes their original handcrafted goods; and Flower/Plant Vendor a Unit that sells or distributes fresh cut flowers or plants.

7 SCHEDULE E WAIVER OF LIABILITY AND INDEMNITY In being granted a license to operate a Mobile Vending Business on public property within the Town of Sylvan Lake, the undersigned hereby unconditionally releases the Town and its managers, officers, employees, agents and representatives from any liability, which may be suffered by the undersigned or any person directly or indirectly associated with the undersigned including any officers, directors, employees, agents or invitees, for any injury, loss, damage or death, including any loss of income or loss of opportunity, resulting or arising directly or indirectly from the operation of the undersigned as a Mobile Vending Business in the Town of Sylvan Lake. The undersigned and its officers and directors also hereby unconditionally indemnify, save and hold harmless the Town and its managers, officers, employees, agents and representatives from and against all losses, costs, damages or expenses (including any expenses incurred by the Town on a solicitor and its own client basis) arising directly or indirectly from any demand, suit or legal action of any kind which may be brought against any of them and for which they may be liable for any reason due to injury, loss, damage or death resulting directly or indirectly from the operation of the undersigned as Mobile Vending Business in the Town of Sylvan Lake. 8 APPLICATION REQUIREMENTS Every applicant for a Permit must provide the following information: (a) a completed application; (b) a Certificate of Insurance with a minimum liability coverage in the amount of $2,000,000 (two million dollars) with the Town of Sylvan Lake named as an additional insured; (c) (d) (e) (f) (g) proof, satisfactory to the Licensing Inspector of motor vehicle insurance and health and safety permits and approvals that may affect the use of the proposed Unit; proof that the applicant is the holder of a business license issued by the Town; a signed indemnification agreement; photos, dimensions and specifications of the proposed Mobile Vending Business Unit; the dimensions, location and photos of proposed signage. Incomplete applications (including required attachments) will not be considered.
