3 Street Vending Background Definition: Street vending is the sale of goods on City owned streets and sidewalks Benefits: It creates a lively public realm and opportunities for new entrepreneurs to start local businesses Many Priorities for Public Spaces: Street space is finite and vending space must be balanced with other public needs Street Vending By-law Regulates: Extensions of Business on City Street - (Display Units and Patios) Vending Units (Food and Non-Food) 3 Vending as Part of a Special Event - (Farmers Market and Special Event Markets)
4 Purpose of A New By-law Existing By-law: The existing By-law was written over 40 years ago Uses of public realm have diversified Food vending industry has grown Goals for the new By-law: A new By-law is needed to evolve City programs which activate Vancouver s streets, support the economic development strategy and provide opportunities for entrepreneurs in the food sector. 4
5 Displays Extension of Business on City Streets Currently there are: 156 permitted display units Only Produce, Plants & Flowers allowed 5 Goals of the Permit Program: Activate the public realm Enable businesses to promote their goods Ensure sidewalks are clear for public passage Proposed by-law changes enable a greater variety of merchandise such as books and toys.
6 Patios Extension of Business on City Streets Currently there are 277 Small Patios Tables and chairs must be removable No alcohol permitted Currently there are 316 Large Patios Semi-permanent structures are allowed Pilots are underway for trials on Patios physically separated from restaurant (across the sidewalk) Extended hours from 11pm to 12pm 6 Proposed by-law changes will improve the permit process and support program guideline for continued pilots
7 A total of 51 patios took advantage of the extended hours pilot in
8 Vending Units Currently there are 191 vending units in the program, including: 34 Street Vending Permits issued for non-food (handcrafts, artwork, and flowers) 157 Street Vending Permits issued for food, of which: 110 are Stationary Food Vendors: 43 traditional Hot Dog and Nut vendors 67 Expanded Food vendors 47 are Roaming Food Vendors: 10 ice cream or coffee vendors 37 Expanded Food vendors 8
9 Food Vending Program Overview The Purpose of food vending program is to: Enliven the public realm Offer healthy, affordable food on Vancouver streets Enable entrepreneurs to initiate businesses Create opportunities for small businesses There has been significant growth in the numbers and the types of businesses participating in the program. 9
10 Food Vending Program Longstanding Issues Primary Issues Include: 1) Renting Out of Permits Some are charging a much higher fee, making it hard for small business entrepreneurs to survive Lack of City control over which vendors are operating, creates challenges for City staff to enforce guidelines, such as healthy food types, and recycling 2) Limited Number of Locations Available Some permit holders have 4 or 5 locations, which limits new entrepreneurs Some permit holders don t activate locations for more than a year 3) No Business License Required Lack of business licenses makes enforcement difficult 4) Rules for Transfer of Permits Lack of clarity on how a permit holder can transfer their permit to the purchaser of their business 5) Proximity to Brick and Mortar Conflicts arising between vendors and nearby brick and mortar restaurants 10
11 Food Cart Program Consultation and Notification Consultation Meetings were held with Program Participants to Solicit Input: Meeting 1 Oct. 10, 2013 Approximately 90 out of approximately 130 vendors in attendance Meeting 2 - Nov. 25, 2013 Approximately 60 out of approximately 130 vendors in attendance Draft recommendations shared with permit holders, vendors, downtown core BIAs and the BC Restaurant and Foodservices Association Notification Letters outlining proposed changes were issued to program participants in December If approved by Council the proposed changes will come into effect 11 for permits issued in May, 2014
12 Food Carts Proposed Changes Key proposed changes include: Prohibiting rental of a permit Limiting the number of permits per person to 3 food and/or non-food (or up to 4 combined of stationary food and roaming) Prohibiting the sale of permits, transfers to be approved by the City All permit holders must have a business license and carts must be owner operated Separation of locations by 100m from a storefront selling a similar product 12 A transition strategy has been developed to minimize the impact of the regulatory changes.
13 Food Carts- Permit Holders Renting Permits Of the 110 Stationary Food Vending Permits: A total of 26 permit holders do not operate carts, but are instead renting their permit locations out to operators 17 operators are renting a total of 31 locations Staff intend to find locations for each of the operators currently renting. This may mean ~4 new locations 3 businesses will be effected by the new limits on number of permits that can be held by an individual: 1 business currently holds and rents outs more than 3 locations 2 business operate out of more than 3 locations, and some of the locations are rented from the permit holder 13
14 Conclusions The use of street space in Vancouver continues to evolve and the economic activity continues to grow The existing By-law that regulates the use of street space was written without contemplating much of the current activity, and therefore is in need of updating 14
