4 AUSTRALIA The INC International Nut and Dried Fruit Council was founded in 1983 with the mission of endorsing activities that provide its membership new opportunities for increasing global consumption of almonds, Brazil nuts, cashews, hazelnuts, macadamias, pecans, pine nuts, pistachios, walnuts, peanuts, apricots, dates, figs, prunes, raisins, sultanas, and currants by: - Collecting and distributing a single source of annual statistical information from producing and consuming countries. - Ensuring the global quality standards and trading terms are within the framework of existing national and international bodies and do not inhibit trade within the industry. - Promoting research and scientific studies through the INC Foundation. - Promoting international cooperation by interacting with various public, private, national and international organizations which share our common goals. - Increasing goodwill and mutual understanding of the nut and dried fruit industry by promoting international meetings in producing and consuming countries. The INC is the International source for information on nuts and dried fruits for: Health, Nutrition, Food Safety, Statistics, Government Standards and Government regulations regarding trade barriers and trade quality standards. MYCORED (Novel integrated strategies for worldwide mycotoxin reduction in the food and feed chains) is a large collaborative European Union project within the Seventh Framework Programme. The project aims at developing strategic solutions to reduce mycotoxin contamination that entails a higher concern in economically important food and feed chains. Novel methodologies, efficient handling procedures and information, dissemination and educational strategies are considered in a context of multidisciplinary integration of knowhow and technology to reduce mycotoxins exposure worldwide. The project is significantly built on the outcome of several European projects on mycotoxins by supporting, stimulating and facilitating education and cooperation with countries having major mycotoxin concerns related to (international) trade and human health. 6 AUSTRALIA 1.INTRODUCTION 1. AUSTRALIAN FAILING FOOD REPORTS. The foods listed in these report have been identified as failing foods under the Australian Imported Food Control Act 1992 (the Act). Under Section 35 of the Act, the Australian Quarantine and Inspection Service (AQIS) may publish certain information concerning this failing food. Failing foods are subjected to further government action. Future consignments of the food will be inspected at the rate of 100 per cent of consignments until the food demonstrates compliance with Australian food standards for five consecutive consignments. Australian failing food reports can be found on the following web page: ion-data/failing-food-reports 2. INC REPORT. This report collects and classifies all Australian notifications published in the Australian Quarantine and Inspection Service Home Page regarding product, country of origin and type of notification for nuts and dried fruits. The reports identify foods that have been found to fail analytical testing or do not meet the compositional requirements of the Food Standards Code The report does not list foods that have failed for non compliant labels as the responsibility for the correct labelling of imported food lies with the importer of the food. In these cases, the importer has an opportunity to bring the label into compliance with Australian food labelling standards. 1

20 JAPAN 1.INTRODUCTION 1. Japanese Import Procedure under Food Sanitation Law To ensure the safety of imported foods and related products, Article 27 of the Japanese Food Sanitation Law obliges importers to submit import notification. As Article 27 of the Food Sanitation Law states that "Those who wish to import food, food additives, apparatuses, or container/packages for sale or for use in business, shall notify the Minister of Health, Labour, and Welfare (MHLW) on each occasion as prescribed by the Ministerial Ordinance," the imported foods and related products must not be used for sale without import notification. Notifications are submitted to a Quarantine Station of the Ministry of Health, Labor and Welfare. At the quarantine station, food sanitation inspectors carry out document examination and inspection to see the foods and products comply with the Food Sanitation Law 2. Document Examination of the Notification Form for Importation of Foods, etc. and Inspection at the MHLW Quarantine Station. 1. After the submission of notification, the food sanitation inspector at the quarantine station inspects the product to examine whether the item meets the regulations under the Food Sanitation Law. During the document examination, the food sanitation inspector validates the following items, based on the information reported in the Notification Form. The judgement will be made based on the information, such as the country of export, imported items, manufacturer, the place of manufacture, ingredients and materials, methods of manufacturing and use of additives. - Whether the imported food, etc. complies with the manufacturing standards regulated under the Food Sanitation Law. - Whether the use of additives complies with the standards. - Whether poisonous or hazardous substance is contained. - Whether the manufacturer or the place of manufacturing has a record of sanitation problem in the past. When the document examination judges the cargo needs to be inspected (cargoes with many records of incompliance with the law in the past, imported swellfish, etc.), an inspection order (inspection order system), a public inspection (other inspection systems) and other inspections (Inspections) will be carried out in order to confirm the compliance of the cargo with the law by the inspection. 3. When the document examination and cargo inspection have found that the cargo is in compliance with the law (the cargo "passed" the inspection), a "Certificate of Notification" will be returned to the importer from the MHLW quarantine station where the notification was first submitted. The import procedures, then, will proceed to the next step. 4. The cargo that has been judged not to comply with the law (the cargo that "did not pass" the inspection) cannot be imported into Japan. The MHLW quarantine station will notify the importer how the cargo violates the Food Sanitation Law, and the importer will take necessary measures by following the instructions from the station. 5. The INC is the International source for information on nuts and dried fruits for: Health, Nutrition, Food Safety, Statistics, Government Standards and Government regulations regarding trade barriers and trade quality standards. MYCORED (Novel integrated strategies for worldwide mycotoxin reduction in the food and feed chains) is a large collaborative European Union project within the Seventh Framework Programme. The project aims at developing strategic solutions to reduce mycotoxin contamination that entails a higher concern in economically important food and feed chains. Novel methodologies, efficient handling procedures and information, dissemination and educational strategies are considered in a context of multidisciplinary integration of knowhow and technology to reduce mycotoxins exposure worldwide. The project is significantly built on the outcome of several European projects on mycotoxins by supporting, stimulating and facilitating education and cooperation with countries having major mycotoxin concerns related to (international) trade and human health. United States Import Refusal Report To ensure the safety of imported foods and related products, the USA Food, Drug, and Cosmetic Act (the Act) authorizes the Food and Drug Administration FDA to detain a regulated product that appears to be out of compliance with the Act. The FDA district office will then issue a "Notice of FDA Action" specifying the nature of the violation to the owner or consignee. The owner or consignee is entitled to an informal hearing in order to provide testimony regarding the admissibility of the product.
