5 INTRODUCTION 1. Rapid Alert System for Food and Feed The RASFF is an effective tool to exchange information within EU Member States about measures taken in response to serious risks detected in relation to food or feed. This exchange of information helps Member States to act more rapidly and in a coordinated manner in response to a health threat caused by food or feed. The INC report collects and classifies all 217 RASFF notifications for nuts and dried fruits intended for food published in the RASFF portal web page, regarding product, country of origin, notifying country and type of notification. The report also includes notifications for peanuts intended for feed, which are not included in the general overview, summary or comparisons. Some caution is needed when drawing conclusions from this report, for example, it is not because a Member State has a relatively high number of notifications that the situation regarding food safety is disastrous in that country. On the contrary, it could indicate that a greater number of food checks are carried out. The analysis shall consider trade volumes through Member States. The report includes the relation between the 216 imports of the RASFF member states from the notified countries and its total notifications. At the time of writing this report, not enough trade values were available to provide data for The Legal Basis The legal basis of the RASFF is Regulation (EC) Nº 178/22, published in the European Official Journal L.31 of 1 February 22. Article 5 of this Regulation establishes the rapid alert system for food and feed as a network involving its members. Whenever a member of the network has any information relating to the existence of a serious direct or indirect risk to human health deriving from food or feed, this information is immediately notified to the Commission under the RASFF. The Commission immediately transmits this information to the members of the network. Article 5.3 of the Regulation lays down additional criteria for when a RASFF notification is required. Member States shall immediately notify the Commission under the rapid alert system of: - Any measure they adopt which is aimed at restricting the placing or forcing the withdrawal from the market or the recall of food or feed in order to protect human health and requiring rapid action. - Any recommendation or agreement with professional operators which is aimed, on a voluntary or obligatory basis, at preventing, limiting or imposing specific conditions on the placing or the eventual use of food or feed on account of a serious risk to human health requiring rapid action. - Any related to a direct or indirect risk to human health, of a batch, container or cargo of food or feed by a competent authority at a border post within the European Union. Regulation (EC) N 16/211 lays down implementing rules for the RASFF. It entered into force on 31 January 211. The Regulation lays down requirements for members of the network and the procedure for transmission of the different types of notifications. A difference is made between notifications requiring rapid action (alert notifications) and other notifications (information notifications and border notifications). 3. Members The RASFF list of members includes the 28 EU Member States, the European Commission, as member and manager of the system, the European Food Safety Authority (EFSA), Norway, Liechtenstein, Switzerland and Iceland. 4. Notifications The system differentiates between market notifications and border s. According to the seriousness of the risks identified and the distribution of the product, the market notification is classified as alert notification or information notification. Alert Notifications - Alert notifications are sent when a food or feed presenting a serious risk is on the market or when rapid action is required. - Products subject to an alert notification have been withdrawn or are in the process of being withdrawn from the market. Member States have their own mechanisms to carry out such actions, including the provision of detailed 217 EU-RASFF INC - International Nut and Dried Fruit Council 2

6 information through the media if necessary. - Alerts are triggered by the member of the network that detects the problem and has initiated the relevant measures, such as withdrawal/recall. The notification aims at giving all the members of the network the information to verify whether the concerned product is on their market, so that they can take the necessary measures. Information Notifications - An information notification concerns a food or a feed of the notifying country for which a risk has been identified - that does not require rapid action, because the product has not reached the market or is no longer on their market. - Products subject to an information notification have not reached the market or all necessary measures have already been taken or are in process of being taken. Border Rejections - A border notification concerns a food or a feed that was refused entry into the Community and was rejected at their external borders for reason of a health risk. The notifications are accompanied by a detailed explanation of the reasons for the action taken by the Member State in which the notification was issued. Notifications are immediately transmitted by the Commission to the members. Border s are transmitted to all members border posts as well as the third country of origin. Information is also provided to third countries when a food or feed has been notified and shipped to them. 5. Abstract In 217, the European Union s Rapid Alert System for Food and Feed (RASFF) issued a total of 61 notifications including edible nuts (427 not.), dried fruits (145 not.), peanuts for feed (22 not.), and mixtures of nuts and dried fruits (7 not.). This result means an increase of 17% compared with 216, when a total of 514 notifications were registered. The most notified edible nuts were peanuts, with 2 notifications, followed by pistachios (113 not.) and hazelnuts (57 not.). As in previous years, the main reason for notifying edible nuts was the presence of aflatoxins (85%). By country of origin, the most frequently notified edible nuts were peanuts from China (21%), pistachios from Iran (12%), and pistachios from USA and hazelnuts from Turkey (7% both). Compared with 216, the number of notifications for peanuts from China increased by 56% and for pistachios from USA more than doubled. However, the number of notifications for pistachios from Iran and hazelnuts from Turkey remained stable with respect to the previous year. As for dried fruits, dried figs (75 not.), dried apricots (4 not.) and dried grapes (25 not.) were the most notified. The main reasons for notifying were aflatoxins (48%), sulphites (32%) and Ochratoxin A (1%). Dried figs and dried apricots from Turkey were still the most notified, representing 47% and 27%, respectively, of the total notifications, following by dried grapes from Turkey (8%). 46 INTRODUCTION 1. United States Import Refusal Report To ensure the safety of imported foods and related products, the USA Food, Drug, and Cosmetic Act (the Act) authorizes the Food and Drug Administration FDA to detain a regulated product that appears to be out of compliance with the Act. The FDA district office will then issue a "Notice of FDA Action" specifying the nature of the violation to the owner or consignee. The owner or consignee is entitled to an informal hearing in order to provide testimony regarding the admissibility of the product. If the owner fails to submit evidence that the product is in compliance or fails to submit a plan to bring the product into compliance, FDA will issue another "Notice of FDA Action" refusing admission to the product. The product then has to be exported or destroyed within 9 days. The IRR reports on those products for which a determination was to refuse admission to part or all of the product offered for importation. The IRR is generated from data collected by FDA's Operational and Administrative System for Import Support (OASIS) and is updated monthly. Each month, the IRR is available sorted by country/area and by product based on the industry code which is the first two characters of FDA's product code (e.g., all fishery/seafood products will be coded 16...). FDA has prepared this information in an effort to provide the public with information on products that have been found to appear in violation of the Act. The cases of violation of Food Sanitation Law that are Found on the Occasion of Import Notification are available on: refusals/ 2. INC Report This report collects and classifies all 217 United States notifications for nuts and dried fruits published in the Food and Drug Administration (FDA) Home Page regarding product, country of origin and type of notification. 3. Abstract In the United States, notifications for edible nuts decreased, for a third year in a row, about 23% in comparison with the previous year (from 49 to 38 not.). As in 216, the edible nut with the higher number of notifications was the peanut (13 not.). Misbranding (3% of total) was the main reason for notifying edible nuts, followed by aflatoxins (27%) and filthy (18%). On the contrary, dried fruits also showed a upward trend in the number of notifications, reaching 25% more than in 216. Date was the dried fruit most notified (37 not.) followed by dried grapes (23 not.) and prunes (17 not). Filthy (35%), misbranding (19%) and pesticide (16%) were the main reasons for notifying dried fruit.
