1 Minutes of the meeting to consider re-allotment of surrendered quantity of raw sugar for duty free import under TRQ The Exim Facilitation Committee (EFC) chaired by Addl. DGFT Sh. K.C. Rout met on to decide the re-allocation of quota upon surrender of quota by some applicants as detailed in the EFC minutes dated 26/4/217 in pursuance to the Notification Nos.1& 2 dated 5 th April, 217 and 13 th April, 217 for import of 5 lakh MT of raw sugar duty free under Exim Code 1714 of Chapter 17 of ITC (HS) 217. The List of participants are at Annex-I. 2. The Committee noted that M/s NCS Sugar Ltd. who had been allocated quota of 9858 MT of sugar was in DEL (Denied Entity List of DGFT) and it had filed Writ Petition No of 217 in the High Court at Hyderabad for revoking its DEL status and further requested for consideration of his application for grant of import license in pursuance of DGFT s Notification Nos.1& 2 dated 5 th April, 217 and 13 th April, 217. The Hon ble Court had disposed off the petition on with the direction to consider company s representation dated submitted in RA Hyderabad for removal of company DEL status and to pass appropriate orders within two weeks. It had further directed that if the decision taken by RA Hyderabad was favourable, sufficient time for submission of the application by the company for allocation of quantities be considered. 3. RA Hyderabad however has vide order dated rejected the representation and decided not to remove the name of company from DEL. Hence, the allocation was treated as cancelled and accordingly, a quantum of 9858 MT of sugar has become available for reallocation amongst other applicants in the South Zone 4. Further, subsequent to allocation of the quota for import of sugar under TRQ on , in the South Zone M/s. Dalmia Bharat Sugar and Industries Ltd. surrendered the quantity allocated to him i.e. 575 MTs. Similarly Madhucon Sugars and Power Industries Ltd, Khammam, Telangana surrendered its allotted quantity of 4313 MT. In the west zone, M/s. Dalmia Bharat Sugar and Industries Ltd Tiruchirapalli surrendered its quota of 3877 MTs. Thus in total, a quantum of 19,921 MTs of sugar is available for re-allocation in the south zone and similarly, 3877 MTs of sugar is available for re-allocation in the west zone. 5. The Committee, accordingly, considering the per day refining/ processing capacity of the applicants as per the minutes dated 26/4/217 and the formula adopted therein reallocated/revised the TRQ quantity as per the Annex-II. 6. Those applicants who do not want to take the additional import quota as revised in the Annex-II may surrender the additional quota only by writing to their respective RAs and DGFT(Hqrs) before 5 pm of 15 th May, 217. Once license is issued for such additional quantity and the applicant does not import raw sugar, the penalty provision will be applicable. All licensee are advised to get their additional quantity by getting their TRQ license amended from their respective RAs immediately.
