TERMS AND CONDITIONS PRICES Prices listed in this catalog are in effect from June 1, 2017 to May 31, 2018. Orders placed after May 31, 2018 are subject to new catalog pricing. Custom packaging, such as field potting, may be charged an additional fee. OBERSINNER NURSERY, INC. TERMS CASH. Established accounts are due 30 days from date of invoice. All past-due accounts will be charged 1-1/2% per month service charge (18% per anum). A deposit may be required. A signed credit application will be required before credit will be extended. A 25% deposit required for new customers. Prices subject to change without notice. Obersinner Nursery is not responsible for freight charges if customer fails to pay carrier. ORDERS, CANCELLATIONS AND ORDER CHANGES All orders must be shipped by May 15, 2018. Please notify us two weeks prior to your requested shipping date. Shipping is to be arranged by the customer. Notice of cancellations or changes of field potted orders must be received by October 1, all other spring order cancellations or changes must be received by January 1. If cancellations are not made in advance as defined above, and the cancelled material has been dug, our terms are that the order, including the cancelled items, will be paid in full. If the cancelled material has been graded and tagged but not dug, it is subject to a 10% cancellation charge. SUBSTITUTIONS In the event of growing conditions beyond our control, substitutions of like variety and hardiness within one size up or down may be necessary. If you cannot accept substitutions, it must be noted on the order. We also reserve the right to change or cancel any order prior to shipment. CLAIMS Plants damaged in transit should be noted by size, variety, and the extent of damage. This must be submitted to the carrier. Any other claims must be reported to Obersinner Nursery, Inc. within five days of receipt of stock. Claims will be adjusted at the discretion of Obersinner Nursery, Inc. A photograph of each plant for which a claim is requested must be provided to support the claim. In no case shall we be liable for any special, incidental or consequential damages, including, but not limited to: damages such as loss of profits, loss of use of the nursery stock, or injury to any other property including any claims arising from latent defects in purchased items. Under no circumstance shall the Seller be liable for any amount greater than the original purchase price, nor shall the Seller be liable for any freight costs. The exhibition of sample or model of the goods shall not be regarded as part of the basis of the bargain and shall not create an express or implied warranty that the whole of the goods shall conform to the sample or model.
