Page 8 of 8 Conditions of Use: 1. In these conditions Amadeus Food Limited is referred to as Amadeus, and customer means any person, firm or company to whom an application form for an account is issued and who applies for an account. 2. Credit facilities are available up to the credit limit specified by the customer in its application form, or such lower limit as may have been notified in writing to the customer not less than 48 hours before the opening of the exhibition to which the credit facility relates. 3. The account facility shall cease to be valid after the end of the exhibition to which it relates. 4. The account facility may only be used for facilities provided by Amadeus Food Ltd at Belfast Waterfront and Ulster Hall. 5. All purchases made pursuant to the use of the account facility will be charged by Amadeus Food Ltd to the customer s account with Amadeus Food and an invoice in respect of the total amount so charged will be sent to the customer. 6. The amount invoiced will be payable by the customer within 30 days of the date of the invoice. If payment is not made by the due date then, without prejudice to any rights and remedies available to Amadeus Food Ltd, the customer shall, in addition to the sum so due, Pay interest in line with the Late Payment of Commercial Debts (interest) Act 1998. The amount invoiced must be paid in full by the due date notwithstanding any disagreement by the customer as to the amount claimed, but any agreed repayment shall be made by Amadeus Food Ltd forthwith on demand. 7. Any representative of the customer placing orders and/or signing for purchases on behalf of the customer shall be deemed to have the full authority of the customer to do so. 8. Whilst Amadeus Food Ltd will endeavour to ensure that the credit limit applying to the customer is not exceeded, no undertaking is given by Amadeus Food Ltd that such limit will not be exceeded and the customer will be liable for the whole amount of the credit extended, whether or not that amount exceeds the relevant credit limit. * Payment interest in line with the Late Payment of Commercial Debts (interest) Act 1998. The amount invoiced. Conditions of Hire of Equipment: 1.All equipment remains the property of the National Exhibition Centre Ltd, registered office NEC Ltd, Birmingham, B40 1NT. ( The Owner ). 2. The period of the hire is for the duration of the exhibition for which the equipment has been booked. 3. The person signing the contract on delivery warrants that they have the hirer s authority to do so. 4. PAYMENT Payment may be made by Company Cheque, Access, VISA, AMEX, Diners and cash. But a refundable security equal to the replacement cost must be made in advance using any method of payment as listed. 5. Any security for the return of goods paid by the hirer shall be refunded if all hire and other charges have been paid and the equipment has, on inspection by the Owner after it has been returned, and found by the Owner to have been returned in clean and good condition. 6. The hirer shall, without prejudice, to any other right or remedy of the Owner pay a charge equal to cost of cleaning, repairing, reconditioning or replacing as the Owner considers necessary any of the equipment. or any part of it not returned in clean and good condition at the end of hiring. Any such charge fee for replacing any equipment shall equal the Owners replacement list price of the equipment current at the end of the hiring. 7. FORCE MAJEURE Whilst every effort will be made by the Owner to carry out any accepted contract, the performance of it is subject to variation or cancellation by the Owner, consequent upon Act of God, War, Riots, Strikers, Lockouts or other Labour Disturbances, Fire, Flood, Restrictions on the use of transport or labour or any other cause beyond the control of the Owner. In the event of the completion of the contract being frustrated owing to any of the above causes, the contract shall be deemed to be complete and the hirer shall be liable for payment of the percentage of the total contract deemed to have been carried out. 8. No variation of these conditions of hire and no conditions in any order or acceptance of the hire shall be effective unless agreed to in writing by the Owner. 9. The hirer undertakes to comply with any safety instructions for the equipment made available by the Owner. 10. Unless otherwise stated any price or rate quoted or published by the Owner is inclusive of value added tax which shall be payable to the Owner in addition to the price or rate. 11. The hirer is responsible for the safekeeping of all equipment including boxes, racks and cartons from the time of delivery until it is collected or returned to the Owner. For this we recommend you arrange ALL RISKS INSURANCE.
