ING! ING! ING! OUND BrewHa! is the craft beer festival of Thunder Bay, ON Twenty-sixteen boasted three sold out sessions, over 4000 people in attendance, 14 breweries, and 50 delicious beers. Well we re ready to do it all again... BrewHa! 2017 will take place on August 11 & 12, housed once again upon the award-winning Prince Arthur s Landing Festival Area in Thunder Bay, Ontario. Save the date because we ve dipped our toes into the frothy waters and it s time to aim higher. A goal of 150 beer varieties to celebrate Canada s 150. 150 beers for 150 years! 1. Application Process 1.1. We will accept food vendor applications until all spaces have been filled. This is an application; it does not guarantee acceptance. You will be notified of your status after we have received completed applications. We will not process your application if it is not completed correctly. Once accepted, you will receive an acceptance letter with a contract and fees due. This application kit will provide you with necessary information such as purveyor contact information, load in/out schedules, additional insurance/permit requirements, etc. 2. Fee/Payments 2.1. The fee for vendors will be a flat rate of $200 + HST. Additional fees may apply for any necessary tent, banner, utilities, ice, etc. 3. Booth Description 3.1. Please submit pictures with your application. Please note that unless otherwise specified, all vendors will be set up in a 10 x 20 space. Negotiation of space available additional fees may apply. The event welcomes specialty carts and food trucks. 4. Menu Choice 4.1. All menu items must not use utensils. All items must be eaten with fingers or on a wooden stick. Use of Styrofoam/plastic prohibited. Please fill out your menu choices. We will do our best to give selected vendors their first choice of menu items, but we cannot guarantee it. We do not want to have numerous vendors selling the same menu items, but we do not offer exclusivity. We will let you know what items you will be allowed to sell. While we cannot estimate what a vendor s sales could be, we will give advice on menu items/price points if we feel it is necessary to help a vendor maximize sales. 5. Beverage Policy 5.1. Food vendors may sell non-alcoholic beverages such as pop/soda, juice. No bottled water will be permitted. All other drinks must be pre-approved by the Event. No alcoholic beverages can be sold out of your booth at any time. Ice is available for purchase through the Event. 6. Load-in & Strike Schedule 6.1. Setup will occur: Friday, August 11 from 9:00AM until 1:00PM. 6.2. Tear-down will occur: Saturday, August 12 from 10:00PM until 12:00AM (midnight). 6.3. No set up or tear-down will be permitted during Festival hours. 6.4. Event Volunteers will be available for assistance. 7. License (let us promote you!) 7.1. The Food Vendor hereby grants a license to BrewHa Festival to use, without further compensation, Food Vendor s name, logo or other intellectual property supplied by Food Vendor to BrewHa Festival, or displayed at BrewHa Festival, in any and all promotional materials produced by BrewHa Festival, including, but not limited to use on BrewHa Festival s website, flyers, press releases, photography, advertising, souvenirs, displays and the like. 8. Thunder Bay District Health Unit 8.1. All approved vendors must register with the Thunder Bay District Health Unit with the form found on: http://www.tbdhu.com/eh/foodsafety/specialevents.htm 9. Indemnification (the fine print) 9.1. Food Vendor means the legal entity, whether corporate or individual(s) entering into this Food Vendor Application for BrewHa Festival and vendor has corresponding meaning. 9.2. BrewHa Festival, its Officers and Directors, employees, consultants, agents, affiliates, sponsors, volunteers, and the host facility (individually and collectively Event Management, as the context requires), shall not be responsible for injury (including death), loss, expense or damage to persons, goods, equipment or decorations, caused by accident, or any other cause, either directly or indirectly, during load in and out preparations or during the Event s scheduled duration (August 11-12, 2017). This applies to any injury, loss or damage to persons, goods, equipment or decorations which occurs during transportation of goods, and/or other cause. 9.3. Event Management shall be in no way whatsoever liable to a Food Vendor, their employees, agents, invitees, guests, affiliates, successors or assigns (together, the Vendor Agent ) for their participation at BrewHa Festival.
9.4. Food Vendor hereby releases, indemnifies and holds harmless, Event Management, for any and all costs, losses, damages, expenses, liability, and legal costs (on a full indemnity basis) incurred by Event Management, or such one or more of them, as a result of the vendor agent s breach of any of the terms and conditions of this application, any policies imposed by the BrewHa Festival, any conditions of the SOP, and any applicable law. 10. Other Policies 10.1. Serving is only permitted to attendees wearing an official event wristband. 10.2. Hey, don t drink before or at the event. No vendors are permitted to be under the influence of alcohol any time. 10.3. Only sell during event hours. No exceptions. 10.4. All vendors must abide by all local health, safety, alcohol, and fire regulations and all other laws at their cost. 10.5. Keep your booth/area tidy. All food vendors must provide a ground cover inside their booth/cooking area for the absorption of grease. No food vendor will be allowed to open for business if the ground cover is not in place. No grease or gray water is to be poured onto the ground or in an unapproved drain. Vendors are responsible to collect and bag garbage/recycling from within your booth space. Garbage/recycling bags will be provided to Vendors. If any garbage accumulates, please clean up. 10.6. All Vendors must leave their booth at the end of the Festival hours in a clean/tidy manner. Not doing so will result in a possible cleanup fee. 10.7. Don t hurt our things. Lost, stolen or damaged Festival property will be charged back to the vendor. 10.8. All vendors must have proper general liability insurance in the amount of two million dollars ($2,000,000) for participation in the 2017 BrewHa Festival and must name BrewHa Craft Beer Festival and the City of Thunder Bay as additional insured. Your policy must reflect the sale of food. 11. Important Information 11.1. Upon receipt of a fully executed Food Vendor Application, you will receive a phone call or email confirming your payment and entry. 11.2. Full payment must be submitted within 30 days of confirmation of menu items. 11.3. There are no refunds for a cancellation.
A SIGNED AND COUNTER-SIGNED VENDOR APPLICATION ACKNOWLEDGES THE ABOVE AND BELOW TO BE CONDITIONS OF CONTRACT. The Food Vendor by the execution of this document by its authorized representatives accepts the terms and conditions as set out herein and agrees to ensure compliance by its employees, agents, and representatives participating in the 2017 BrewHa Craft Beer Festival.
