Since the last edition of this catalogue, the range has grown largely, thanks to our efforts in breeding, both internationally and locally in Asia and India. Moreover, the acquisition of Century Seeds in 2012 has significantly reinforced our offer for Indian crops such as gourds, peppers or pumpkin to name a few. Following the branding change initiated in April 2015 all our products are now sold under CLAUSE brand. The new organization in India is combining the best of HM.CLAUSE India and Century Seeds to offer the best varieties and a renown seed quality which has been the backbone of HM.CLAUSE development in India since we started our activity here. RISKS: Title to products passes from the seller to the buyer on shipment from the seller. Loss or damage that occurs during shipping is the buyers responsibility. This is so even if shipped as free or ex-works and whatever the method of transport used: road, rail, Haulage Company, postal services, air, boat, etc. Likewise, barring particular conditions, the risks caused by any late delivery of the goods as well as any loss or damage caused to the goods during transportation and their possible consequences shall be solely born by the buyer. The Consignee is advised to refuse damaged products from the carrier on original delivery attempt. Should he have accepted the damaged products such damage should be noted on the carrier delivery record along with the consignee s signature, stamp and date. The product and the original box and packaging should be preserved and the seller notified within 24hours of receipt for it to arrange for a carrier inspection and a pick up of damaged products. Please notify the sellers Customer Relations personnel of the Seller of damaged products WITHIN THE FIRST 24 HOURS of receipt. Timely receipt of this information is necessary as the seller needs to file a damage claim within 48 hours. It is the consignees responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note/ seller s invoice. Any shortages must be noted on the consignment note and it will be the consignees responsibility to notify the seller within 24 hours of delivery. Any tampering with the seller s tapes and belts that seal the packing must be recounted fully. The consignees failure to observe these formalities prevents any action against the carrier. OWNERSHIP RESERVE CLAUSE: The seller expressly reserves the ownership of the delivered goods until the price has been fully paid by the buyer. In this respect and in the sense of the present clause, the remittance of bills or of any other instruments creating an obligation to pay does not constitute payments. In the event of seizure or of any other intervention by a third party, the buyer is obliged to notify the seller of this immediately and shall bear the responsibility of any risks whatever they may be, including in the case of loss or destruction.
