Quality Labelling Standard for Processed Foods (Notification No. 513 of the Ministry of Agriculture, Forestry and Fisheries of March 31, 2000) (UNOFFICIAL TRANSLATION) Established: March 31, 2000 Partially revised: December 19, 2000 (Scope of Application) Article 1. This standard shall apply to the processed foods (limited to those kept in container or package). (Definitions) Article 2. In this standard, the definition of terms in the left column of the following table shall be as given in the corresponding right column. Term Definition Processed foods Those listed in the Attached Table 1 as the foods manufactured or processed. Best-before date The date up to which it is considered that any product sealed in any (Date of unopened container or package adequately maintains all the quality minimum durability) characteristics expected of the product if the product is preserved according to the indicated instruction for storage. Use-by date The date up to which it is considered that any product sealed in any unopened container or package maintains the quality that is expected good enough to be taken as food if the product is preserved according to the indicated instruction for storage. (Matters to be Labelled Collectively) Article 3. Regarding the quality of processed foods, the matters to be labelled collectively by manufacturers, processor/packers or importers (distributors if the distributors are in a position to make the quality labelling on behalf of the manufacturers or processor/packers with the latter s agreement to it. Referred to as the manufacturer, etc. hereinafter) on the container or package of the processed foods shall be as shown below. However, this provision shall not apply to the case that any persons manufacture or process foods and sell them to general consumers directly or provides the facilities to have them eat or drink those foods. (1) Name 1

(2) Names of ingredients (3) Net contents (4) Best-before date (Date of minimum durability) (5) Instruction for storage (6) Name or trade name and address of manufacturer, etc. 2. With regard to the products where liquid packing media are added to solid products and then the final products are sealed in cans or bottles (except those in which the drained weight is difficult to control), the drained weight and the total quantity of contents shall be labelled in place of the matter listed in the preceding paragraph, Item 3 for the items labelled collectively on the cans or the bottles by the manufacturer, etc. However, this provision shall not apply to the case that the drained weight and the total quantity of contents are nearly the same or the purpose of adding liquid packing medium is only to protect the contents. 3. With regard to the products where liquid packing media are added to the solid products and the final products are sealed in containers or package other than cans or bottles, the drained weight may be labelled in place of the matter listed in Paragraph 1, Item 3 for the items labelled collectively by the manufacturer, etc. on the containers or packages other than cans or bottles. 4. With regard to the products that should be consumed promptly after manufactured due to its quickly changeable quality, the use-by date shall be labelled in place of the matter listed in Paragraph 1, Item 4 for the items labelled collectively on the containers or packages by the manufacturer, etc. 5. With regard to imported products, a name of country of origin shall be labelled in addition to the items labelled collectively on the containers or packages by the manufacturer, etc. 6. Notwithstanding the provisions of Paragraph 1 hereof, with regard to those products falling under the division given in the left column of the following table, the labelling items given in the corresponding right column may be omitted. Those containing a kind of ingredient only (except canned foods and meat products) Those of which net contents can be easily identified (except the specified commodities listed under Article 5 of the Government Ordinance for the Measurement Concerning Sale of Specified Commodities (Government Ordinance No. 249 of 1993) Those listed in the Attached Table 2 as the products that undergo very slight change of quality Those for which there is no particular instruction for storage other than the storage at an ordinary temperature Name of ingredients Net contents Best-before date (Date of minimum durability) and Instructions for storage Instructions for storage (Method of Labelling) Article 4. In labelling the matters provided in Items 1 through 5 of Paragraph 1 of the preceding article, drained weight and total quantity of contents in Paragraph 2 of the same article, drained weight in Paragraph 3 of the same article and use-by date in Paragraph 4 of the same article, the manufacturer, etc. shall comply with the provisions of the following items: (1) Name Name shall be declared with a common name expressing the content of the product. However, any product other than the processed foods listed in the left column of the Attached Table 3 shall not be labelled with the name provided under the corresponding right column of the same table. (2) Names of ingredients Names of ingredients shall be indicated as provided as below in accordance with the divisions in a to b. a. Names of ingredients other than food additives shall be indicated in descending order of weight percentage in the total ingredients. However, in the case that an ingredient consists of two or more ingredients (referred to as compound ingredients hereinafter), the names of the said compound ingredients shall be followed by brackets in which names of the component ingredients shall be indicated with the most common names in descending order of weight percentage in the said compound ingredient. In this case, if the weight 3

percentage of the compound ingredient in the total ingredients of the product is less than 5% or the name of ingredients can be easily identified from the name of the compound ingredient, the name of ingredients of the said compound ingredient may be omitted. b. Names of food additives shall be indicated in the descending order of weight percent in the total ingredients pursuant to the provisions of Article 5, Paragraph 1, Items (1) ( ) and (2), Paragraph 11 and 12 of the Enforcement Regulations of the Food Sanitation Law (Ministerial Ordinance No.23 of the Ministry of Health and Welfare of 1948). c. Notwithstanding the provisions of a. hereof, those products falling under the division given in the left column of the following table may be labelled with the names given in the corresponding right column. percentage in the total ingredients is not more than 2%] Savory herbs and garnishes and their processed products (limited to the case that its weight percentage in the total ingredients is not more than 2%) Fruits penetrated with syrup (limited to the case that its weight percentage in the total ingredients is not more than 10%) Fragrant grass or Mixed fragrant grass Crystallized fruit d. In the case that organic agricultural products [those provided under Article 3 of the Japanese Agricultural Standard of Organic Agricultural Products (Notification No. 59 of the Ministry of Agriculture, Forestry and Fisheries of January 20, 2000); the same shall apply hereinafter] or organic agricultural product processed foods [those provided under Article 3 of the Japanese Agricultural Standard of Organic Agricultural Product Processed Foods (Notification No. 60 of the Ministry of Agriculture, Forestry and Fisheries of January 20, 2000); the same shall apply hereinafter] graded under the provisions of Article 14 or Article 15 of the Law Concerning Standardization and Proper Labelling of Agricultural and Forestry Products (Law No. 175 of 1950; referred to as the Law hereinafter) are used as an ingredient, such product may carry the statement to the effect that the said ingredient is an organic agricultural product or an organic agricultural product processed foods. (3) Net contents Net contents of the specified commodities listed under Article 5 of the Government Ordinance for the Measurement Concerning Sale of Specified Commodities shall be indicated under the provisions of the Measurement Law (Law No.51 of 1992), and those of the other products shall be indicated by weight of contents, volume of contents or number of contents, and the weight of contents shall be mentioned in grams or kilograms, the volume of contents in milliliters or liters, and the number of contents in number, clearly stating the unit used respectively. (4) Drained weight Drained weight shall be mentioned in grams or kilograms clearly stating the unit used. (5) Total quantity of contents Total quantity of contents shall be mentioned in grams or kilograms clearly stating the unit used. (6) Use-by date or Best-before date (Date of minimum durability) 5

Use-by date or best-before date (date of minimum durability) shall be indicated as provided below: a. With regard to a product whose period from manufacture to use-by date or best-before date (date of minimum durability) does not exceed three months, it shall be mentioned by any of the following samples. However, if it is difficult to print. in the case of (b), (c) or (d),. may be omitted. In this case, if the month or the date is one digit, its second digit shall be represented by 0. (a) Heisei 12, April 1 (b) 12.4.1 (c) 2000.4.1 (d) 00.4.1 b. With regard to a product whose period from manufacture to use-by date or best-before date (date of minimum durability) exceeds three months, it shall be mentioned as provided below: (a) Mention shall be made by any of the following samples. However, if it is difficult to print. in the case of (ii), (iii) or (iv),. may be omitted, in which case, if the month or the date is one digit, its second digit shall be represented by 0. (i) Heisei 12, April (ii) 12.4 (iii) 2000.4 (iv) 00.4 (b) Notwithstanding the provisions of (a), mention may be made as provided in a. above. (7) Instructions for storage Instructions for storage shall be declared as Avoid the direct sunshine and store at the normal temperature, Store below 10 C, etc. according to the properties of the product. 2. All the matters provided in the preceding article shall be labelled at a conspicuous place of the container or package according to the Attached Form. However, if the container or package is packed by wrapping paper or paper box, etc., necessary matters shall be labelled on the wrapping paper or paper box, etc.; the wrapping paper or paper box, etc., shall be made so that the labelling on the container or package can be looked through; or the labelling on the container or package shall not be covered by the wrapping paper or paper box, etc. 6

(Labelling of Characteristic Ingredients, etc.) Article 5. In the case that any product has an indication to the effect that the product has employed the ingredients of a certain origin, organic agricultural products, organic agricultural product processed foods and other characteristic ingredients or where the name of any product shows that it has employed any characteristic ingredients, any of the percentages listed as below shall be labelled at a place in close proximity to the said labelling or in the brackets following the name of ingredients in Article 3, Paragraph 1, Item 2. However, if the percentage is 100%, the percentage may be omitted: (1) Weight percentage of the characteristic ingredient in the total of the ingredient of the product; or (2) Weight percentage of the characteristic ingredient in the mixture of the characteristic ingredient and the ingredient of the same kind as the characteristic ingredient (In this case, mention shall be made to the effect that it is the weight percentage of the characteristic ingredient in the mixture of the characteristic ingredient and the ingredient of the same kind as the characteristic ingredient.). 2. In labelling to the effect that a certain ingredient is used in only a small quantity, its weight percentage in the product shall be labelled at a place in close proximity to the said labelling or in the brackets following the name of ingredients in Article 3, Paragraph 1, Item 2. (Matters Prohibited from Labelling) Article 6. The following matters are prohibited from labelling: (1) Any wordings which conflict with those expressed in accordance with the provisions of Article 3; and (2) Any letters, pictures, photographs or other labelling which may give a wrong impression on the contents. (Other Standards of Quality Labelling of Processed Foods) Article 7. In labelling the quality of processed foods, manufacturers, etc. shall comply with the requirements otherwise provided by the Minister for Agriculture, Forestry and Fisheries than those provided under Article 3 through the preceding article. 2. If otherwise provided by the standards of quality labelling established by the Minister for Agriculture, Forestry and Fisheries under the provisions of Article 19-8, Paragraph 2 of the Law other than those provided under Article 3 through the preceding article and the preceding paragraph, such provisions shall apply. 7

The letters used for labelling shall be in the uniform-sized printing type and the size equivalent or larger than 8 point as provided for in the Japanese Industrial Standards (JIS) Z8305 (1962), provided that they may be a printing type of 5.5 point through 7.5 point as provided for in JIS Z8305 (1962) with respect to the maximum labelling area of approximately 150 cm 2 or smaller. 3.The items on which labelling is not made shall be omitted from among those listed in this form. 4. With respect to the products that are liable to deteriorate rapidly and should accordingly be consumed soon after produced, Best-before date shall be replaced with Use-by date. 8. In the case that it is difficult to show the frame of this form, it may be omitted. 13. With the matters to be labelled collectively as provided in the standard of quality labelling established under the provisions of Article 19-8, Paragraph 2 of the Law, the matters to be indicated provided in the fair competition code under the provisions of Article 10 of the Act Against Unjustifiable Premiums and Misleading Representations, and any matters to be labelled under the other laws and regulations, they may be indicated within the frame. Supplementary Provisions 1. This notification shall come into force on the date of enforcement of the Law Revising Part of the Law Concerning Standardization and Proper Labelling of Agricultural and Forestry Products. 2. With respect to the agricultural and forestry products other than those of which the standard of quality labelling have been stipulated under the provisions of Article 19-8, Paragraph 1 of the Law Concerning Standardization and Proper Labelling of Agricultural and Forestry Products prior to the revision by the Law Revising Part of the Law Concerning Standardization and Proper Labelling of Agricultural and Forestry Products, this notification shall apply to those which are manufactured, processed or imported on and after April 1, 2001. Supplementary Provisions (Notification No. 1,630 of the Ministry of Agriculture, Forestry and Fisheries of December 19, 2000) This notification shall come into force on the date of promulgation. NOTE: In labelling according to this standard, all the matters shall be stated in Japanese because the purpose of the quality labeling standards is to help general consumers choice (Article 19-8, Paragraph 1 of the Law). 15
