2016 Salinas Valley Food & Wine Festival ASSUMPTION OF RISK AND RELEASE I / We,, acknowledge that I / We have voluntarily applied to participate in festival activities, and any and all activities incidental thereto, in conjunction with the Salinas Valley Food & Wine Festival (collectively, the Activities ). 1. I / WE AM / ARE AWARE THAT THE ACTIVITIES INVOLVE RISKS, WHICH MAY LEAD TO SERIOUS INJURY OR DEATH. I / WE AM / ARE VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH THE KNOWLEDGE OF THE DANGER INVOLVED, HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH. a) As consideration for being permitted to participate in the Activities, I / we hereby voluntarily release, discharge, waive and relinquish all actions or causes of action for personal injury, property damage or wrongful death occurring to me / us as a result of engaging in the Activities, wherever or however the same may occur and for whatever period the Activities may continue, and I do for my / our / self / selves, my heirs, executors, administrators and assigns hereby thereafter arise for me / our estate, and Agree that under no circumstances will my / our heirs, executors, administrators or I / we and assigns prosecute, present any claim for personal injury, property damage or wrongful death against Salinas Valley Food & Wine Festival, and/or the Oldtown Salinas Foundation, a California non-profit tax deductible 501(c)3, or any of its officers, agents, servants, or employees (the Released Parties ) for any said causes of action, whether the same shall arise by negligence or otherwise. 2. A copy of this insurance and rider shall be provided to Salinas Valley Food & Wine Festival immediately upon notice of acceptance as a vendor. 3. I / WE AM / ARE AWARE THAT FOOD AND/OR BEVERAGES IS NOT ALLOWED TO BE SERVED OUTSIDE OF MY PERMITTED PREMISES. ALL FOOD AND/OR MUST BY PREPARED AND SERVED IN THE AREAS DESIGNATED BY THE MONTEREY COUNTY HEALTH DEPT. UNDER THE CURRENT HEALTH PERMIT. 4. I / WE AM / ARE AWARE THAT VEHICLE(S) ARE NOT ALLOWED ON FESTIVAL GROUNDS UNTIL SATURDAY, AUGUST 13, 2016 AT 8:00AM. I / WE AM / ARE AWARE THAT THERE WILL BE NO SECURITY OVERNIGHT ON SATURDAY. ANY ITEMS LEFT OUTSIDE OVERNIGHT ARE AT MY / OUR OWN RISK. 5. WINERY TERMS & CONDITIONS FORM Disclaimer: A completed application does not guarantee acceptance. Admission to the festival will be considered on a first come, first served basis determined upon a completed application AND payment (if applicable). Once spaces are filled completely, wineries will be placed on a wait list and notified should a space become available. Expectations and Requirements: Participating wineries are asked to bring enough wine to allow a 1 ounce pour tasting of each wine represented for an estimated 1,000 participants over 3.5 hours. Tasting is for SVFW Festival wristband holders only the general public may not partake of wine without paying. ( A minimum of 4 cases requested) Set-up time the day of the event will be from 8:00 am 10:30 am on August 13, 2016 in the exclusive venue selected for your winery in a business along Main Street. Wineries are asked to be ready to serve at 12:00 pm. A confirmation letter will be mailed prior to the event with your specific location assignment, parking information, and other miscellanous reminders (such as to confirm your event day pourer). Wineries may opt to drop off wine and display items in advance of the event day if the host venue is agreeable to such an arrangement. Absolutely no early closing. All wineries must stay for the duration of the festival, which concludes at 4:00 pm on August 13, 2016. Pouring will conclude at 3:30 pm and wineries are asked to remove their entire display from their host location and vehicles from Main Street by 6:00 pm. te: The Salinas Valley Food & Wine Festival has obtained an event permit to cover the pouring of alcohol in venues not holding a license to serve alcohol, so wineries will not need to provide a single-day permit. It is our understanding that you are covered under the event permit. However, you are still required to follow all rules and guidelines set forth by the Alcohol Beverage Control Board and the City of Salinas and may be subject to their inspection. The Salinas Valley Food & Wine Festival is not responsible should ABC or the City decide to close down your pouring location for violation of these standards. Cancellation Policy: A cancellation fee of $50 will be charged to participants for any cancellation after registration has been verified, and the logo posted on website. There will be a $25 fee for all returned checks. It is your responsibility to have read and understand what is outlined in this document for wineries participating in the Salinas Valley Food & Wine Festival.
