2016 Continuing Product Guaranty Dawn Food Products, Inc. ( Seller ) in consideration of the purchase, from time to time of food or other items by Buyer, hereby agrees as follows: 1. All goods, as of the date of shipment or delivery, a. are not adulterated or misbranded with the meaning of the U.S. Federal Food, Drug and Cosmetic Act; b. may be introduced into interstate commerce under Sections 404 and 505 of the U.S. Federal Food, Drug and Cosmetic Act; c. are not adulterated or misbranded within the meaning of the pure food or drug laws or ordinances of any U.S. state or city which are applicable to such shipment or delivery; d. comply with all applicable and material U.S. Federal, State, and Local law, including, but not limited to, the Consumer Product Safety Act and the Fair Labor Standards Act. 2. Seller does not guarantee against goods becoming adulterated or misbranded after shipment or delivery to Buyer, by reason or causes beyond Seller s control. In no event shall Seller be liable for any consequential damages suffered by Buyer. In those cases where goods are shipped under Buyer s brand label, Seller s responsibility for misbranding shall be limited only to that resulting from the failure of the article to conform to the purchase specifications or label furnished by Buyer, provided that Seller shall not be responsible for such misbranding if Buyer insists upon the use of Buyer s brand label after Seller has notified Buyer of the defects of the label giving rise to any such liability. 3. Dawn Products are all food grade products to which, water, yeast and/or other ingredients may be added or have been added to produce edible food items. It is our opinion that Material Safety Data Sheets (MSDS) are not required for our Dawn Products based on the definition of Chemical Hazard as defined in OSHA Hazard Communication Rule, 29 CFR 1910.1200. Dawn Products as food items are best protected when stored according to product specifications. Because of the physical nature of dry mixes and bases, one should avoid procedures that may cause dust to form. Airborne dust may result in an explosive mixture and/or act as an irritant to those working in the area. Dawn Food Products, Inc. cannot predict the uses of any of its products and denies any liability for injuries or illnesses that might be occasioned by unanticipated or non-normal product usage.
