WSWA 75 th Annual Convention & Exposition Caesars Palace, Las Vegas April 30 May 3, 2018 Checklist for suppliers NOT represented by Southern Glazer s Wine & Spirits Nevada Supplier Requirements: Supplier will be responsible for all import and customs clearance. Product must be sent to Southern Glazer s Wine & Spirits for delivery to the WSWA Convention & Exposition. Supplier is responsible for all unused product at the close of the show. Southern Glazer s Wine & Spirits will not be responsible for picking-up, handling, shipping or returning unused product. Only consumable product will be handled by SGWS warehouse. Non-consumable items such as POS material must be shipped directly to the show in accordance with WSWA published guidelines that can be found in the Freeman Service Manual or online at wswaconvention.org. All product shipped to SGWS warehouse must include a completed WSWA Alcohol Beverage Product List (see form), which includes name of supplier, contact information, complete product description, case pack, quantity, size and alcohol content. This form must be returned to WSWA per the instructions provided. Southern Glazer s Wine & Spirits can only deliver product to the venue dock and cannot be held responsible for delivery to your exhibitor locations. Freeman will deliver product to the various convention locations within Caesars Palace. For more information, see the WSWA Product Handling Guidelines in the Freeman Service Manual or online at wswaconvention.org under the Exhibitors tab. Paperwork, payment and product must be received at Southern Glazer s Wine & Spirits of Nevada by Friday, March 30, 2018. Mandatory paperwork to be submitted to Southern Glazer s Wine & Spirits Nevada PRIOR to receipt of product includes: Executed letter of indemnity see form Supplier information sheet for all products see form Completion of an LT08 form and COC (Certificate of Compliance) number. If you don t have a COC number, you will need to apply for one at Nevada Department of Taxation and pay all applicable fees directly to Nevada Department of Taxation in applying for a COC number - see form All product must be labeled as Samples Not for Resale If your product is being shipped INTO the United States and does not currently have distribution you must complete a COLA waiver. COLA waivers take time to process please DO NOT DELAY - see form

Billing information: $25.00 per case handling and delivery fee + the calculated state tax on goods. (to be calculated once goods are confirmed) Payment to Southern Glazer s Wine & Spirits must be made prior to the receipt of product. Payment must be made via wire-transfer or official business check see form Shipping information: All products must be received by SGWS by March 30, 2018. Product not received by March 30 th may not be delivered to the show and no refunds will be given to the supplier. COD or damaged goods will NOT be accepted. No more than two cases of each type of product can be shipped to SGWS warehouse. Only full cases will be accepted. The appropriate WSWA Destination Label must be affixed to the SIDE of each case. A copy of the label should also be included inside of the case in case the outside label is destroyed or removed during shipping. SGWS Inc. shall take commercially reasonable measures to deliver the described wine or liquor to the destination in the same condition in which the goods were received by SW&S Inc., and in a timely manner. SW&S INC. GIVES NO WARRANTY, EXPRESS OR IMPLIED, AS TO THE DESCRIPTION, CONDITION, QUALITY, AUTHENTICITY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR OTHER MATTER REGARDING THE GOODS TO BE DELIVERED. SHALL NOT BE LIABLE FOR: (1) any failures, neglects, or defaults of others in the distribution stream; (2) any Acts of God or acts of government or regulatory authorities that prevent, hinder or delay delivery; or (3) any consequential, or punitive or exemplary damages. Shipments of liquor to Nevada may be made only by suppliers with a valid certificate of compliance. It is unlawful for a supplier to ship or to sell intoxicating liquor directly to a retailer. A valid certificate of compliance permits the supplier to ship beer, wine or spirits to Nevada licensed importers or to consumers. Supplier Requirements 1. File a completed Certificate of Compliance application along with the $50.00 fee. 2. File a completed LT08 form naming all brands, for each designated importer, in accordance with the Prime Source law. This form must be filled out by the supplier, accepted by signature of the importer, and returned to the Department s Carson City office prior to shipping to Nevada. If the brands assigned are not owned by the shipper, a copy of original assignments from the manufacturer, producer or brand owner must be attached. 3. By the 10 th of each month, file a Report of Shipments of Alcoholic Beverages Into Nevada (LTD04) and attach legible copies of all invoices of shipments made the previous month. Each invoice must show total gallons of beer, wine or liquor. (no report required for months with no shipments to Nevada). 4. Renew annually by responding to renewal letter sent in May and paying the $50.00 fee. Direct Shipments to Exempt Persons for Personal or Household Use - Requirements 1. Ship no more than one gallon of liquor per month to a person in Nevada who is 21 years of age or older. Ship no more than 12 cases of wine per year to a person in Nevada who is 21 years of age or older and who is a Nevada resident. 2. Pay excise tax. NRS 369.490 provides for the direct shipment of liquor to persons for personal or household use. Effective June 7, 1999, a supplier who ships liquor into Nevada pursuant to NRS 369.490 subsection 2 (b) or (c) must pay the excise tax to the Department of Taxation pursuant to NRS 369.330. Tax returns must be filed with this Department on or before the 20 th of the month, along with the remittance of any taxes due, including penalty and interest if applicable. A tax return is due by the 20 th of each month, even if there were no shipments to Nevada.

Intoxicating Liquor Page 2 3. Collect and pay sales tax. Information and instructions are available in sales tax application packet. 4. A supplier who ships wine into Nevada pursuant to NRS 369.490 subsection 2 (c) must designate a Nevada importer/wholesaler if the supplier ships 25 cases or more of wine into Nevada in a fiscal year, if the supplier has not already designated an importer in Nevada. 5. A supplier who ships 200 or more cases of wine to Nevada residents in a fiscal year must pay a fee in the amount of $500 to this Department on or before the 30 th calendar day after the 200 th case of wine was shipped (NRS 369.466). The fee is only valid for the remainder of the fiscal year (ending June 30 th ) in which the 200 th case of wine was shipped. There is nothing in the Nevada Liquor Law pertaining to or restricting the bottling, labeling, or advertising of alcoholic beverages. To date Nevada has not enacted the Fair Trade Law. Attached is a certificate of compliance application, samples of LT 08 and LTD 04 forms, and a list of Nevada importer/wholesalers for your convenience. The Nevada Revised Statute may be accessed on the web: www.leg.state.nv.us Chapters 369 and part of 597. If anyone other than the owner or officer of your company will be signing documents on your behalf, a completed power of attorney must accompany this application.
