II SUBMISSION OF TENDER : Tender should be submitted in two parts ie. Part-I and Part-II ( price bid ) A PART- I : Part-I of the tender should contain the following documents: 1 Terms & Conditions duly signed and sealed by the Tenderer / Bidder 2 EMD should be given with details of Demand Draft and amount. 3 Attested copies of the valid ML4 / ML6 Licence issued by the Government of Tamil Nadu. 4 In case any tenderer/bidder is represented by any agent, a letter of authorization should be submitted by the tenderer/bidder. 5 If any tenderer fails to submit the above documents along with Part-I, his tender will be rejected summarily.
/ 2 / B PART- II 1. The Part-II of the tender document should contain quantity and price offer in the prescribed format. 2. The tenderer / bidder should not offer for a quantity less than 100 Metric tonnes..the Tenderer / Bidder may inspect the stock and check the quality of molasses before quoting the rates. Withdrawal of offer based on quality of molasses will not be permitted. In case, the total quantity offered at the highest price is less than the quantity available for sale, the H2 and others in descending order may be given an opportunity to match the H1 rate for the balance quantity. 3. Tender should be submitted in the prescribed form purchased from Tamil Nadu Cooperative Sugar Federation Ltd in a sealed cover superscribed as " TENDER FOR SALE OF MOLASSES WITHIN THE STATE OF TAMIL NADU DUE ON 05.11.2013." 4. The tender should be submitted either by Registered Post or delivered in person at the Tamil Nadu Coop Sugar Fedn Ltd, Periyar EVR Building, Vth floor, 690 Anna Salai, Nandanam, Chennai-600 035. 5. Tenders sent through Fax will not be considered. If the tender opening day is declared as holiday, the tender will be opened on the subsequent working day. The Tamil Nadu Cooperative Sugar Federation will not be held responsible for postal and other delays. Tender received after the due date and time will not be considered. 6. The tender should reach the Federation before 12.30 P.M. on 05.11.2013. 7. The tenderers who are submitting the valid documents along with the EMD alone will be allowed to participate in the auction. 8. The negotiation will be conducted only with H-1 tenderer. III. OPENING OF TENDER AND CONDUCTING AUCTION : 1 Part-I tender will be opened before the Molasses Sales Committee on 05.11.2013 at 3.00 P.M in the presence of the tenderers or their authorised representatives. 2 After evaluation of Part-I tender by the Molasses Sales Committee, the eligible tenderers will be declared and auction will be conducted immediately on the same day. The eligible tenderers alone will be allowed to participate in the auction. The upset price fixed for open auction is Rs.4500/- per MT.(Rupees Four thousand five hundred only) 3 Part-II (Price bid) will be opened after the end of the auction in the presence of the available tenderers/bidders.

EARNEST MONEY DEPOSIT (EMD) : 1 EMD should be paid at the rate of Rs.100/- per MT of the tendered quantity. 2 The EMD should be remitted by way of Demand Draft in favour of Tamil Nadu Coop Sugar Fedn Ltd payable at Chennai. 3 EMD shall be given with details of D.D.No., Date and Amount. 4 The EMD remitted for earlier tender will not be considered for this tender. 5 Tenders without EMD will be summarily rejected. 6 EMD of the un-successful tenderer / bidder will be refunded and it will not carry any interest. V. SECURITY DEPOSIT : 1 The successful tenderers should remit the Security Deposit with the Tamil Nadu Cooperative Sugar Federation Ltd on receipt of intimation of allotment of molasses @ 25% of the basic price per MT after adjusting the E.M.D. If the Security Deposit payable is lesser than the E.M.D, the E.M.D amount remitted will be taken as Security Deposit. The security deposit should be remitted within two working days of confirmation of tendered quantity and the rate by the Tamil Nadu Cooperative Sugar Federation, failing which, allotment of molasses will be cancelled and EMD will be forfeited. 2 The EMD and Security Deposit will be refunded only after satisfactory completion of the contract / agreement. VI RIGHTS OF THE MOLASSES SALES COMMITTEE : 1 The Molasses Sales Committee reserves the right to accept or reject the price and quantity quoted by the tenderers / bidders or to negotiate or to fix an open rate or to delete or include any mills in the tender or to increase / decrease the quantity notified and the decision of the committee shall be final. 2 The Molasses sales committee reserves the right to accept the whole or part of the offer or to reject a part or the whole of the offered quantity at its discretion, without assigning any reason therefor. VII DUTIES & TAXES : In addition to the price, the successful tenderer / bidder shall also remit the duties, taxes and other charges at the rate applicable at the time of despatches.
/ 4 / VIII PAYMENT & DELIVERY : 1 The purchaser shall remit the amount ( Price,duties,taxes and other charges ) for molasses by way of Demand Draft in favour of concerned Mills at the mill's counter during the office hours of the mills and lift the Molasses within the lifting time mentioned in the Sale Order. 2 Molasses will be delivered subject to availability of stock ( as is where is condition) only to the successful tenderers / bidders or his authorised agent at mill site. IX LIFTMENT OF MOLASSES : The successful tenderer / bidder should lift the molasses within the time limit stipulated in the sale order. X EXTENSION OF TIME FOR LIFTMENT : 1. Sanction of extension will be considered on genuine factors. 2. An additional rate of Rs.50/- (Rupees fifty only) per tonne per month will be levied for the unlifted quantity of molasses till the next tender. 3. Each extension is limited to 30 days, in addition to the original order of 60 days and there shall not be more than three extensions.. 4. If there is an upward revision in the rate of molasses during the extended time limit, the revised price approved in subsequent tenders or the price fixed in the last extension (exclusive of duties, taxes and other charges) whichever is higher will be applicable for the unlifted quantity of molasses. XI NON-LIFTMENT : 1 If the successful tenderer / bidder fails to lift the allotted quantity of molasses within the stipulated time as per the sale order / extension order, the Earnest Money Deposit and Security Deposit remitted by them / him, stands forfeited and the quantity un-lifted will automatically get lapsed. 2 In case of failure to lift the Molasses on or before the due date specified in the Sale order, the member factories / Tamil Nadu cooperative Sugar Federation shall have the right to dispose the unlifted quantity of molasses and the loss incurred, if any, by the factories, on account of re-sale of this molasses and differential price will be recovered from the tenderer / bidder who failed to lift the molasses. 3 If there is any deterioration in the quality of molasses due to nonliftement of molasses within the stipulated time, the loss to be incurred by the mills will be borne by the allottee.
/ 5 / 4 In case of failure on the part of the tenderer to remit the amount claimed towards loss within one week from the date of receipt of the claim, Tamil Nadu Cooperative Sugar Federation / concerned Mill will initiate action to recover the amount of loss sustained by each member Mill. 5 Non liftment of allotted quantity of Molasses from the Mill's premises within the stipulated time in the sale order / extension order will be the conclusive evidence for failure to perform the contract / agreement. XII COMPLIANCE WITH STATUTORY AND OTHER REGULATION : The successful tenderer shall, in all matters arising in the lifting of molasses, conform, at his own expenses, with the provisions of all Central and State Statute, ordinances or laws and the rules, regulations or byelaws of any local or other duly constituted authority and shall keep the sugar mills indemnified against all penalties and liabilities of every kind of breach of any law statute, ordinance, rule, regulation or byelaw by the Tenderer / their Agent. XIII AGREEMENT : The successful tenderer/ bidder should enter into an agreement with the Tamil Nadu Cooperative Sugar Federation. The cost of registering the agreement shall be borne by the tenderer / bidder XIV GENERAL : 1 The tenderer should keep the tender valid upto 05.02.2014. 2 Unless otherwise stated, the date & time wherever occurs including sale order, means the date or day that will close by 5.00 p.m. 3 The jurisdiction of the court for dispute, if any, arising out of this contract / agreement shall be Chennai City only.
