Rationale For Proposed Ordinance Passed in 1971, the previous ordinance is outdated. It is limited in scope and regulation. Existing ordinance left a lot of gray area, as many important issues were not addressed. We have received 3 inquiries so far this year.
Survey Responses Posted an ongoing mobile food vendor survey on social media and the city website since June 22 nd. 19 questions total. The survey had 109 responses. 81 respondents from Altoona, 24 from Eau Claire, 1 from Chippewa Falls, and 3 from other locations. 64 female and 42 male respondents. Age Breakdown: 26 (25-34 yrs. old), 21 (35-44 yrs. old), 22 (45-54 yrs. old), 33 (55 to 64 yrs. old), and 6 (65 to 74 yrs. old).

Purpose and Goals To regulate mobile and temporary food vending activities. To protect public health, safety, and welfare. To promote an active and social pedestrian environment. To promote the continued successful operation of existing brick and mortar restaurant establishments, while also providing fair opportunities for mobile food vendors. To provide residents and visitors with a variety of food options and a vibrant food scene in our community.
Ordinance Overview Straight forward and easy to navigate. Designed in the spirit of a pilot program. Specific locations and times of operation The ordinance may be amended if needed. City vendor licensing required if not in conjunction with a special event. Protection of existing businesses.
Different Types of Vendors Mobile Sidewalk Cart Mobile Food Truck Temporary Food Tent, Booth, or Stand Mobile Food Trailer
Annual Licensing Mobile food trucks, mobile food trailers, mobile sidewalk carts, as well as temporary food booths, tents or stands desiring to operate in the City of Altoona must be annually licensed by the city and the Eau Claire County Health Department, the State of Wisconsin, or other agency with jurisdiction if not operating in conjunction with a special event. A background check will be conducted for annually licensed applicants. The background check fee will be included in the cost of the annual license. If operating in conjunction with special events, the City of Altoona may require that special event organizers submit a list of vendor operator names for the purpose of conducting background checks. If background checks are required, then the fee of the background checks shall be paid by the vendors. The fee is noted in the fee schedule in chapter 3.08 of the Altoona municipal code.
Exempt from Annual Licensing Non-profit temporary food vendors operating fewer than 3 nonconsecutive times per year. Temporary Farm Stands Vendors operating in conjunction with special events
Designated Locations Parking is first come first served. Parking spaces may be occupied by nonvendors. Ice Cream/Dessert Trucks May also operate within residential districts within the public right of way.
Designated Times for Annual Permittees (Special events operation times are specified in permit) Mobile food vendors may operate in designated locations/areas for the duration of designated times of operation and are not required to move during designated times of operation. Mobile food vendors may operate on private property between 7 a.m. and 3 a.m. In addition to those times listed for designated locations, licensed ice cream/dessert vendors may operate Monday through Sunday, 11 a.m. to a half hour before sunset but no later than 8 p.m. Temporary Farm Stands may operate between 7 a.m. and 10 p.m.
River Prairie Location: Six (6) curbside parking spaces along the Community Plaza Mobile sidewalk carts may conduct business within the Community Plaza area Time: Sunday through Thursday: 10 a.m. to 9 p.m. Friday and Saturday: 7 a.m. to 10 p.m.
Downtown (1300 block of Lynn Ave.) Location: One (1) mobile food vendor may conduct business in either the designated parking spaces on the south side of the street in the 1300 block of Lynn Ave. or in the designated spaces within the Library/City Hall parking lot. At any given time, at most two (2) parking spaces may be occupied by a vendor in the parking lot. Mobile sidewalk carts may conduct business on the sidewalk along the south side of the street in the 1300 block of Lynn Avenue. Time: Sunday through Thursday: 10 a.m. to 9 p.m. Friday and Saturday: 7 a.m. to 10 p.m.
10 th Street Park Locations: Three (3) mobile food vendors may conduct business curbside in the designated area adjacent to the park on 9 th Street or within spaces in designated area (18 spaces) on the north side of Bartlett Ave. At any given time, at most 6 spots could be occupied by vendors. Mobile sidewalk carts may conduct business on sidewalks within and on the perimeter sidewalk. Times: Sunday through Thursday: 10 a.m. to 9 p.m. Friday and Saturday: 7 a.m. to 10 p.m.
Cinder City Park Locations: Three (3) mobile food vendors may conduct business in designated parking area (14 spaces) on the west side of the Cinder City Park parking lot area. Each vendor is allotted two (2) spaces. At any given time, at most 6 spots could be occupied by vendors. Times: Sunday through Thursday: 10 a.m. to 9 p.m. Friday and Saturday: 7 a.m. to 10 p.m.
Devney Park Location: One (1) mobile food vendor may conduct business in the designated parking spaces within the park parking lot. At any given time, at most two (2) parking spaces could be occupied by a vendor in the parking lot. Mobile sidewalk carts on sidewalks within and on the perimeter sidewalk. Times: Sunday through Thursday: 10 a.m. to 9 p.m. Friday and Saturday: 7 a.m. to 10 p.m.
Measures to Protect Existing Businesses Vendors may not operate within two hundred (200) feet of a public entrance of any licensed restaurant without permission from the business. This provision shall not apply during special events. River Prairie is exempt from this provision. During special events, vendors may not operate within one hundred (100) feet of any business selling the same or similar type products without permission from the business. Vendors shall not conduct business within five hundred (500) feet of any City of Altoona permitted special event without permission of the event organizer. No vendor shall conduct business in designated park locations if an Altoona Parks and Recreation Department approved concessionaire is open for operation, unless written permission is granted by the City.
