GENERAL TERMS: GOVERNING CLASSIFICATIONS AND EXCEPTIONS: This Tariff shall be governed by the following classifications and publications: Central Region General Tariff 1000 RCPE 7006 Switching and Accessorial Tariff Charge Catalog RCPE 6006 Extended Asset Use Tariff Charge Catalog Open and Prepay Station Listing OPSL 6000 Standard Transportation Commodity Code STCC 6001 TERMS AND CONDITIONS: All rates exclude loading and unloading, and drayage at origin or destination. Rates herein will be assessed in United States currency. Rates in United States will not include reciprocal switching charges unless noted on the individual rate item. Freight charges must be prepaid. Rates are subject to any applicable taxes, including the Goods and Services Tax and/or other sales taxes. EQUIPMENT CLASSIFICATION AND APPLICATION: Rates are subject to availability of equipment, unless otherwise specified. Application of rates for equipment is defined in each commodity section based on type of equipment and ownership or control thereof. COMBINATION RATES: Rates contained in this tariff can be used in combination with rates named in other publications to construct through rates only where specified in the rate item. Construction of such rates will not be made to defeat a through rate nor for aggregate of intermediate application at origin or destination or unless otherwise stated. Combination rates will divide as made.

PROPORTIONAL RATES: Proportional rates, which by their terms are limited in their application to traffic destined to, originating at, specific points or territories, including rates which are published for application of traffic when from beyond or when for beyond, apply only when the entire through transportation is performed by railroads by rail, subject to AAR accounting Rule 11. INTERMEDIATE APPLICATIONS: Intermediate application at origin or destination does not apply unless provided elsewhere in this tariff. ABSORPTION OF CONNECTING RAILROADS SWITCH CHARGES: Except as otherwise stated in individual rate items, rates published in this tariff do not include the absorption of connecting railroads reciprocal switch charges. STOPPING FOR COMPLETE LOADING OR PARTIAL UNLOADING Shipments made under the prices in this tariff will not be accorded stopping in transit privileges for completion of loading or for partial unloading. ROUTING: Routes are shown in individual rate items. The routing shown is in one direction only. When traffic is moving in the opposite direction, routing shall apply in reverse. TERMINAL RATES: A rate published from a specific origin to a specific destination via specific route. FUEL SURCHARGE APPLICATION: All rates originating on the RCPE in this tariff are subject to Fuel Surcharge Tariff 92000.

MAXIMUM GROSS WEIGHT LIMITATION ON LINE-HAUL TRAFFIC (LIMITED) The Maximum Gross Weight Limitation (MGWL) applies individually to equipment and track. The maximum gross weight limitation in equipment cannot exceed the sum of the lading weight and the stenciled tare weight of the car. The maximum gross weight limitation on track on Grain and Grain Products as specified in this tariff cannot exceed the track capacity for the station or routing as outlined in the individual items. Loading capacity: o Overload penalties as provided in the General Tariff and its Charge Catalogs will apply. o Maximum gross weight limitations outlined in this item apply only on traffic handled while in line-haul service on the RCPE property. It is the responsibility of the loading shipper to verify capacity limits of the connecting carriers. If a covered hopper car greater than or equal to 4,800 cubic feet in capacity are light loaded from the RCPE origin that is capable of handling 286,000 lbs MGWL, to a destination or via a route that is not 286,000 lbs MGWL capable, notation must be made on original billing or bill of lading that car has been light loaded. Failure to note on original billing or bill of lading will result in the high cap rate being assessed. If a covered hopper car greater than or equal to 4,800 cubic feet in capacity is placed for loading at a RCPE origin that is not capable of handling 286,000 lbs MGWL, car must be light loaded to a maximum gross weight limitation of not more than 263,000 lbs. 286,000 lbs MGWL covered hopper cars that are loaded from origins not capable of handling 286,000 lbs MGWL will be subject to overload penalties as provided in the General Tariff and its Charge Catalogs. The following origins must not be loaded to more than 263,000 lbs MGWL: o Aberdeen, SD, Belle Fourche, SD, Box Elder, SD, Buffalo Gap, SD, Mansfield, SD, Midland, SD, New Underwood, SD, Northville, SD, Oelrichs, SD, Philip, SD, Rapid City, SD, Redfield, SD, Wall, SD, Yale, SD and Chadron, NE. Where no rate is listed for covered hopper cars equal to or greater than 4,800 cubic feet in capacity indicates that this station or route is not capable of handling 286,000 lbs MGWL equipment and cars must be light loaded.

This charge is $2500 per car. RCPE does not and will not provide railroad owned or controlled covered hopper cars for the loading of animal proteins derived from non-ruminant animals as follows:

RCPE will handle these cars are requested by the customer. Therefore, RCPE is not party to a company s practices or policies in compliance with the Federal Regulations. Currently, all cars that carry an AAR N designation do so because they have handled ruminant material at some point in their loading history. RCPE does not require, but strongly encourages all shippers that own or lease rail cars used to transport ruminant materials to be kept completely segregated from non-ruminant materials. Non-ruminant materials that are directed for loading in cars that carry an AAR N designation must to destined to an end point of consumption respective of the proper end use of the product. On shipments moving on proportional rates to any gateway junction as named in this tariff, it shall be the responsibility of the party providing the billing and forwarding instructions to provide the RCPE with complete routing and ultimate destination. The RCPE will not accept billing consigned to an Agent and a named connecting line for furtherance. When ordering cars, the order number must be applied on the bill of lading. When an organic STCC is provided on billing instructions or bill of lading, an additional charge of $250 will be added to the base rate.
