1 AGENDA MEMORANDUM TO: FROM: Honorable Mayor and City Council Members Bryan Cobb, City Manager DATE: March 5, 2018 SUBJECT: Discuss the creation of a specific permissible use to allow Micro-breweries, Micro-distilleries, and Micro-wineries in the City Introduction: This is a request for City Council to provide direction regarding microbreweries as a permissible use in specific zoning districts in the City. Discussion: At its February 19, 2018, meeting, City Council directed Staff to research and prepare a discussion item to address possibly allowing Microbreweries as a permissible use in appropriate zoning districts. The City s Land Development Code does not address microbreweries as a permissible use in Table 4.1, Table 6.1, Table 6.4 or Table 6.9 that regulate permissible uses in all zoning districts in the City. The following is the summary of the LDC standards regulating uses associated with the sale of alcoholic beverages for consumption on the premises, such as restaurants serving alcohol and stand-alone bars or cocktail lounges: 1. LDC Section 5.6(G) allows bars and cocktail lounges accessory to bona fide restaurants (seating at least 45 patrons) wherever restaurants are allowed: In accordance with provisions of this LDC, no certificate may be issued for a bar or cocktail lounge offering alcoholic beverages for consumption on the premises that is not incidental to or within a portion of a building used for a bona fide restaurant seating not less than forty-five (45) patrons. Upon review and approval in accordance with the provisions of this LDC, a deviation may be granted for the required number of patrons in accordance with the deviation procedures of this LDC. 2. The LDC provides restrictions to stand-alone bars and cocktail lounges, currently allowed only in the New Downtown Development and Redevelopment Districts provided in Section 6.4, under entertainment uses. Table 6.4 that regulates uses in the New Downtown Village Core allows entertainment use as a permissible use and Table 6.9 allows entertainment uses as permissible uses subject to locational requirements (only on parcels which front Oviedo Boulevard or Central Avenue). Section 6.4(C) defines entertainment uses as the following: theaters, playhouses, concert halls, social clubs, banquet facilities, amphitheaters and attendant uses, nightclubs, bars, dance halls, video arcades, and like uses in which the principal function of the use is to provide entertainment to its patrons. Entertainment uses do not include recreational uses or problematic uses. 3. For zoning districts outside of the New Downtown Development and Redevelopment Districts, LDC Section 4.11(4) states Bars or cocktail lounges offering alcoholic beverages for consumption on the premises that are not incidental to or within a portion of a building used for a bona fide restaurant seating not less than forty-five (45) patrons.

For the Downtown Development Districts regulated by Section 6.2, the Code does not prohibit stand-alone bars and cocktail lounges but also does not allow them as permissible uses, so the same restrictions apply as provided in Article IV, in that they would only be allowed as incidental to a bona fide restaurant. A microbrewery as a use is not a bar or cocktail lounge. In general terms, it is a business with a limited-production brewery, typically producing specialty beers and often selling its products locally. Usually, it has an associated tap room, or tasting room or drinking area. It may offer food on-site such as snack or full meals or just provide the crafted beer. In some cases, food trucks on specific dates offer complementary food. In other cases, additional recreational uses are also allowed, such as yoga classes, movie nights and so on. There are also cases in which a whole area or building is designated as a food market and specific vendors occupy booths or units, one of them being a microbrewery. Therefore, microbreweries merge two distinct uses: a light manufacturing use and a drinking and/or food use component with some accessory entertainment uses. Microbreweries have been identified as a desirable use with the potential to help revitalize neighborhoods and to become an entertainment destination. Attachment 2 is a presentation from the 2015 Florida Chapter Conference of the American Planning Association (APA) that discusses the trend of microbreweries and the main topics associated with its use. With the emergence of microbreweries, literature has identified the potential emergence of similar uses, such as micro-distilleries and micro-wineries. Therefore, Staff also included those uses in the proposal for discussion. Staff supports the inclusion of microbreweries, microdistilleries and micro-wineries as permissible uses in the following zoning districts: By right in C-2 (the most intensive commercial zoning districts), I-1 and I-2, MUD-HDC, MUD-HDP, MUD-CHR, MUD-VC, MUD-NDA and MUD-NDB. Under special exception use order in C-1. In the Oviedo Marketplace PUD (to be included in the next amendment to the Oviedo Marketplace PUD). Since some breweries business models invite food trucks to join the establishment in regular times, microbreweries, micro-distilleries and micro-wineries in I-1 and I-2 will be allowed to have food trucks on-site. This will be added as a note to Table 4.1. Staff also proposes the following definitions to be included in the City s LDC: Microbrewery, micro-distillery and micro-winery. Establishments that can respectively brew beer, and/or distills spirituous beverages, and/or produces wine on a small scale not to exceed 50% of the business square footage. These establishments may include a tasting room and retail space to sell the local production for consumption on the premises and off premises, along with retail items and food. Bar or Cocktail lounge. Any establishment devoted primarily to the retailing and onpremises consumption of malt, vinous, distilled, or other alcoholic beverages. Micro-

The LDC also establishes the types of State Certifications required for each type of business dealing with the sale and/or consumption of alcoholic beverages: (1) Class I, to sell only beer or beer and wine in sealed containers for consumption off premises (1 APS and 2 APS). (2) Class II, to sell beer, wine and liquor in sealed containers for consumption off premises (quota liquor license, 3 PS, 3-APS, 3BPS, 3CPS, 3DPS). (3) Class III to sell beer or beer and wine for consumption on the premises and by package (1-COP, 2-COP). (4) Class IV to sell beer, wine and liquor by the drink, for consumption only on the premises, in a bona fide restaurant offering full course meals to one hundred fifty (150) or more patrons and providing floor space of at least two thousand five hundred (2,500) square feet, all under a permanent type roof (Series 4-COP-SRX); or to sell beer, wine and liquor by the drink for consumption only on the premises in bowling establishments containing twelve (12) or more lanes (4-COP-SBX); or to sell beer, wine and liquor by the drink for consumption only on the premises at a golf club or tennis/racquet ball club with not less than ten (10) regulation size courts (Series 11-C and 11-CX). (5) Class V to sell beer, wine and liquor for consumption on the premises and by package (Quota liquor license, series 4-COP); and to sell beer, wine and liquor at certain hotels and motels for consumption on the premises and by package (Series 4-COP-S); and to sell beer, wine and liquor by the drink only, for consumption on the premises at fraternal and benevolent clubs (Series 11-C). The City does not issue the alcoholic beverage license. It is issued by the Florida Division of Alcoholic Beverages and Tobacco. The City signs off on the license verifying that the use is a permissible use for the particular zoning district. Staff is not proposing to connect the definition of microbrewery, micro-distillery and micro-winery uses to the type of license of the establishment since they may vary if the business just sells beer for consumption on-premises and by package in sealed containers for consumption off-premises (1-COP), beer and wine for consumption on-premises and by package in sealed containers for consumption off-site (2-COP), or beer, wine and liquor for consumption on-premises and by package in sealed containers for consumption off-premises (license dependent on the County population). Most microbreweries and micro-wineries should obtain a Class III license (2-COP), which gives the establishment the right to sell beer and wine for consumption on-premises and by package in sealed containers for consumption off-premises. The manufacturing side also requires specific licenses. Budget Impact: There is no budget impact associated with discussing allowing Micro Breweries, Micro-distilleries and Micro-wineries as permissible uses in appropriate zoning districts. Strategic Impact: Promote diversification of the local economy. Foster redevelopment of business and commercial areas. Pursue development of Oviedo on the Park. Foster

Revise city codes to promote redevelopment. Recommendation: It is recommended that City Council provide direction regarding amending the LDC to allow micro-breweries, micro-distilleries, and micro-wineries as a permissible use in specific zoning districts in the City and declare the matter zoning in progress. 9 Discussion What to allow: Allow bars or tap bars only associated with micro breweries. LDC fix: include micro breweries as a new use in Table 4.1 and 6.1 and include a definition of micro brewery as a non-bar. Also include a percentage of the manufacturing side of the microbrewery. Connect to the type of license Class III. Allow similar uses, such as micro-wineries and micro-distilleries. 25 Economic Impact Brewers Alliance: Small and independent American craft brewers contributed $33.9 billion to the U.S. economy in The figure is derived from the total impact of beer brewed by craft brewers as it moves through the three-tier system (breweries, wholesalers and retailers), as well as all non-beer products like food and merchandise that brewpub restaurants and brewery taprooms sell.

26 Employment The industry also provided more than 360,000 jobs, with 108,440 jobs directly at breweries and brewpubs, including serving staff at brewpubs. Per Scott Metzger (UT San Antonio) Anheuser- Busch employs 116,000 people worldwide to sell 335 million barrels of beer. That s 2,888 barrels per employee. Craft Brewing employs 103,000 individuals to sell 11.5 million gallons of beer. That s 112 barrels per employee. As the activity shifts away from large multinational producers, by default, more jobs will be created. Per the Florida Brewers Guild, While our brewers comprise only five percent of the total beer sold in Florida, they provide approximately 85 to 90 percent of all beer-related jobs.
