1 Environmental Public Health ORDER OF AN EXECUTIVE OFFICER NOTICE OF CLOSURE To: Donair Station Inc. Hijrat Shah the Owner RE: The food establishment located in Calgary, Alberta and municipally described as: Donair Station Avenue SW WHEREAS I, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended; AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder in any manner the prevention or suppression of disease, namely: a. There was no prepared sanitizer for food contact surfaces or food handling areas. b. Shisha assembly, lighting and washing station was in the food handling/storage area. c. There was a container of concentrated bleach stored in the food storage area. d. The walk-in cooler air temperature measured 19.7ºCelsius and the internal temperature of food measured 18.5ºCelsius. e. The prep cooler aire temperature measured 22ºCelsuis and the internal temperature of food measured 25.7ºCelsius. f. Cooked chicken shawarma meat stored in a heating unit measured 42ºCelsius. g. Cooked donair meat from the previous day was reheated in the hot-holding unit and measured 13ºCelsius. h. The thermometer in the walk in cooler was not operational. i. The handwash sink was disconnected and removed from the wall. j. There was no soap or paper towel dispensers at the handsinks in food handling areas. k. The shelves were lined with a soft, absorbent, non-durable material. l. Walls were unfinished and the insulation was exposed in the food handling area. m. Electrical wires were exposed in several areas of the kitchen. n. Many items such as construction equipment, vacuums, etc that are not associated with food preparation, were stored in the kitchen. o. Fly traps were stuck to the walls directly above the food preparation area. p. The food establishment was undergoing construction while preparing and serving food. q. Plans for renovations were not submitted to AHS prior to the start of construction.

2 Page 2 of 5 AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Food Regulation, Alberta Regulation 31/2006 and the Food Retail and Foodservices Code exist in and about the above noted premises, namely: a. There was no prepared sanitizer for food contact surfaces or food handling areas. This is in contravention of section 28(2) of the Food Regulation, AR 31/2006 which states that: A commercial food establishment, all equipment and utensils in it and all surfaces in it with which food comes into contact must be maintained in a sanitary condition and, without limiting the foregoing, must be washed and sanitized in a manner that removes contamination. b. Shisha assembly, lighting and washing station was in the food handling/storage area. This is in contravention of section 23(1) of the Food Regulation, AR 31/2006 which states that: All food used or to be used in a commercial food establishment must be protected from contamination and handled in a sanitary manner. c. There was a container of concentrated bleach stored in the food storage area. This is in contravention of section 20(2) of the Food Regulation, AR 31/2006 which states that: Chemicals, cleansers and other containers that are not intended to be used to store food and that are clearly labeled to identify their contents, and in such a manner as to prevent the contamination of any food or food area. d. The walk-in cooler air temperature measured 19.7ºCelsius and the internal temperature of food measured 18.5ºCelsius.This is in contravention of section 25(1) of the Food Regulation. AR 31/2006 which states that: High risk foods must be kept at a temperature of less than 4C or greater than 60C at all times. e. The prep cooler air temperature measured 22ºCelsuis and the internal temperature of food measured 25.7ºCelsius. This is in contravention of section 25(1) of the Food Regulation. AR 31/2006 which states that: High risk foods must be kept at a temperature of less than 4C or greater than 60C at all times. f. Cooked chicken shawarma meat stored in a heating unit measured 42ºCelsius. This is in contravention of section 25(1) of the Food Regulation, AR 31/2006 which states that: High risk foods must be kept at a temperature of less than 4C or greater than 60C at all times. g. Cooked donair meat from the previous day was reheated in the hot-holding unit and measured 13ºCelsius. This is in contravention of section 24 of the Food Regulation, AR 31/2006 which states that. All food processing must be done in a manner that makes the food safe to eat. h. The thermometer in the walk in cooler was not operational. This is in contravention of section 26 of the Food Regulation, AR 31/2006 which states that: An operator shall ensure that all refrigeration and hot holding equipment used in the food establishment are capable of maintaining the respective temperatures required by section 26 and equipped with an accurate thermometer. i. The handwash sink was disconnected and removed from the wall. This is in contravention of section 17(1)(e) of the Food Regulation, AR 31/2006 white states that: An operator must ensure that a commercial food establishment has handwashing stations, adequate in number and location, to ensure convenient access to all food handlers. j. There was no soap or paper towel dispensers at the handsinks in food handling areas. This is in contravention of section 30(4) of the Food Regulation, AR 31/2006 which states that: Hand sinks must be maintained and kept supplied. k. The shelves were lined with a soft, absorbent, non-durable material. This is in contravention of section 28(3) of the Food Regulation, AR 31/2006 which states that: All equipment and utensils in a food establishment must be kept in good working order and condition and maintained in a manner that ensures the safe and sanitary handling of food.

This is in contravention of section 17(1)&19 of the Food Regulation, AR 31/2006 which states that: An operator shall ensure that a food establishment is of sound contraction and in a good state of repair and is so designed as to facilitate that effective cleaning and sanitizing of it and all equipment, utensils and surfaces with which food comes into contact in it. m. Electrical wires were exposed in several areas of the kitchen. This is in contravention of section 17(1) & 19 of the Food Regulation, AR 31/2006 which states that: An operator shall ensure that a food establishment is of sound contraction and in a good state of repair and is so designed as to facilitate that effective cleaning and sanitizing of it and all equipment, utensils and surfaces with which food comes into contact in it. n. Many items such as construction equipment, vacuums, etc that are not associated with food preparation, were stored in the kitchen. This is in contravention of section 28(1) of the Food Regulation, AR 31/2006 which states that: A commercial food establishment must have all the facilities, equipment and utensils that are necessary to ensure its safe operation and maintenance. o. Fly traps were stuck to the walls directly above the food preparation area. This is in contravention of section s 28(2) of the Food Regulation, AR 31/2006 which states that: A commercial food establishment, all equipment and utensils in it and all surfaces in it which food comes into contact must be maintained in a sanitary condition and, without limiting the foregoing, must be washed and sanitized in a manner that removes contamination. p. The food establishment was undergoing construction while preparing and serving food. This is in contravention of section s 28(2) of the Food Regulation, AR 31/2006 which states that: A commercial food establishment, all equipment and utensils in it and all surfaces in it which food comes into contact must be maintained in a sanitary condition and, without limiting the foregoing, must be washed and sanitized in a manner that removes contamination. q. Plans for renovations were not submitted to AHS prior to the start of construction. This is in contravention of section 16 of the Food Regulation, AR 31/2006 which states that: A person shall not construct or make alterations to a food establishment unless plans and specifications for the construction or alteration, as the case may be, have been approved by an Executive Officer. AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to be Closed. NOW THEREFORE, I hereby ORDER and DIRECT: 1. That the Owner immediately close the above noted premises. 2. That the Owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely: a. Ensure sanitizer is prepared. b. Remove shisha and shisha related products away from the food preparation or storage areas. c. Install a sink for washing shisha equipment and ensure it is not in the food handling or storage areas. d. Remove all chemicals from food handling and storage areas.

4 Page 4 of 5 e. Repair or replace the walk-in cooler the refrigeration equipment must maintain a temperature of 4ºCelsius or below. f. Repair or replace the prep cooler the refrigeration equipment must maintain a temperature of 4ºCelsius or below. g. Discard any perishable food that was stored in the walk-in cooler and preparation cooler. h. Reheat all potentially hazardous foods to a temperature of 74ºCelius or above. i. Obtain working thermometers. j. Replace and install the handwash sink. k. Install a soap and paper towel dispenser at the handsink. l. Remove non-durable lining from shelves. m. Finish all walls so they are smooth, durable and easily cleanable. n. Cover all electrical wires and outlets. o. Remove all items from the food handling and storage areas that are not associated with the operation of a food establishment. p. Remove fly traps from above the food preparation area. q. Complete all construction and renovations prior to seeking approval to operate a food establishment. 3. That until such time as the work referred to above is completed to the satisfaction of an Executive Officer of Alberta Health Services; the above noted premises shall remain closed. The above conditions were noted at the time of inspection and may not necessarily reflect all deficiencies. You are advised that further work may be required to ensure full compliance with the Public Health Act and regulations, or to prevent a public health nuisance.
