Property The client is responsible for the conduct of the clientʼs guests and indemnifies the restaurant for all costs, expenses, damage and loss caused by any act made by the client or the clientʼs guests. Any damage caused by guests to Mosmans will be the financial responsibility of the organizer. Deliveries All deliveries to the venue must be advised to the Function Coordinator prior and marked with the name and date of the function. All deliveries to the venue can be made 24 hours prior to an event, and need to be collected before 11am on the following day. Signage Nothing is to be nailed, screwed, stapled or adhered to any wall, door or other surface of the building. Signage in public areas is to be kept to a minimum and must be approved by the Venueʼs management. Numbers Guaranteed minimum number of guests required by fourteen (14) working days prior to the function date. When final numbers received, client will be required to pay final balance. Final number of guests given at this time will be charged for. Damage & Loss We do not accept responsibility for damage to, or loss of, any client property left on the premises prior to, during or after a function (including hired equipment/goods). Clients are financially responsible for any damage to fittings, property or equipment by themselves, guests and outside contractors, prior to, during or after a function. Insurance The Venueʼs staff are always extremely careful when looking after guests belongings, however accept no responsibility for the damage or loss of property left in the venue prior to, during or after a function. The onus to arrange insurance is that of the clients. Menu The menu must be chosen four weeks prior to the event. Payment A non-refundable $2500 deposit to be paid upon confirmation of date. $5000 instalment to be paid 6 months prior to the wedding date and $5000 to be paid 3 month prior to the event. Final balance to be paid 7 days prior. No invoicing after an event. Payments can be made via credit card or EFT. American Express and Diners attract a 3% surcharge, and Visa and Mastercard 1% surcharge. Pricing Prices are based on current and expected cost increases, any change in price will be advised within 30 days. All prices are inclusive of GST. Suppliers The Venue has no restrictions on suppliers, however please advise your function & Set up co-ordinator of who is delivering, contact numbers and times of deliveries to be discussed. The suppliers are responsible for pick up and delivery within the venues guidelines. Please note set up from 4.00pm. If extensive set up is required a fee can be negotiated with your coordinator for lunch closures. Entertainment Please note we are adjacent to a residential area and in order to ensure responsible noise levels all musical entertainment is required to operate through our in house PA system. We strongly recommend that if you choose a third party supplier for this aspect of your wedding day that they visit the venue in advance to assess the systems and connections required. Duty of Care Under the liquor licensing laws of Western Australia we have a duty of care to all our clients and reserve the right of our duty manager to refuse service of alcohol to persons he/she deems are intoxicated and may do harm to themselves other patrons or property. 13
Confirmation The booking is confirmed when we receive the deposit. Payment of the deposit is your acceptance of these terms and conditions.the venue will be under no obligation to proceed with the event if the deposit or full payment has not been received. Payments Full payment must be received and cleared 7 days prior to the event being held. A 50% fee is payable per person if numbers fall below minimum requirements. Children and suppliers are not included in the final number. Tentative Bookings can be held for 7 days and will be automatically released after this period. An instalment of $5000 is required 6 months prior to the event and $5000 3 months prior to the event. Payment balance and numbers to be finalised 14 days prior to the event date. Credit card payments attract a 3% surcharge so where possible please transfer funds to our bank account: BSB 016 002 ACCT 481955042 quoting your name and event date in the notes. Cancellation If the client cancels the booking, the restaurant must be notified in writing. Mosmans Restaurant will be entitled to retain the inital deposit paid as well as other instalments paid. If cancellations occur within : *3 months prior to the event- the deposit and instalments forfeited *4 weeks prior to the event- the client is liable for 50% of the total perceived event amount *1 week prior to the event- the client is liable for 100% of the total perceived event amount Cancellation Mosmans Restaurant reserves the right to cancel an event if: any circumstances occur outside its control, if full payment has not been received prior to the event date, if the booking may cause damage or prejudice the reputation. In the event of cancellation by the restaurant, Mosmans may at its discretion refund any advance payment but will have no further liability to the client. 14
