3 2016 Fire Pits Frequently Asked Questions Can I have a fire pit in Kimberley? Yes, but only as a barbeque fire pit for food preparation only. Do I need a permit to use my barbeque fire pit? Yes, the City of Kimberley regulates the installation and use of barbeque fire pits under Schedule B of Open Burning Bylaw # Is there a charge for my permit? No, permits are currently free of charge. Does my fire pit require an inspection by the fire department? Yes, prior to issuing a permit your barbeque fire pit must be inspected by fire department personnel to ensure that it meets the bylaw requirements. A barbeque fire pit inspection form must be competed and submitted to the Fire Department. How long will it take to receive a permit once I request a barbeque fire pit inspection? It could take up to 7 working days for your permit to be issued. It is important that you do not use your barbeque fire pit is not used until you receive your permit. How long is my permit good for? Permits expire annually on December 31 at midnight. A reminder may be sent by near expiration but it is important to know that the submission of a permit renewal request is your responsibility. A renewal request can be easily submitted by to Fire@Kimberley.ca or by calling (250) weekdays between 8:00 a.m. and 4:30 p.m. Are there specifications regarding the construction and location of my fire pit? Yes, the diagram provided outlines the minimum safe distances and maximum size along with a description of acceptable materials and screen requirements. Can I use a commercially constructed fireplace or chiminea? Often permits are not issued for these devices. Commercially constructed fireplaces and chimineas are not recommended unless they are permanently attached to solid ground while following the other construction and placement requirements. Additionally they must be screened and configured in a way to allow for food preparation. It is recommended that the Fire Department be consulted prior to purchasing and installing any of these devices to ensure their suitability. Are there time limits regarding the use of my fire pit? Yes, barbeque fire pits can only be operated between the hours of 3:30 pm until 11:00 pm.
4 2016 Fire Pits Frequently Asked Questions cont d Can I burn yard waste materials in my fire pit? No, only clean dry wood must be used. What about the smoke I create? If smoke from your barbeque fire pit is creating a valid nuisance for your neighbours, you will be ordered to discontinue the use of the fire pit. What about fire bans? The City of Kimberley follows recommendations by the Province regarding open burning bans. During fire bans barbeque fire pit permits will be suspended until the ban is lifted. Provincial information is available online at: status How will I know there is a ban? The City posts fire ban information on and on its Facebook page. As well notification will be sent to the you provided when your permit was issued. It is important to note that it is your responsibility to ensure that there are no bans in place. Are there fines for misusing my fire permit? Yes, there are fines for misusing your fire pit. Fines start at $ and escalate for various reasons. Barbeque fire pit permits can be revoked for major or repeated infractions. I rent or lease the home I am in. Can I get a barbeque fire pit permit? Yes, but the fire department requires written confirmation from the homeowner giving you permission to use a barbeque fire pit on the rented or leased property. The letter must also confirm that the owner has reviewed the rules and regulations related to the installation and use of the barbeque fire pit. 5 SCHEDULE B CITY OF KIMBERLEY BARBEQUE FIRE PIT REGULATIONS 1. Every person carrying out open burning within a back yard barbecue fire pit must comply with all requirements of the City of Kimberley Open Burning Bylaw, these Barbecue Fire Pit Regulations and all other special terms and conditions imposed on a permit by the Fire Chief. Where a person fails to comply with all such requirements, terms and conditions, the Fire Chief may suspend or revoke the permit and it shall be unlawful to carry out further open burning in the backyard barbecue pit. 2. Barbeque fire pits must be masonry, brick or steel (solid). Maximum dimensions: 18 high by 24 wide. (See reverse) 3. Acceptable spark arrestors must be installed on top of the barbeque fire pit ring to stop any sparks from becoming airborne (size ¼ to ½ maximum). 4. There must be a minimum six-foot diameter non-combustible surface around and under the barbeque fire pit area (i.e. crushed rock, paving stones, concrete). There must be a minimum 10-foot clearance from any structure or fence. 5. An Annual Burning Permit is required from the Fire Department and permits are issued during the hours of 8:00 am 4:30 pm Monday to Friday. 6. Barbeque fire pits must only be used for the preparation of food. 7. Barbeque fire pits must only be operated from 3:30 pm until 11:00 pm and all fires must be completely extinguished by 11:00 pm. 8. If air quality indexing is unacceptable or if there is a fire ban declared within City limits, there will be no permits issued and it will be illegal to use the barbeque fire pit. 9. Any barbeque fire pit constructed within the boundaries of the City of Kimberley must be INSPECTED and APPROVED by the Fire Chief or his designates.
