1 Department of Planning & Development Services S T A F F R E P O R T October 11, 2013 CASE NO: PROJECT: EXECUTIVE SUMMARY: REQUEST DETAILS: ZA Specific Use Permit for a Temporary Construction and/or Sales Facility Hines GTIS Carillon LLC is requesting approval of a specific use permit for a temporary construction and/or sales facility located at 1845 Riviera Lane. SPIN # 3. Hines GTIS Carillon LLC is requesting approval of a specific use permit in order to keep an existing temporary sales facility on Lot 1R, Block 20, Carillon Phase 1A in the Carillon development. The existing facility was permitted by right in December 2011 prior to the adoption of Ordinance 480-IIII which required a specific use permit approval by City Council. The applicant is requesting the permit be valid until construction of the community is completed. The anticipated completion date is mid-year Under Zoning Ordinance 480, as amended, Section 45.18, the following regulations were adopted under Ordinance 480-IIII: 1) The City Council may grant a specific use permit to increase the maximum parameters set forth for temporary construction facilities by Section 34 of this ordinance and may grant a specific use permit to allow temporary sales facilities subject to the following standards: (a) Temporary facilities must be at least two hundred (200) feet from any occupied residence. (b) Temporary facilities must be skirted on the front and sides. (c) Temporary facilities must provide foundation landscape planting consisting of one (1) five-gallon shrub per four (4) linear feet around skirting (excluding entrances). (d) Each temporary facility shall have at least two (2) paved parking places (two (2) deep, tandem parking is not permitted). ZA (e) Temporary facilities may also be subject to other requirements as deemed necessary in order to promote public health, safety, welfare and aesthetics.

2 Variance Requests: The existing temporary sales facility is approximately 90 feet from the first occupied residence to the south and does not meet the distance criteria (a). The existing facility does not have the required landscaping on the south side. There is an existing model home which is approximately 10 feet from that side of the facility. There is also a masonry wall and open space area on the north side which blocks view from any required landscaping to the north side of the facility(c). 3 BACKGROUND INFORMATION APPLICANT/OWNER: PROPERTY SITUATION: LEGAL DESCRIPTION: LAND USE CATEGORY: CURRENT ZONING: HISTORY: Hines GTIS Carillon LLC 1845 Riviera Lane Lot 1R, Block 20, Carillon Phase 1A Mixed Use ECZ Employment Center Zoning District On November 18, 2008 the City Council approved Zoning Change and Development Plan for Carillon under Planning Case ZA On May 5, 2009 the City Council approved a Preliminary Plat for Carillon under Planning Case ZA A final plat for Carillon Phase 2A-2 was approved by the Planning and Zoning Commission on May 3, 2012 under Planning Case ZA On September 4, 2012 the City Council approved a revised Zoning Change and Development Plan for Carillon under Planning Case ZA On June 18, 2013 the City Council approved a Specific Use Permit for a temporary sales trailer located at 1601 Riviera Lane. The permit expires June 21, Planning Case ZA Building permits were issued by right in December 2011 for the sales facility that currently exists and is being considered for approval under this application. STAFF COMMENTS: The City Council shall consider the following in determining whether to grant a Specific Use Permit for a temporary construction and/or sales facility according to the Comprehensive Zoning Ordinance No. 480, Section 45.18, as amended: 1) The City Council may grant a specific use permit to increase the maximum parameters set forth for temporary construction facilities by Section 34 of this ordinance and may grant a specific use permit to allow temporary sales facilities subject to the following standards: (a) Temporary facilities must be at least two hundred (200) feet from any occupied residence. (b) Temporary facilities must be skirted on the front and sides. (c) Temporary facilities must provide foundation landscape planting consisting of one (1) five-gallon shrub per four (4) linear feet around skirting (excluding entrances). Attachment A ZA Page 1
