(b) Supply is subject to sufficient stock being available for sale at the time of ordering. (c) Any retail price set out or referred to herein is a recommended price only and there is no obligation to comply with the recommendation. RETENTION OF TITLE CLAUSE (a) Risk in the goods shall pass to the Purchaser at the date of delivery and the Purchaser will ensure all goods that are at his risk. (b) Not withstanding that the risk shall pass to the Purchaser as herein provided, title to the goods shall remain the absolute property of the Company until the whole of the moneys due under this agreement are paid in full. The Company (and its agents duly authorised in writing) shall at all times and without notice be entitled to enter any premises believed to be occupied by the Purchaser without any liability for trespass and recover therefrom the goods the subject of this agreement, and any goods created pursuant to the use of the goods, but only if there is an existing default in the terms of payment for such goods. (c) The sale by the Purchaser of any of the goods prior to payment in full of the moneys due thereon shall be made by the Purchaser as the Company s agent and the Purchaser shall forthwith account to the Company for the proceeds of sale to the extent to which such proceeds are necessary to satisfy moneys due. (d) Where goods sold hereunder are used in the manufacture of new objects or otherwise mixed, then title of the object in question shall automatically pass to the Company as surety for full payment of the moneys due. TERMS OF PAYMENT Unless otherwise agreed by both parties the terms of payment shall be by the end of the month following the month of Invoice Date. Action will be taken to recover overdue accounts including legal fees. The Company reserves the right to refuse supply until outstanding accounts have been paid. RETURN OF GOODS Goods will not be accepted for return AFTER 30 DAYS from the date of delivery. (a) Orders placed by the Buyer may only be cancelled with the Sellers written permission. (b) Return of goods can only be made upon the prior agreement from Fairbanks Seeds. FREIGHT All orders will be charged freight and handling costs. LIMIT OF LIABILITY We warrant to the extent of the purchase price that seeds and plants sold are as described on the container within recognised tolerances. We give no other or further warranty expressed or implied. If this condition of sale is not acceptable the buyer should immediately return the goods unopened. Any liability incurred by the Seller to the Buyer, to the extent legally permissible is to be limited to the replacement of the goods or a refund of the price paid by the Buyer. DISEASE RESISTANCE Resistant is the ability of a plant variety to restrict the growth and development of a specified pest or pathogen and/or the damage they cause when compared to susceptible plant varieties under similar environmental conditions and pest or pathogen pressure. Resistant varieties may exhibit some disease symptoms or damage under heavy pest or pathogen pressure. Two levels of resistance are defined:- High standard resistance (HR): plant varieties that highly restrict the growth and development of the specified pest or pathogen under normal pest or pathogen pressure when compared to susceptible varieties. These plant varieties may, however, exhibit some symptoms or damage under heavy pest or pathogen pressure. Moderate/Intermediate resistance (IR): plant varieties that restrict the growth and development of the specified pest or pathogen, but may exhibit a greater range of symptoms or damage compared to high/standard resistant varieties. Moderately/Intermediately resistant plant varieties will still show less severe symptoms or damage than susceptible plant varieties when grown under similar environmental conditions and / or pest or pathogen pressure. Virgin has an excellent white curd which is suitable for fresh market production. GOHAN F 1 - CAU4151 (TRIAL) Gohan is a new hybrid cauliflower from Syngenta for summer and autumn harvest. It has a large vigorous frame with an excellent internal wrap. The heads are bright white with a smooth curd. Gohan has performed very well in all trials to date and is well worth a look for any cauliflower growers. Cabbage BELADA F 1 Belada is a 1.5 to 2.5kg semi-savoy cabbage. 11 Syngenta TopRes Club Root Resistance is a widespread disease that causes serious problems in many Brassica growing areas. The disease is caused by a pathogen known as Plasmodiophora brassicae, a single-cellular organism. Symptoms of the disease include root malformations with hard swellings (clubs), that eventually rot. The disease also causes stunting through reduced growth, and the wilting of leaves due to the roots failing to function effectively. Chemical control of the disease is not effective. Therefore, good genetic resistance of the crop is important for its protection against the disease. Standard cabbage variety (left) versus Ramkila (Right) in Gippsland, Victoria Syngenta has developed a monogenetic dominant native trait which provides high resistance to clubroot for varieties of the Brassica oleracea species (including cauliflower, broccoli, cabbage, Brussels sprouts, and others). This resistance is known as TopRes, and is currently available in a selection of cabbage, cauliflower and Brussels sprout varieties. Early trial work is currently being conducted in the broccoli crop and new hybrids with TopRes resistance are expected to be available for trial in the coming years. To identify which commercially available Syngenta varieties carry this resistance, just look for the TopRes symbol next to selected varieties in this crop guide. The advantage of this gene is evident in the surrounding photos (all taken in Australia) and can mean the difference between harvesting a crop or losing it all. We suggest using TopRes varieties in your crop rotation as a form of insurance against this devastating pathogen in fields where the disease is present or expected to be present. At present limited information is available on the identification of these strains and their occurrence. Genetic resistance is only one of the tools to manage clubroot. Culture measures such as liming, use of fertilizers with high percentage of calcium, proper drainage, good crop hygiene management are several of important components of an integrated approach to manage the disease. We always recommend to conduct small variety trials before starting commercial production of a new variety.
