The goal was to provide relevant information to help the legislature better understand tied house laws meant to protect the independence of the individual tiers within the three-tier system. 2 Control State Results for June 2018 NABCA July 20, 2018 NABCA NEWS NABCA Daily News Update (7/24/2018) 2 During June 2018 nine-liter spirits case sales in the control states fell 5.4% over same period sales last year. June s weak sales growth is, at least partially, attributable to last June s strong comp (7.7%) and anomalies in the control states June 2018 sales reporting calendars. Idaho (4.8%), North Carolina (5.8%), New Hampshire (3.5%), Ohio (4.1%), Virginia (3.6%), Vermont (2.5%), and West Virginia (2.6%) reported monthly growth rates exceeding their twelve-month trends. The growth rates for Alabama (-4.2%), Iowa (-2.4%), Montgomery County Maryland (-3.5%), Maine (-4.9%), Michigan (-16.8%), Mississippi (-12.5%), Montana (-0.4%), Oregon (2.2%), Pennsylvania (-18.8%), Utah (-11.0%), and Wyoming (-5.5%) fell short of their twelve-month trends. Control state rolling-twelve-month volume growth, 2.0%, fell short of May s reported 3.2%. Volumes in the control states grew 2.0% year-to-date compared to 3.0% a year ago. Control state spirits shelf dollars were down 3.1% during June while trending at 4.5% during the past twelve months. Idaho (7.0%), Montgomery County Maryland (2.4%), North Carolina (7.6%), New Hampshire (3.3%), Oregon (5.1%), Virginia (5.6%), Vermont (5.4%), and West Virginia (5.4%) reported growth rates exceeding their twelve-month trends, while Alabama (-1.0%), Iowa (-0.1%), Maine (0.8%), Michigan (-15.6%), Mississippi (-11.7%), Montana (-0.4%), Ohio (6.9%), Pennsylvania (-16.2%), Utah (-8.0%), and Wyoming (-5.0%) grew shelf dollars at rates below theirs. Shelf dollars in the control states are up 4.2% year-to-date compared to 5.2% last year. Price/Mix for June is 2.3%, nearly flat with May s 2.4%. June s Control State spirits nine-liter case and shelf dollar growth rates were effected by anomalies in the Control States sales reporting calendars and last year s robust comp: Utah, with 3% of Control States spirits nine-liter case volumes and 2% of Control States dollars, reported four weeks of sales this June versus five weeks of sales during June 2017, artificially deflating sales and skewing Control States results. Utah had four fewer selling days during this year s June than during last year s. Pennsylvania, with 15% of Control States spirits nine-liter case volumes and 14% of Control States dollars, reported four weeks of sales this June versus five weeks of sales during June 2017, artificially deflating sales and skewing Control States results. Pennsylvania had seven fewer selling days during this year s June than during last year s. Michigan, with 15% of Control States spirits nine-liter case volumes and 17% of Control States dollars, reported four weeks of sales this June versus five weeks of sales during June 2017, artificially deflating sales and skewing Control States results. Michigan had seven fewer selling days during this year s June than during last year s. Overall, June 2018 had seventeen fewer selling days, 3.3% fewer, than last year s June. After equivalizing nine-liter spirits case sales with respect to selling-day variations, June s volumetric growth is 1.5%, and rolling-twelve-month volume is up 2.2%. Likewise, after equivalizing shelf dollars, June s shelf dollar growth rate is 4.2% with a twelve-month trend of 4.6%. June s equivalized Price/Mix is 2.7%. Irish Whiskey, with 1% share of the nine-liter case control states spirits market, was June s fastest growing category with 2.5% growth reported and a twelve-month trend of 13.4%. Vodka, with 35% share, grew during the same periods at -5.1% and 1.7%, respectively. No category grew during June at a monthly rate exceeding its twelve-month trend, while Brandy/Cognac (-10.0%), Canadian Whiskey (-6.5%), Cocktails (1.2%), Cordials (-8.5%),

3 NABCA Daily News Update (7/24/2018) 3 Domestic Whiskey (-3.4%), Gin (-6.8%), Irish Whiskey (2.5%), Rum (-8.2%), Scotch (-7.9%), Tequila (1.6%), and Vodka (-5.1%) grew at rates below theirs. June s nine-liter wine case sales growth rate was -12.8%. Pennsylvania (reporting -17.9% nine-liter case growth for wines), New Hampshire (--1.6%), Utah (-13.3%), Mississippi (-8.4%), Montgomery County Maryland (-6.6%), and Wyoming (-4.9%) are the control states that are the sole wholesalers of wines and spirits within their geographical boundaries. 5 NABCA Daily News Update (7/24/2018) 5 CONTROL STATE NEWS PA: Pennsylvania looks to cash in on state's craft beer boom WFMZ 69 News By Jim Vasil July 23, 2018 EAST NORWEGIAN TWP., Pa. - Can Pennsylvania do more to cash in on the craft beer boom that's being seen in Berks County and beyond? That's the question on the minds of state and local officials, wondering how the craft industry can help struggling towns. "We want to see the economic vitality of breweries benefit all people across the state," said Bill Covaleski, a founder of Victory Brewing Company in Downingtown. State Sen. David Argall and state Rep. Jerry Knowles, both of whom represent parts of Berks County, are among those who met Monday morning with brewers from around the region at D.G. Yuengling & Son's newest brewery in East Norwegian Township, Schuylkill County, just outside Pottsville. Pennsylvania produces more barrels of craft beer than any other state, and officials said the industry has spurred jobs and tourism. "[We're] looking at how breweries can do more to serve as the catalyst to breathe new life into small towns like Pottsville, Pennsylvania," said Argall. "You can turn a two-hour trip into a two-day trip if you do it right." With the beer industry continuing to boom in Pennsylvania, there are a lot of ideas out there on how to capitalize on that, and officials with America's oldest brewery want to throw in their expertise.

6 NABCA Daily News Update (7/24/2018) 6 "We've been around. Next year is our 190th anniversary," said Dave Casinelli, Yuengling's chief operating officer. "As Dick Yuengling would like to say, probably more of those years were difficult and challenging years than positive years." Officials said places like Pottsville have seen better days, but when a brewer comes to town, restores a building and hires a handful of people, it can be the start of something beautiful. "There's a lot of camaraderie in this state," said Casinelli. "We're all competitors, per se, for consumers, but within Pennsylvania, we support each other. We help each other out a lot." LICENSE STATE NEWS NJ: East Windsor recognizing Alcohol Awareness Month in July NJ.com By Rich Cuccagna July 23, 2018 Mayor Janice S. Mironov, surrounded by local Township liquor license holders, issued a Proclamation recognizing Alcohol Awareness Month and kicking off the East Windsor "We Check for 21" initiative aimed at deterring underage drinking. As part of the Township "We Check for 21" Campaign, liquor license holders are required to sign the "We Check for 21" Pledge as a condition of receiving their liquor license renewal. The Pledge affirms each liquor license holder's strong support of East Windsor Township's "We Check for 21" Program. Various resource and informational materials and paraphernalia were distributed for use at these establishments. The 'We Check for 21' Program is an excellent vehicle to bring together municipal government leaders, young people, parents, key community and school leaders, policy makers and local businesses toward a common positive community effort. MN: Sunday sales, one year later: Who's crying in their beer? Minneapolis/St. Paul Business Journal By Mark Reilly, Managing Editor July 23, 2018 Nearly a year after Minnesota lifted its prohibition on Sunday alcohol sales, independent liquor store owners are split on how the change has affected their businesses. The Star Tribune touches base with several retailers who have changed their schedules in the wake of the Sunday sales rule, which took effect last July. Liquor stores don't have to be open on Sundays now, but they can be though that's not as much of a choice as it may seem like, considering that some of their biggest competitors definitely will be.

7 NABCA Daily News Update (7/24/2018) 7 That sort of resignation comes up a lot among smaller shops, who say that, as they feared, the extra sales from staying open on Sunday don't make up for the extra costs of staffing. Not everybody's down on the new rules, though. Jim Surdyk, owner of Surdyk s Liquor & Cheese Shop in Minneapolis who was so excited about Sunday sales that he started months early, prompting a big fine said that his adjacent deli and cheese shop has been the biggest beneficiary, as customers are able to linger longer. Surdyk's also has worked to drive traffic with Sunday promotions like dog-adoption events. The story is only about independent shops, so there's no word from big chains like Total Wine & More or Target Corp., which has added liquor stores to some of its locations. But they may be doing best of all. Andy LaRose with accounting firm Baker Tilly estimates that larger chains are seeing about 10 percent growth under the new rules. The biggest losers may be convenience stores that sell low-alcohol beer. Sales of 3.2-percent beer once the only game in town on Sundays have dropped by as much as 80 percent in convenience stores and gas stations since last year, according to the Minnesota Service Station and Convenience Store Association. An official with the trade group says the stores should be allowed to sell stronger beer to compensate, which could be the next alcoholfueled fight at the Minnesota Legislature. INTERNATIONAL NEWS Canada: Craft beer group less than gung-ho about lowering cross-border barriers Move to raise cross-border alcohol limits is welcome, but it could hurt too, producer says CBC News July 23, 2018 As the New Brunswick government moves toward increasing the amount of alcohol people can bring in from other provinces, a craft brewer association isn't entirely enthusiastic as long as the playing field for producers remains uneven. At a meeting in Saint Andrews last week, Premier Brian Gallant said he and the other premiers agreed to "significantly increase" the import limits for alcohol. "It's a positive step for the consumer and opening up the industry," said Wendy Papadopolous, president of the New Brunswick Craft Alcohol Producers Association, "but certainly something we have to be careful of going forward." Papadopolous, a co-owner of Big Tide Brewing Company in Saint John, said consumers' pursuit of low prices could hurt local craft brewers. "There's another side of consumers always looking for the best deal on things," she said. "If they're able to cross over into Nova Scotia or into Quebec or into any of the other provinces that we border and buy craft alcohol or beer at a cheaper price and bring it home in larger quantities, then it certainly will have an impact on the producers here." Papadopolous said craft alcohol producers aren't "big beer," and they can't offer the same discounts larger breweries provide because the margins are smaller. Specifics of the cross-border shopping agreement reached at the Council of the Federation have not been released. Gallant said it could be weeks or months before specific new limits are enacted. Papadopolous said she hopes the province also lowers taxes on alcohol Quebec liquor taxes are the lowest in Canada to help level the playing field, lessening the savings on inter-provincial booze shopping.

8 NABCA Daily News Update (7/24/2018) 8 She'd also like to see more New Brunswick-produced alcohol made available in other provinces. The New Brunswick Liquor Corp. imports liquor from around the world, but many New Brunswick-made products can only be bought in this province. "In addition to being fairly taxed, so we can be cost competitive, is accessibility and export, that there are equal opportunities for New Brunswick producers in other provincial liquor stores and other liquor corporations, the same way [New Brunswick] treats those same producers in our province." Ireland: Drinks Industry Continues to Grow but Faces 'Significant Challenges' Hospitality Ireland By Patricia Callan July 24, 2018 Ireland s drinks industry is experiencing a period of growth and innovation, but faces significant challenges ahead, according to Patricia Callan, director of the Alcohol Beverage Federation of Ireland. Callan was speaking at the MacGill Summer School on Monday July 23 on a panel discussion entitled Beyond Brexit: Ireland in Europe The Future with Phil Hogan, EU commissioner for Agriculture & Rural Affairs and Pat Cox, former president of the European Parliament. According to the ABFI, the drinks industry exports products to 135 markets. Last year, exports were worth 1.5 billion, up 8%. The industry is also a major purchaser of Irish agricultural raw materials. Additionally, there were 2.6 million visitors to Irish breweries and distilleries last year. Speaking at the event, Callan said, With new players entering the market and exports continuing to grow, Ireland s drinks industry is an important sector, that contributes significantly to the economy. We are an industry that sells globally, while creating jobs and attracting tourists locally. Brexit However, with Brexit, over-zealous regulation, excessive taxation and protectionist policies Ireland s drinks industry faces a perfect storm that could impact this growth. At the event, Callan outlined how Ireland s drinks industry is exposed to a number risks associated with Brexit. She explained, Ireland s drinks industry operates on an integrated all-island basis with seamless cross-border supply chains. The avoidance of a hard border or, indeed, a cliff-edge, no-deal withdrawal by the UK is a key concern. It is vital that we avoid tariffs, particularly on packaging and glass, and regulatory checks and delays at the border. The Chequers Agreement gave us hope, but unfortunately last week s amendments in the Commons diminished that hope. In addition, Irish whiskey, Irish cream liqueur and poitín are protected at an EU level in a similar manner to Champagne in France or Parma ham in Italy with a geographical indication (GI), which means they must be produced on the island of Ireland, in accordance with certain production practices and standards. As this protection covers the island of Ireland, currently these products can be made in both Northern Ireland and the Republic of Ireland. After Brexit, the GIs on these three Irish spirits will be the only ones to span territory both in the EU and outside the EU and it s vital that they are protected in future UK trade agreements. Other Issues President Trump s protectionist policies are also of concern for the industry, according to Callan, who stated, US whiskeys have been hit with a 25% tariff by the EU in response to President Trump s protectionist policies. Fears of further retaliation are very real, particularly for the Irish whiskey industry which is heavily reliant on the US market. Now is the time when de-escalation is needed. The EU s lofty and still-valid ambitions for global free trade must not be abandoned in a tit-for-tat trade war. The costs to Europe and Ireland would be much too high. Callan also warned that the labelling proposals in the Public Health (Alcohol) Bill are a major concern for the drinks industry.

9 NABCA Daily News Update (7/24/2018) 9 She asserted, We are calling on the government to remove the requirement for cancer warnings on alcohol products, as it is a disproportionate measure that represents a barrier to trade in the EU amidst Brexit uncertainty. These country-only labels will undermine the EU single market for goods and act as barriers to trade both in and out of Ireland. They will bring reputational damage to Ireland s food and drinks industry more broadly and you can be sure that if we start with alcohol then more categories will follow. We will likely see warnings that red meat is associated with an increased risk of colorectal cancer, and that processed meat is associated with an increased risk of colorectal and stomach cancers. Finally, Callan warned about over-taxation in Ireland, saying, We are seeing that over-regulation in Ireland is joined by over-taxation. Ireland s alcohol excise tax is the second highest in the European Union. We have the highest tax on wine, the second highest on beer, and the third highest on spirits. Our high excise tax unfairly penalises Irish businesses and Irish consumers, puts jobs in rural Ireland at risk, negatively impacts Ireland s attractiveness and competitiveness as a tourist destination, and exposes Ireland to more Brexit risk. Technology Networks By Karen Steward, PhD, Science Writer July 24, 2018 INDUSTRY NEWS There s nothing like a nice cool glass of rosé on a balmy summers evening. Whether you re an adventurous type who likes to try a new wine every time or you have your go-to favourites, you put your trust in producers and retailers to deliver the products that they claim to be but are they? Fraud in the food and beverage industry is becoming an all too common problem, whether it s lower quality honey claiming to be Manuka, cheap oils passed off as extra virgin olive oil or even horse meat masquerading as beef, they ve all hit the headlines for the wrong reasons. Some food fakery is easier for a consumer to detect than others glaringly obvious spelling mistakes on packaging is an immediate red flag, but for many consumers the only option is to take products at face value. Do you really know what you re sipping this summer? In response to suggestions of cheap imports being passed off as French wines, the Directorate-General for Competition, Consumer Affairs and Fraud Control (DGCCRF) based in France, undertook a survey to examine wines imported into France, especially from Spain.

10 NABCA Daily News Update (7/24/2018) 10 For French wine producers that lack protected geographical indication (Indication Géographique Protégée-IGP) status, competition can be tough. Spanish producers are challenging them, especially in varietal entry level wines. As such, temptation exists to pass off cheaper Spanish imports under their own brands. Speaking to Le Parisien, Alexandre Chevallier from the DGCCRF said: We were alerted to the Frenchification of Spanish wine at the end of So, we launched an inquiry at all levels, from producers to importers to restaurants and distributors. The survey, launched in 2016, initially targeted wine importers but was then extended to the rest of the industry, including distributers, retailers and cafés, hotels and restaurants. Inspections focussed on verifying traceability of wines and that where wines had been imported or blended with wines from other countries, the labelling correctly reflected this. In total 743 establishments (179 in 2016 and 564 in 2017) were examined. The report The study results, which have recently been published showed that startlingly, 22% of the establishments visited in 2016 and 15% of the establishments visited in 2017 were misrepresenting wine origins in some form. Offences included Spanish wines sold in bulk as "French wine" while others were even given French IGP names. Several cases of note involved volumes of misrepresented wines ranging from 2,000 hectolitres to 34,500 hectolitres (equivalent to 4.6 million bottles!) Earlier in March 2018, the DGCCRF revealed that 480,000 hectolitres of table wine, totalling many tens of millions of bottles and the equivalent of 15% of Côtes-du-Rhône production, had been passed off as Côtes du Rhône from October 2013 to June 2016, in a scam that affected UK drinkers as well as French. What is being done to combat wine fraud? As well as the economic consequences, cases such as these bring the reputation of the industry into disrepute. The DGCCRF have responded firmly by pursuing criminal cases against those in breach, which may result in fines and even custodial sentences. Much work has been done in the food and wine industry to make fraud detection quicker, cheaper, easier and more definitive. Analytical science techniques are being employed to look at creating fingerprints for wines from different areas. Nuclear Magnetic Resonance (NMR) has been used in wine screening across Western Europe very successfully to authenticate and protect wines and is also showing good results in Hungary where the Hungarian Ministry of Agriculture are striving to protect its valuable wine industry. In the U.S., scientists have been looking at multi-elemental profiling of macro, micro, and trace elements for determination of authenticity using mass spectrometry and atomic emission spectroscopy-based techniques. Wine prices from premises that are relatively close together can vary dramatically and it is therefore imperative that precise locations and not just the grape variety and country can be determined. In the future, routine identification of wine origins may be a whole lot easier and hopefully will make fraudsters think twice. Wine industry disappointed with Canadian Premiers Food in Canada By Andrew Joseph July 23, 2018 OTTAWA On July 20, 2018, the Canadian Vintners Association (CVA) and its members expressed disappointment with the Council of Federation s decision to not lift restrictions on the interprovincial shipment of alcohol. The association says it will however work with internal trade ministers to build support for a winery-to- consumer delivery system as a concrete step towards improved consumer choice and freer trade within Canada.

11 NABCA Daily News Update (7/24/2018) 11 Following more than a decade of effort with the federal and provincial governments, and 12 months of direct work with the federal-provincial-territorial Alcoholic Beverages Working Group (ABWG), we are frustrated that Premiers did not act on our legislative proposal presented to the Alcoholic Beverages Working Group which would expand consumer choice across Canada with legal, regulated winery-to- consumer shipments, says CVA president and chief executive officer Dan Paszkowski. According to the CVA, Direct-to-Consumer would lead to important growth for the country s highest value-add agricultural industry, with free interprovincial trade positively impacting the economy across the country. Industry research shows that for every $1.00 spent on Canadian wine in Canada, $3.42 in Gross Domestic Product (GDP) is generated across the country. Continuing, Paszkowski adds: It s the 21st century and Canadians are still bound by archaic prohibition-era laws that outlaw their ability to join an out-of-province wine club, order wine online, or visit a winery and have their wine purchases delivered to their out-of-province residence. Canadians would be shocked to learn that they could face significant fines and/or jail time for disobeying these laws. Interprovincial winery-to-consumer delivery is something nine out of 10 Canadians believe should be permitted, according to the CVA, with wineries across Canada awaiting provincial approval to make this choice available to its citizens. British Columbia, Manitoba and Nova Scotia are the only jurisdictions in Canada which have permitted interprovincial wine delivery. This means that only 19 percent of Canadians can legally order and have award- winning Canadian wines delivered to their homes from an out-of-province winery. These are wines that are not readily available in their local liquor retail stores, adds Paszkowski. B.C. opened its borders to direct-to-consumer shipping of 100 percent Canadian out-of-province wines in Since that time, there s been no effect on provincial vintners sales, BC wine retail sales, nor on provincial revenue. In fact, we would argue, supporting 100 percent Canadian wine shipment direct to customers encourages consumer support of farm-to-glass growers and producers throughout the province, says British Columbia Wine Institute president and chief executive officer Miles Prodan. Winery & Grower Alliance of Ontario president and chief executive officer Aaron Dobbin called the announcement a missed opportunity, adding that today s announcement is not the meaningful change that could have helped Canadians truly access the great wines our country has to offer and enable our domestic wine and grape industry to grow and create jobs. We will continue to work with government to remove interprovincial barriers. Paszkowski says, While we are disappointed with today s announcement, the industry will continue our work with the federal, provincial, and territorial governments to encourage the provinces to go beyond their personal exemption limits for personal transport and allow interprovincial wine delivery from wineries to consumers. Moore July 24, 2018 DAILY NEWS As the alcohol industry continues to make healthy profits, Britain is left counting the increasing cost of its unhealthy relationship with booze. From overstretched accident and emergency departments to a steady incidence of alcohol-related disease, the cost is massive. The most recent figures reveal that alcohol-related harms cost the NHS around 3.5 billion annually.

12 NABCA Daily News Update (7/24/2018) 12 And the problems don t end there. Often the erratic and antisocial behaviour of intoxicated people will have an impact on others. This becomes apparent when walking down any UK high street on a Saturday night, as you dodge obstacles from aggressive drinkers to broken glass. Alcohol issues aren t limited to towns and cities, either. Recently, budget airline Ryanair once again called for airports to introduce preventative measures to curb excessive drinking, following a flight that had to land unexpectedly when three passengers became disruptive. Airports are places where high security and order are paramount to safety so, really, no alcohol should be allowed whatsoever. Drunk on board In recent years, there have been several high-profile incidents involving drunk passengers on planes as well as countless other unreported events. In fact, figures show 387 people were arrested for being drunk at airports between February 2016 and February 2017 up from 255 the previous year. And a BBC Panorama investigation has found that more than half of cabin crew have seen disruptive drunken passenger behaviour at UK airports. Problems linked to alcohol consumption in airports and on planes include passengers being too drunk to board or being out of control on planes. Those who do not board have their bags removed, causing delays for other passengers, while those who board drunk can cause disorder and endanger passenger safety especially pertinent in the confines of an aeroplane where other passengers can become scared. Drunk behaviour is not just disruptive to other passengers, however. Air travel involves a tightly integrated, complex set of processes and the effects of drunk passengers can impact this infrastructure. The number of professionals required for the safe management of drunks can divert resources away from normal service, potentially affecting security and the safety of other travellers. Drunk people have reportedly tried to open plane doors and smash windows while in flight. The extent of drunkenness has caused planes in flight to divert so that the intoxicated and disorderly can be offloaded, again affecting all other passengers safety and convenience. Licensing rules The government is examining how alcohol is sold in airports, but they stop short of banningit altogether. Instead, restrictions have been proposed to end rules which allow airport bars and pubs to operate outside UK licensing laws. Limiting the number of drinks a passenger can have, both before and during flights, would almost certainly bring this number of alcohol-related incidents down, and result in fewer delays and a more secure and pleasant trip for passengers and staff. It s not about being puritanical. Choice is important, and many choose to make alcohol an important part of many activities, including their holidays. At the same time, choices have been made to ensure the safety of air passengers and to keep flights running on time. Airport and aeroplane staff, given the choice, would probably prefer not to mop up vomit from those who have drunk too much or worse, potentially put themselves in harm s way to protect other passengers. During air travel, travellers are contained in secure areas, with no choice over their fellow passengers. Removing the irrationality of intoxication from such an activity is not the tyranny of the majority, it is simply asking people to temporarily abstain until they reach their chosen destination. Many passengers choose not to drink and, given the choice, families would likely prefer that their children are not exposed to disorderly drunks. No one has the right to cause harm to others and it is trivial to expect abstinence while passengers make their way to their destination, whether it is an alcohol-fuelled excursion, a family holiday or a business trip. For those who use alcohol to cope with anxiety, there are more effective and safer alternatives. For those who cannot go without alcohol there are many services available to help with dependence. Ultimately, the needs of the many must outweigh the desires of a minority who want to start their holiday early.
