Cuomo Governor of New York State NYS State Capitol Building Albany, NY October 10, 2017 Re: Matter of Finger Lakes LPG Storage, LLC, DEC Permit Application ID No Dear Governor Cuomo: In light of Chief Administrative Law Judge James McClymond s recent ruling, we write to you once again to reiterate our strong opposition to Crestwood s plan to store liquefied petroleum gas (LPG) in unlined salt caverns bisected by a fault line along Seneca Lake. This ill-conceived plan is widely unpopular among families, businesses, and communities in the Finger Lakes region. The nearly 500 businesses that are members of the Gas Free Seneca and Finger Lakes Wine Business Coalitions and 32 municipalities including the cities of Syracuse, Rochester, Geneva, and Ithaca, the Village of Watkins Glen, numerous towns and seven counties across the Finger Lakes Region, representing 1.2 million New York residents all join in opposing the project. At this time, we want to draw your attention to some recent developments that throw need for the project into serious doubt. First, Crestwood has opened a new propane distribution facility in Montgomery, New York, that it has advertised as sufficient to serve the entire northeast in the coldest winter. Second, the company s storage facility in Savona, New York, has received U.S. Environmental Protection Agency approval to expand capacity at that site. Together, these facilities serve the project s ostensible functions and operate as a reasonable and feasible alternative to Crestwood s proposal for Seneca Lake, which seriously threatens the Finger Lakes brand. More information about this alternative is provided in the attached letter to the judge. If the project is not built, no one will be the worse off. The public will not suffer one iota. If the project is allowed to go forward, however, it will put in place new infrastructure that is not really needed, but will have to be used to justify the investment, resulting in increased pressure to continue the use of fossil fuels into the future. That course runs directly contrary to your nationally recognized efforts to accelerate the transition to renewable energy sources. Given your strong support of wine and tourism in the Finger Lakes region and your promise to

2 reduce the use of climate damaging fossil fuels, we urge you to side with the people of the Seneca Lake community, not a Texas gas corporation. The Finger Lakes is a national treasure, the only wine region in the world identifiable from space, and it should be preserved and protected, not sacrificed as a convenient dump for LPG. We trust that you will work with DEC Commissioner Seggos on a denial of the permit to avoid the potentially devastating impacts of this ill-conceived project, including its threat to your economic development and clean energy efforts.
