1 RFQu # Fresh Produce July 20, 2017 Collier County Public Schools (CCPS) will accept submittals for RFQu (Request for Qualifications) # Fresh Produce. The purpose of the RFQu is to identify responsible providers of the best competitive prices for fresh, high quality, seasonal and if possible local, Florida produce, to be used at various sites throughout CCPS, primarily by the Nutrition Services Department. Qualifications are due no later than 2:00PM, August 10, Interested firms should submit SEALED proposals to: Collier County Public Schools Purchasing Department, 5775 Osceola Trail, Naples, FL Firms shall submit two (2) electronic copies of its submittal, each on a separate flash drive in a sealed envelope/package, with file names that correspond with the underlined qualifications listed below. Each file shall be a Microsoft Word document or PDF document, compatible with Microsoft Word versions dated between 2010 and Files will be as follows: 1. Letter of interest: Describe Firm s interest in providing requested products to CCPS. Letter shall include firm s principal place of business and firm s primary point of contact (name, title, phone, , etc ). Letter of interest is to be signed by the firm s senior officer or a representative authorized to legally obligate the firm. 2. Description/History: a brief description of organization and history thereof to include but not limited to: number of years in business, business location(s), number of employees, and types of products provided. 3. Experience: specific project details and specifications of the firm s experience with providing fresh produce to a minimum of three (3) entities within the last two (2) years. Please note: CCPS may contact provided entities for further reference. In addition, Firm shall provide a description of any and all previous experience with CCPS, if applicable. Description details shall include any key CCPS personnel involved. Firm(s) may be deemed non responsive based on past performances. Firm may also provide, in chronological order, any additional experience within the last three (3) years for CCPS consideration. 4. Professional licenses: a. A copy of current business license demonstrating firm is legally eligible to operate and provide requested product within Collier County, Florida, must be submitted with the proposal. Either a state or county occupational license will be acceptable. All licenses shall have current name and address of proposer. License must be valid/current at the time of the RFQu opening and will be maintained throughout the duration of the contract and submitted to the District as necessary. Furthermore, the Vendor for the duration of the contract shall comply with all Federal, State and Local rules, regulations and licensing requirements. b. Firm must also show evidence of being a certified local farmer by obtaining a GAP (Good Agricultural Practices) letter. Farmer certification information must also include certificate of insurance, hold harmless, traceability program and third party inspection.

2 5. Available products: a. Prospective vendors must complete and provide Exhibit A identifying products that they wish to provide to Collier County Public Schools when needed. Place a (check mark) in the space provided next to the item you wish to provide. b. Space is provided at the end of exhibit A to add other items that you think the District may be interested in but has not listed. Use additional pages if necessary. 6. Farm to School Definition: Collaborative projects that connect schools and local farms to serve locally grown, healthy foods in K 12 school settings, improve student nutrition, educate students about food and health, and support local and regional farmers. Locally grown produce shall be identified and featured on the menu as often as economically and seasonally feasible. The Nutrition Services Department participates in the Farm to School program to encourage consumption of locally grown produce to enhance the freshness and nutritional value of the fresh produce, decrease the transport time (food miles) and fuel costs, and to support the local economy. Locally grown produce is defined as seasonal produce grown in the State of Florida. Also the following is needed: a. The implementation of food safety/haccp programs. b. Third party audit inspections are completed per safe industry standards. c. Fertilization and pest control schedules and products are recorded and maintained by specific growing field. d. Hold Harmless Agreement. e. Certificate of Insurance. 7. Opportunity Buys a. This RFQu will allow for opportunity buys from reputable, certified, local farmers due to seasonal volume, weather considerations, etc. 8. Farm to School Distribution and pricing methods a. Farm to School Program product and opportunity buy produce pricing (which includes delivery cost into Adams) contracted directly with a qualified vendor, should be delivered to the District s central warehouse, Adam s Cold Storage, 701 McKeon St., Auburndale, FL The district will pay a drayage fee to their distributor to have this produce delivered to individual schools. b. Pricing quoted for Farm to School Program products and opportunity buys contracted from a qualified vendor with resources and desire to deliver directly to Collier County Schools must also be inclusive of delivery fee. 9. Fresh Fruit and Vegetable Program (FFVP) a. This grant program allows pre determined elementary schools to serve a fresh fruit or vegetable snack to each student a minimum of 3 days per week. Multiple elementary sites participate in the FFVP. The specific schools and number of schools varies from year to year depending on funding. b. Special consideration is needed for increased delivery schedules for these FFVP schools. c. An increased variety of products is necessary to introduce children to healthy options. Suggestions and recommendations from the Contractor on in season less common domestic produce with competitive pricing is necessary. Carambola (star fruit), baby kiwi, blueberries, dragon fruit, edamame, jicama, cherries, avocado, eggplant, pineapple, and grapefruit are examples of product that we will purchase for this program in addition to the more traditional items.

When financially feasible, produce that is individually packaged or ready to eat or single serving size will be utilized in the FFVP due to time constraints to avoid loss of instructional classroom time and labor restrictions. e. In season Florida produce will be offered as often as possible: i. Florida produce in the Fall/Winter months (oranges, grapefruit, tangerines, tangelos, pummelo, etc.) ii. Florida strawberries in the Winter months iii. Florida peaches and berries in April and May iv. Florida melon in the late Spring months v. Florida vegetables in season to include but not limited to: tomatoes, squash, salad greens, celery, peppers, potatoes, carrots, green beans, corn, etc. 10. Farm to School Snack Program (F2SS) a. In the remainder of the elementary schools that are NOT FFVP schools, it is the intention of the Nutrition Services Department to offer the same fresh fruit and/or fresh vegetable snack 1 to 3 days per week depending on budgetary constraints. b. This F2SS snack will be whole or individually packaged due to labor restrictions. 11. Fruit Promotion Day a. Each year, the Nutrition Services Department features a specific and different fruit for a marketing promotion. b. The featured fruit will be identified and communicated with the qualified vendors each year so that the best fresh, domestic (if possible) available produce with excellent pricing can be purchased. c. Examples of the featured fruit include: strawberry, citrus, blueberry, watermelon, pineapple, peach and kiwi. 12. Buy American Provision a. As a participation sponsor in the USDA s National School Lunch and School Breakfast Programs, the School District of Collier County, Florida and Nutrition Services Department must adhere to the Buy American provision of the Child Nutrition Reauthorization Act. b. The provision requires school districts to purchase, to the maximum extent possible, domestic food products that are produced in the United States. The Legislature defines domestic commodity or products as one that is produced in the United States and is processed in the United States substantially using agriculture commodities that are produced in the United States. c. Substantially means that a minimum of 51% of the final processed food comes from American produced products. d. The vendor is to make every effort to purchase domestic products. Items known to the Nutrition Services Department to be grown internationally/ non domestic, such as pineapple and bananas, are indicated by stating non domestic OK in the description. 13. Applicable Laws a. All products and deliveries must meet the State Board of Health and Collier County Health Department specifications and standards, and must comply with Federal Statutes Executive Orders and the requirements of 7CFR 210, 7 CFR and 7 CFR (b) and (c).

Equal Employment Opportunity Except as otherwise provided under 41 CFR Part 60, all contracts that meet the definition of federally assisted construction contract in 41 CFR Part must include the equal opportunity clause provided under 41 CFR (b), in accordance with Executive Order 11246, Equal Employment Opportunity (30 FR 12319, 12935, 3 CFR Part, Comp., p. 339), as amended by Executive Order 11375, Amending Executive Order Relating to Equal Employment Opportunity, and implementing regulations at 41 CFR part 60, Office of Federal Contract Compliance Programs, Equal Employment Opportunity, Department of Labor. c. Contract Work Hours and Safety Standards Act All contracts awarded by the non Federal entity in excess of $100,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence. d. Funding Agreement Rights to Inventions Made Under a Contract or Agreement. If the Federal award meets the definition of funding agreement under 37 CFR (a) and the recipient or sub recipient wishes to enter into a contract with a small business firm or nonprofit organization regarding the substitution of parties, assignment or performance of experimental, developmental, or research work under that funding agreement, the recipient or sub recipient must comply with the requirements of 37 CFR Part 401, Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under Government Grants, Contracts and Cooperative Agreements, and any implementing regulations issued by the awarding agency. e. Clean Air and Water Pollution Acts Contracts and sub grants of amounts in excess of $150,000 must contain a provision that requires the non Federal award to agree to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act (42 U.S.C q) and the Federal Water Pollution Control Act as amended (33 U.S.C ). Violations must be reported to the Federal awarding agency and the Regional Office of the Environmental Protection Agency (EPA). f. Energy Policy Mandatory standards and policies relating to energy efficiency which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act (42 U.S.C. 6201). 14. New Products; Pack Size Changes; Updated End Product Data Schedule (EPDS) The District reserves the right, in its sole discretion, to negotiate pricing with qualified vendors and new qualified vendors to supply new and additional items. When deciding whether or not to add a new item, the District will review the previously qualified vendors and their offering to determine if a new vendor and/or item is necessary to continue operations. Adding new items and if necessary, new vendors, may be done at any time during the contract period to maximize flexibility and take advantage of new offerings as new products that meet USDA nutrition standards become

5 available. New items and associated prices will be incorporated into the contract via a written notification of acceptance issued by the Purchasing Department. New items will be subject to the contract s terms and conditions. Pack size changes must be authorized in writing in advance by the Purchasing and Nutrition Services Departments. A pack size reduction may be accompanied by a concurrent reduction in the vendor s fee. 15. Additional Information: Firm may provide any additional information necessary to further demonstrate its qualifications and capabilities to provide requested services. Failure to comply with the submission requirements may result in the submittal being deemed non responsive. All requested information shall be submitted to the Purchasing Department no later than the time and date stated above. Applicants must be licensed in the State of Florida at the time of submittal. Firm must be registered by the Department of State, Division of Corporations, to operate in the State of Florida as a corporation at the time of application. Applicants must comply with Professional Services Insurance Requirements posted at Firms with the best, reasonable and qualified submittals will be approved for use by CCPS. When a project is necessary, all approved vendors will be contacted to provide a quote. Requested product specifications will be provided via . Approved firms will then be requested to submit quotes as necessary by a specific date and time. Purchases will be made from the vendor that offers the best, fair, reasonable and low quote for that purchase as deemed by CCPS. Process will be repeated as necessary throughout the year from due date to June 30, Services may be renewed for up to four (4) one year renewal periods. Renewal options will be at the discretion of CCPS. All approved contractors that will perform services on any CCPS site will be expected to have any and all employees, sub contractors or other known affiliate(s) to comply with any and all Fingerprinting and Badging requirements.
