1 Liberty Park Farmers Market Sponsored by Liberty Wells Community Council The Liberty Wells Community Council identified a need for fresh local produce in the Liberty Wells area. Additionally, there is a need to support small local farms and businesses that create local products. Liberty Park Farmers Market will help support local farms and businesses by bringing fresh local produce directly to the Liberty Wells community. The purpose of the Liberty Park Farmers Market is to bring our community closer together and show off local farming, small businesses, and community gardening in our wonderful park in the city. Liberty Park is an ideal venue for a Farmers Market to sell local fresh produce directly from farmers and local businesses to the Liberty Wells community. The Market can help strengthen the Liberty Wells neighborhood by showcasing produce that is gown in the Liberty Wells community gardens and connect members of the community with the LWCC. The Liberty Park Farmers Market strives to be a zero waste environment. Vendors should limit packaging where possible. We will encourage customers to bring and use reusable bags or other alternatives. Types of Vendors at the Market: Farmers Prepared Food Handmade Goods When admitting vendors, the following considerations will be given: Priority will be given to local urban farmers selling produce. Market Calendar: Begins June 9 th October 20th Fridays, 4pm to dusk Market Fees: Farmers Daily Booth Fee: $15 Farmers Full-Season Fee (20 weeks): $270 Farmers Half-Season Fee (10 weeks): $135 All Others Daily Booth Fee: $30 All Others Full-Season Fee (20 weeks): $540 All Others Half-Season Fee (10 weeks): $270 Payment is due prior to set up, no exceptions.
2 Booth Spaces: Booths are approximately 10ft x 10ft. Space will vary based on location, trees, sidewalks, and other permanent fixtures. Vendors are responsible for providing their own equipment, including and not limited to: tables, chairs, canopies, and weights for canopies. All canopies are required to be properly secured with a weight system using a minimum of 40lbs per leg. Staff will assign spaces based on types of products, cooking requirements, and other special considerations. Vendors will be assigned a space at least 24 hours prior to the market and priority of spaces will be given to those participating in the full season. Staff has the authority to move and reassign vendor spaces to enhance or facilitate market operations. The Market hours are 4pm to dusk on Fridays. Unloading and set up for vendors begins at 2pm on Friday. Vendors need to check in with LWCC staff prior to unloading. Vendors must be in place by 3:45pm on Fridays and ready to sell by 4pm. Vendors are encouraged to stay for the duration of the Market time. Any buskers (individuals performing music, magic, etc.) are required to check in with LWCC staff prior to setting up. LPFM staff reserves the right to limit the number of buskers. Electricity is very very limited. Vendors requesting electricity must specify the amount needed and need to check with staff prior to using. Keep items off sidewalks to maximize room for customers. Please do not put signs on the sidewalks or in front of other booths. There will be no parking on 1040 South. Vendor Requirements: Vendors are encouraged, but not required, to sell pesticide/chemical/gmo free and hormone free food. We have high customer demand for organic food. Misrepresentation of products as organic may result in removal from the Market. Vendors are responsible for complying with all applicable state and local laws, regulations, and requirements. Vendors selling processed items (i.e. jellies, honey, salsa, cut fruit, meat, anything other than raw produce) must have a food establishment registration certificate from the Utah Department of Agriculture. The certificate must be visibly displayed at the booth.
3 Vendors may only sell items declared and approved in their Market application. Market staff has the right to ask vendors to remove unapproved products. Approval from the Market Team is required before any products may be added during the course of the season. Vendors will determine the prices for products sold, but the LPFM requests that vendors maintain fair retail market pricing. All prices should be clearly marked. Sellers agree to abide by fair business practices. All required sales tax collections and remittances are the sole responsibility of the sellers. Vendors must notify the LWFM Staff by phone or at least 24 hours in advance if they will not be attending the Market that week (before end of workday on Wednesday is preferred). Noncompliance or repeated absences risk forfeiture of permanent reserved space. Vendors are responsible for their own garbage. Vendors must clean up their selling spaces at the end of each day. Bins for recycling and trash will be provided. All other garbage should be removed by the vendor. Vendors should respect one another s space and right to sell their products without intrusion. Problems with other vendors should be discussed with LWFM staff. Sampling is permitted at the LWFM provided that the person handling the food has a current food handler permit, a hand washing station and abides by all food safety standards. Vendors with booth spaces are allowed to keep ONE vehicle in the park during Market hours. Vendors will park directly behind their booth. No parking is allowed on 1040 South. We encourage you to bring only one vehicle to the park. However, additional vehicles must be parked in the west parking lot on 500 E. Do NOT park in stalls adjacent to the park. These stalls are customer parking ONLY. Use caution when driving in the park, and be mindful of trees, poles, signage, people, and animals. Driving in the park is PROHIBITED during Market hours. After 4pm, items must be brought in by hand or cart. Vendors that sell out early will have to wait until dusk to drive out of the park. Seller assumes full liability for the products they market or sell and hereby agrees to hold Liberty Park Farmers Market and Liberty Wells Community Council harmless against any claim of injury or damage by any buyer, seller, or other persons resulting from the use, consumption, disposition, display, or marketing of products. Liberty Park Farmers Market, Liberty Wells Community Council, and the Parks and Public Land Program of Salt Lake City Corp are not liable for any injury, theft, or damage to either the buyer or seller, or their property, arising from or pertaining to preparation for or participation in the
4 Liberty Park Farmers Market. Regardless of whether such injury, theft, or damage occurred prior, during, or after the Market. Children (under the age of 13) and pets are not allowed in food prep booths per SLVHD guidelines. Pets are not allowed in any booth where food is being sampled. Any vendor pets must be on a leash. Amplified music or sound is prohibited at vendors booths during Market hours. Food Booth Requirements: Each food booth is required to have a posted Temporary Food Permit. Temporary Food Permits must be obtained from the SLCoHD Food Protection Bureau at least 12 days prior to the event date or a late fee of $35 will be assessed by SLCoHD per permit. Booths only serving foods that are not potentially hazardous and that are commercially prepackaged in individual serving portions or uncut, whole fruits and or vegetables may not be required to have a Temporary Food Permit. All vendors should contact the SLCOHD Food Protection Bureau to determine if permits are required. A restaurant with an annual food establishment permit must still obtain a Temporary Food Permit to operate a food booth outside of its permitted building. Food carts, trailers and mobile food units with permanent permits are not required to obtain temporary permits to operate at events, but must operate within the requirements of their permanent permit. At least one person shall be present in the food booth with a current Food Handler Card at all times. Each food booth shall meet the following minimum structural requirements: A roof, awning or other covering, impermeable to weather, over the entire food preparation, service, clean-up and storage area; Two side walls (not screening) which will reduce the entry of dust and dirt, and exclude non- authorized persons; The front service wall shall be a counter, half-wall, or table draped to the floor. The back wall may be open for employee access, or solid if desired; The floor shall be plywood, concrete, asphalt or other acceptable cleanable material. Flooring shall be provided if the vending site is on dirt, gravel, grass, or a poorly drained surface; All cooking equipment utilized at the food booths shall be at least 4 feet from the
5 public by roping off or by other means for safety reasons, as per FDA/CFP Guide. (Conference for Food Protection); and All open flamed cooking devices shall meet the requirements of the local fire code. Contact your local fire department to inquire what distance is required between the cooking unit and the walls and ceiling of the booth. Charcoal and wood burning devices are not recommended by the FDA/CFP. Sternos is not allowed. Each food booth shall be equipped with a hand wash station. Hand wash stations in restrooms do not qualify. A permanently plumbed sink is not required. At a minimum, there shall be a container with a handled spigot, which can stay open on its own to allow for water to flow freely so that a person can wash both hands at the same time, a catch basin or bucket, liquid hand soap, covered waste receptacle, and paper towels. All waste water collected shall be disposed of properly in an approved waste water container or sewer system. Fines & Penalties Failure to be at the Market by opening time $30 Failure to call Market Manager with required notice when not attending the Market $50 Failure to use tent weights as required $30 Failure to leave booth space clean $30 More than one approved vehicle in the park $25 Unapproved driving in the park during hours of operation $25 Failure to provide copies of legal and health department required documents will result in loss of Market space until such documents are in order. Any vendor caught reselling items will be asked to leave the market immediately and any money spent toward the venue will be forfeited. Any food booth without a handwash station or temporary food event permit will be closed immediately. Any vendor caught dumping water down the storm drain or using Sternos will be asked to leave and not allowed back for the remaindered of the season.
