1 2018 F.O.O.D Week Night Markets Friday 6 th April 2018 STALLHOLDER TERMS & CONDITIONS 1. MEMBERSHIP To be eligible to participate in the F.O.O.D Week Night Markets, your business must be a current member of either F.O.O.D Week Inc., Orange Regional Tourism or Orange Region Vignerons Association (ORVA). Memberships will be confirmed once applications have been received. Those without membership or with expired memberships will be requested to renew before participation is confirmed for the event. If you are not a member, please contact Orange Regional Tourism ( ) to discuss membership options. F.O.O.D. Week membership is available to purchase at 2. SITE INCLUSIONS Fete stalls have a 2.4m x 2.4m footprint with 3 x serving benches. Double stalls consist of two single fete stalls butted up next to each other providing a 4.8m frontage. Consistent chalkboard sign/s with individual name for each stall (please ensure specific stall name wording is used on registration form). Access to bins Organic, recycling & general waste Access to power (if you have indicated you require power on your registration form) Event security. Public toilets. A licensed Tester & Tagger to tag your leads prior to event commencement (for $5/lead). General park lighting & festoon lighting draped across your fete stall frontage. Advertising and promotion of the event. A4 laminated signs communicating Takeaway Bottle Sale conditions. Live entertainment. Trade Fair Liquor License to cover event see section 15 for more information. Event theming and decor including festoon lighting, chairs and tables - we encourage you to enhance the presentation of your stall with quality professionally made signs and other suitably themed items. Menu chalkboards (subject to availability). Event program for patrons to locate stalls easily. 1

2 3. SITE EXCLUSIONS No lighting is provided for underneath your fete stall. Please bring with you battery powered LED lighting for this purpose. Ice or coolroom facilities. Extension leads. Spittoons, cloths for fete stall benches nor other décor items. Hand washing facilities. RSA signage. 4. TIMES ONS 2. INCLUSIONS 2. INCLUSIONS The event commences at 5:30pm. Liquor licence & alcohol service concludes promptly at 8.30pm The event site closes at 9pm Stallholders can bump-in from 3pm on the event day. Stallholders can bump-out from 9pm no earlier. NO STALLHOLDER VEHICLES WILL BE PERMITTED TO DRIVE INTO ROBERTSON PARK UNLESS PRE-ARRANGED WITH THE EVENT MANAGER AND ONLY IN EXCEPTIONAL CIRCUMSTANCES. PLEASE CALL SARAH GILLOGLY ON TO DISCUSS ACCESS REQUIREMENTS. 5. PARKING Stallholders are encouraged to find suitable on-street parking, however parking restrictions will be in place as per Council signage and F.O.O.D. Week Inc takes no responsibility for parking infringements incurred by stallholders as a result of your involvement in this event. Stallholders are not permitted to park vehicles behind their stalls or anywhere within Robertson Park. Orange City Council and FOOD Week Inc will enforce this. 6. CORE INGREDIENTS In the interest of promoting the food, wine and produce of our chartered Local Government Areas (LGAs) of Orange, Cabonne and Blayney it is a requirement of the F.O.O.D Week Inc. that the core or signature ingredient of each dish must be sourced locally within the LGAs. If you need information on sourcing local ingredients, please contact Jane Arnott on An Orange & District Produce Directory will be circulated to food stallholders following receipt of your application. 2

3 7. VOUCHERS Please be aware that food vouchers will be prepared for F.O.O.D Week sponsors and key personnel, to be redeemed at the Night Markets. These vouchers are to be available for redemption at any of the participating food or wine vendors of the event. Once received, please retain the voucher and note the value. At the conclusion of the event please send all your vouchers with a covering letter or invoice with whom the cheque is to be written out to and for how much to: F.O.O.D. Week Treasurer PO Box 2229 Orange voucher equals 1 glass of wine or 1 serving of food only. It is a requirement of participating that all stallholders must adhere to the request to accept vouchers during the event. 8. STALLHOLDER LAYOUT In 2018, we will once again be utilising the Byng St. end of Robertson Park as well as the traditional Summer St. end of the park. As space is limited all available areas for fete stall placement is utilised and stalls are allocated randomly whilst ensuring a good spread of food and alcohol. The site layout will seek to maximise patron flow around the venue and minimise dead areas. 9. WASTE MANAGEMENT All stallholders taking part in the Night Markets must ensure they are using environmentally friendly products and compostable packaging as this is a PLASTIC FREE EVENT. Compostable cutlery, plates etc are available from Wrap Rite (52 McNamara St, Orange p ). Please refrain from using the public bins for disposing of any substantial rubbish. At the very minimum: Alcohol stallholders are required to remove all empty bottles from site. Cardboard boxes need to be flattened prior to depositing in bins. ALL flattened boxes need to go into the skips provided NOT wheelie bins, skip bins will be located along Lords Place & McNamara Streets. As in previous years, the area around your stall must be kept clean and tidy and after bump out. You must ensure the area in which you have been allocated is left clean and tidy with all rubbish to be deposited in bins provided or taken with you. Please note that this is a requirement of participation, and failure to comply may affect future participation. 3

4 10. COUNCIL FOOD PERMITS Despite what the name suggests, even stalls serving wine/beer or cider require a Temporary Food Stall Permit. Those already with a current permit need only tick the required box on the application form. Those without a permit will need to have the application completed and submitted to Council s Environmental Health Officer s, contactable via (02) or eho@orange.nsw.gov.au. (with payment) at least 4 weeks prior to the event. 11. AVAILABILITY OF POWER Availability of power is limited and should not be relied upon unless you have clearly indicated that you require it along with the items that you plan to plug into the power supply. You must provide us with this list to ensure we have sufficient power available at or close by your stall. Further to this, if you have a requirement for power in excess of 15A, you must pre-arrange this by calling Sarah Gillogly on Power will not be supplied for lighting the interior or fete stalls nor for theming/decorating purposes. 12. COOKING WITH GAS LP Gas is classified as a hazardous substance by Workcover NSW and thus any stallholder wishing to use LP Gas for cooking or heating at the Night Markets must complete an LP Gas Checklist. Your completed LP Gas checklist must be returned at least one week prior to the event date. 13. EQUIPMENT HIRE If you need any additional hire equipment items please contact local providers JD Events directly on (02) Any additional equipment will be the vendors responsibility, and they must arrange collection & return of such equipment directly with JD Events. Please do not leave hire equipment unattended in Robertson Park without first arranging with the hire company. 4

5 14. PUBLIC LIABILITY INSURANCE It is a requirement of participating that all stallholders must carry their own Public Liability Insurance to a minimum value of $10 million and where applicable additional Product Liability Insurance. Please contact your insurer or broker to ensure Orange City Council is noted as an interested party on your policy or Certificate of Currency for this event. A copy of your insurance certificate MUST be forwarded with your booking application form. 15. SALE & SERVICE OF ALCOHOL The event operates under a Trade Fair Limited Licence. The following licence conditions must be met & adhered to by all stallholders serving alcohol: This licence permits both the consumption of alcohol on the premises and the selling of packaged unopened bottles for takeaway purposes only. This second point must be clearly communicated to your patrons upon purchase. All stalls serving alcohol must provide & display the appropriate R18+ signage. (1 only required). All wine stalls must ensure staff are appropriately RSA trained and have proof of RSA on them at all times during the event. Staff on stalls MUST use good RSA practice and refrain from serving alcohol to anyone they think has had too much. Alcohol service is to cease strictly at 8:30pm or as otherwise advised by the licensee. There will be 6 x FREE water points erected around the event site so it is not mandatory that all wine stalls must have free water at their stall, however you are encouraged to do so. The licensee for the event is Michael Abberton please ensure you adhere to any of Michael s communication and instructions in relation to relevant license conditions on the night. 16. CANCELLATIONS POLICY All cancellations must be notified to F.O.O.D. Week Inc in writing. Cancellations received 3 weeks or more prior to the start of the event will not incur any charge. You are not permitted to cancel within 5

6 the 3 weeks prior to the start of the Event. You acknowledge and agree that, if you purport to cancel in the 3 weeks prior to the Event, or fail to attend the Event without F.O.O.D. Week Inc s prior agreement, F.O.O.D. Week Inc will be entitled to retain your up-front rental payment (if already paid) or require immediate payment of the up-front rental payment (if unpaid). The participant acknowledges that F.O.O.D. Week Inc does not make any representation or give any warranty with respect to the event, including the number of attendees or the success or profitability of the event. The participant participates in the event at its own risk. The participant acknowledges that F.O.O.D. Week Inc is not responsible for, and accepts no liability in relation to, the participant s participation in the event. F.O.O.D. Week Inc s liability to you will be limited to the amount(s) paid by you in respect of any stall rental or fee paid. In no circumstances will F.O.O.D. Week Inc nor any of its associated 3 rd party stakeholders be liable to you for any indirect, incidental, special and/or consequential losses or damages (including loss of profits or opportunity) arising in connection with the event. 17. INDEMNITY In consideration of F.O.O.D. Week Inc permitting the participant to operate a Stall at the Event, the participant indemnifies F.O.O.D. Week Inc and its related bodies corporate against any liabilities, losses, damages, outgoings, costs and expenses suffered or incurred by F.O.O.D. Week Inc, a related body corporate of F.O.O.D. Week Inc or any third party (including any Event attendee or participant) arising out of the Stallholder's participation in the Event, including the operation of the Stall or the sale of any product at the Stall, any negligent act or omission of the participant or any of the participant s representatives or any breach of the terms of this agreement by the Stallholder. 18. FORCE MAJEURE For the purpose of this clause, Force Majeure means an event or circumstance beyond the reasonable control of a party, including acts of God, war, rain, hail, fire, explosion, civil disobedience, legislation not in force at the date of this Agreement or labour disputes. Neither party will be in breach of this agreement, and neither party will be liable to the other party, for any delay or failure to perform an obligation under this Agreement due to Force Majeure. Further, the participant acknowledges it is not entitled to any reimbursement in respect of any event or circumstance that prevents or disrupts the Event, including inclement weather. 6
