These rules and guidelines have been developed to help achieve this. Quality items that are made with love and not mass-produced. Farm Produce Items produced on farms within the Wheatbelt area. Local The term local refers to people who live within, or own property within, the Shire of Northam. Primary products A raw product that has not been altered from its primary state e.g. fruit, vegetables, eggs, animals etc. Value Added Products A primary product that has been altered, modified and/or added to, to create a different sellable item e.g. turning milk into ice-cream, fruit into jams etc. NOTE: value added products must be made from artisan produce. Small Livestock Poultry (chickens, turkeys, ducks, geese), rabbits, guinea pigs. Ready to Eat Food Food that is ordinarily consumed in the same state as which it is sold. Food Business The Food Act 2008 defines a food business as: A business, enterprise or activity that involves the handling of food intended for sale, or the sale of food, regardless of whether the business, enterprise or activity (other than a business, enterprise or activity that is primary food production) is of a commercial, charitable or community nature or whether it involves the handling or sale of food on one occasion only. Exempted Food Business A food business is an exempted food business if the food business is:- conducted SOLEY to raise money for charitable or community purposes AND the food is not potentially hazardous food OR after being appropriately cooked the food is for immediate consumption. (e.g.: sausage sizzle); OR the food is not potentially hazardous food AND the food cannot be handled because it is in closed packages. E.g. 4 ABOUT NORTHAM FARMERS MARKET BACKGROUND The Northam Farmers Market is an initiative of the Northam Chamber of Commerce and Northam Women in Business. The original intent was to bring a value added event to the Northam community that promotes Northam and positively impacts local businesses. The market is run by a Market Manager who is overseen by a subcommittee consisting of one representative of the Northam Chamber of Commerce and one representative of Northam Women in Business, plus any other suitably recognised individuals. THEME Fresh produce, health and wellness. MISSION To create a thriving farmers market that positively impacts local businesses and the Northam community as a whole. To provide a space for local and regional artisan and farm producers to sell products directly to the public. To encourage consumption of fresh, local, seasonal food and promote health and wellness for both humans and the environment. OBJECTIVES The key objectives of the Northam Farmers Market are: 1. To create a successful farmers market that mutually benefits buyers, sellers, Northam community, local businesses and provides a space that is uplifting for all those involved. 2. To provide a direct interface between buyers and sellers. 3. To support the sale of: a. Local seasonal artisan fresh produce b. Value added goods made from local seasonal artisan fresh produce c. Local and regional Wheatbelt farm produced goods d. Artisan ready made food e. Small livestock f. Artisan grown edible plants 4. To promote health and wellness modalities & therapies 5. To provide a space for an education stall at each market which fits within the market theme. 6. To provide a space for entertainment at each market. 7. To support activities that add value to market attendees, local business and the Northam community. 8. To support local community groups to fundraise via sale of food that also supports local businesses. 9. To provide a space for the Northam Chamber of Commerce to promote its activities and represent local businesses. 4

5 DATE, LOCATION, TIME 2 nd & 4 th Saturday of each month Village Green & Avon Mall, 174 Fitzgerald Street (former Fitzgerald Hotel Site, opposite the Boulevard), Northam 8.30am-1pm PROVIDING A PRODUCT OR SERVICE AT THE MARKET If you would like to provide a product or service at the market, the following steps needs to be followed: STEP 1: Check with the Rules and Guidelines Objectives to see if what you d like to do is a good fit with the markets. STEP 2: Submit an Expression of Interest (EOI) Form (complete an electronic form by clicking here). The Market Manager will assess application and direct you to step 3 if successful. STEP 3: Submit an Application Form information will be sent to you by the Market Manager if your EOI is successful. STEP 4: Once all requirements of the Application Form are successfully submitted applicants will be given instructions for market day. STEP 5: Submit a Market Notification Form (for product providing stallholders only) before each market to advise attendance. STALLHOLDER ELIGIBILITY Eligibility of stallholders will be determined by the Northam Farmers Market Manager, and committee where relevant. Stallholders will need to meet the criteria of the market objectives, however flexibility can be demonstrated at the manager/committee s discretion, if they feel it will add value to market day. STALLHOLDER DETERMINATION The Market Manager will seek a wide range of stalls and will aim to balance competition where relevant. Preference will be given to locals in the first instance. FRIENDS OF NORTHAM FARMERS MARKET If you would like to support the Northam Farmers Market you can become a friend of the market for $15 per year, which helps to financially support the initiative. 100% of proceeds go toward continually developing the market. SPONSORS OF NORTHAM FARMERS MARKET Sponsorship is a way of supporting the market whilst advertising your brand. Please contact the Market Manager for sponsorship opportunities. 5

6 EDUCATION, ENTERTAINMENT & ACTIVITIES Sponsored spaces will be provided at each market for education, entertainment and activities. Education A space will be allocated at each market for an Information Stall. This is to allow people to knowledge share in areas of interest in relation to the market s mission, theme and objectives. Entertainment A space will be provided for music, buskers, or an MC, as relevant, to entertain market goers and create an uplifting atmosphere. Activities Northam Farmers Market support activities that aim to add value to market day, local businesses or the Northam community as a whole. STALL SIZE One standard stall bay is 3m x 3m. FEES Product Stalls (Food and Non Food) $30 per stall Service Stalls (Education, Entertainment & Activities) No cost PAYMENT Stallholders must pay fee before market day to confirm and secure their stall. Payment on market day can be arranged between stallholder and Market Manager where appropriate. BOOKINGS/CANCELLATIONS All bookings must be made, and fees paid, the Tuesday before market day to allow for processing of paperwork. Any cancellation of stalls must be advised within 48 hours of market day to receive a credit. If the stallholder is unable to attend the market for unforeseen circumstances, or the market is cancelled due to extreme weather events, stallholders will receive a credit for a future market. Stallholders will be notified of any cancellations as soon as possible. 6

7 DISPUTE RESOLUTION Information on disputes that may arise should be put in writing to the Northam Farmers Market Manager covering all facts. An investigation into the matter will take place and the Northam Farmers Market committee will respond in writing regarding the outcome of the resolution. DISCLAIMER All stallholders are asked to respect the Market Manager s efforts and communicate and deal with the Northam Farmers Market Manager/Committee with respect. The Northam Farmers Market Manager reserves and maintains the right to refuse product or service providers (stallholders) entry for any reason. Northam Farmers Market Manager is to have final say on any matter, at their discretion. The Northam Farmers Market reserves the right call the Ranger in regard to animal upsets on market day. Stallholders will indemnify the organizer from any damage, expenses or liability arising from any injury or damages to any person, including the general public, the stallholder or others, occurring either in the space occupied by the participant or elsewhere arising out of its occupancy or anything connected with occupancy. The organizer will not be liable for any loss or damage to the property of the stallholder due to fire, robbery, accidents or any cause whatsoever that may arise from use and occupancy of the site. The organizer assumes no liability for any damages or losses resulting from or relating to the failure of the stallholder to comply with the provisions of this agreement. STALLHOLDER REQUIREMENTS Those that are successful with their Expression of Interest will be sent a Stallholder Application form to complete. Below are requirements for eligible Stallholders. INSURANCE All stallholders (including education, entertainment & activity providers) are required to have a minimum of $10 million public liability insurance and supply an up to date Certificate of Currency to the Market Manager. It is the responsibility of the stallholder to ensure upkeep and renewal of their public liability insurance. Options for insurance: Check with your current insurance provider to include cover for selling at the Northam Farmers Market Organise own independent public liability insurance specifically for the markets Adjust current insurance (i.e. farm) to cover selling at markets 7

8 Please contact the Market Manager to discuss options regarding coming under the NFM Insurance if you: are new to selling and would like to have a 3 month trial before committing to an independent insurance provider. are an education, entertainment or activity stall without insurance. FOOD STALLS Stallholders selling food or food products are required to operate in accordance with the Food Act 2008 and the Shire of Northam Environmental Health Officer (EHO) requirements. The Shire of Northam EHO will determine your compliance with the Food Act 2008, food safety standards and food labeling. Stallholders selling food (excluding Exempted Food Businesses) are required to supply a copy of their current Food Business Registration Certificate from the Shire in which the food is produced/processed. Stalls selling or providing stalls are required to submit additional notification documentation to the Shire of Northam. Please note the fees attached to this submission will be covered by the NFM Market Manager and do not have to be paid by stallholders. Relevant forms will be supplied during Step 3 of the NFM application process. LABELING All stallholders must comply with appropriate labeling regulations in accordance with the Food Act 2008 and the Australia New Zealand Food Standards Code. WEIGHTS AND MEASURES Stallholders must meet requirements under the Weights & measures Act. FOOD SAFETY Stallholders must comply with the food standards that apply to their products and comply with their obligations under the Food Act as stipulated in the ANZF Standards and by the Environmental Health Officer at the Shire of Northam. WASTE MINIMISATION The Northam Farmers Market committee encourages stallholders to think about how they can minimize the amount of waste produced by their stall. Stallholders are encouraged to use environmentally friendly/biodegradable packaging, plates, cutlery and any other single use items. The Northam Farmers Market is proudly a plastic bag free event. Change starts with us. 8

9 MARKET DAY REQUIREMENTS Specific instructions for market day will be sent out to stallholders once paperwork has been successfully submitted. ARRIVAL Stallholders are welcome to arrive 1.5 hours before the market start time on the morning of the market. Please ensure courtesy is offered to other stallholders at all times. No driving on the grassed area is permitted. ACCESS Access to the Village Green can be achieved via Fitzgerald Street or Minson Ave. The Village Green is located opposite the Boulevard Shopping Centre entrance on Fitzgerald Street. PARKING Once stallholders have offloaded their equipment from vehicles, cars must be removed and parked in the public areas around site. STALL INFORMATION Assignment Stalls will be assigned before the market. Stall bays will be pre-marked. Set Up Stallholders are responsible for their own stall set up, including shading and equipment. No protruding ropes or poles are to be outside designated stall bay. Please ensure all equipment is secured to allow for all weather conditions. Pack Up No stalls are to be dismantled during market operating hours. If stock is sold before the end of the market a Sorry Sold Out sign may be displayed to let customers know. Stalls can be dismantled on completion of the advertised market end time. TRADING Trading shall only occur during market operating hours that are advertised to the general public. No trading is to take place outside of these hours. Bartering Stallholders are encouraged to barter with left over stock at the end of trading hours. Bartering is to be conducted with other stallholders only and inclusion is at the discretion of operator. 9

10 EQUIPMENT AND STRUCTURES Equipment and structures must comply with the Occupational Safety and Health Regulations 1996, as administered by Work Safe Western Australia. Marquees less than 10m 2 are to be braced and fixed to withstand normal wind loads. WASTE DISPOSAL All waste is to be removed by stallholders before leaving. The site should be left in the same condition it was found at the time of arrival. Stallholders are encouraged to recycle any relevant waste, in the appropriate bins provided, and should encourage customers to do the same. SIGNAGE Please ensure signage is clearly visible to the consumer and contains accurate and honest information. POWER If you require power, or wish to bring your own, please contact the Northam Farmers Market manager to discuss. Power requirements as per Shire of Northam Event Determination: Electrical outlets and electrically operated equipment in areas available to the public must be protected by RCD s with a tripping current of 30 milliamps. A tag to identify the item, test date and the electrical worker should be fixed to the tested equipment. Leads: Electrical leads must be tested and tagged within the past 6 months in accordance with AS3012 Clause 13. Temporary electrical leads must be flexible cables. TPS cables are not permitted. Leads must not be placed on the ground in trafficable areas. Cord junctions shall not be exposed to the weather or in damp situations. Leads should not be accessible to members of the public. Where this is unavoidable they must be either buried or suspended out of reach to members of the public. FIRST AID AND EMERGENCY RESPONSE In the event of an emergency 000 will be called. A first aid kit will be kept at the Northam Farmers Market information stall and can be accessed as necessary on the day.
