1 ity of Sanibel lanning Department Staff Report July 23, 2013 At the July 9, 2013 lanning ommission meeting, the ommission requested that staff examine the permitted and conditional permitted uses of some other communities. In doing so, the ommission could use this information to compare any difference in the approaches taken with regards to permitted and conditional commercial uses. In completing this task Staff has compiled a list of six communities from across the country that are similar to Sanibel in that they are vacation destination with progressive planning regulations that focus on the environment and preserving their community character. As a result the following six communities were selected: 1. Aspen, olorado 2. armel-by-the-sea, alifornia 3. Longboat Key, Florida 4. Rehoboth Beach, Delaware 5. Jackson, Wyoming 6. Nags Head, North arolina For each community, there is a brief description of the community and their zoning code, the process for receiving approval for permitted and conditionally permitted uses and a key for reading the matrix. The matrix contains all of the permitted and conditional commercial uses for each of the municipalities commercial districts. The matrix also includes the permitted and conditional commercial uses for Sanibel so that the ommission can make comparison to the other communities selected. Furthermore, terminology used by the other communities has been converted to the terminology used by Sanibel to reduce any confusion.

9 ity of Aspen, olorado Description: Aspen is a city of 6,658 people located in west-central olorado just under 8,000 feet above sea level. Aspen is a popular ski destination with one of the most expensive real estate markets in the United States. The Aspen ode often uses terms such as retail use or office use when identifying what specific uses are permitted within its commercial districts. There are definitions of what a retail use or an office use is; however, the traditional list of items that qualify as one of those uses is absent. 12 ity of armel-by-the-sea, alifornia Description: armel-by-the Sea, alifornia is a city of 3,722 people located on the acific coast, about 330 miles north of Los Angeles and 120 miles south of San Francisco. 16 Town of Longboat Key, Florida Description: Longboat Key, Florida is a town of 6,888 people located on the Gulf of Mexico approximately 60 miles south of Tampa. Longboat Key is the name of both the town and the barrier island on which the town is located. The Longboat Key code appears to have a hierarchical organizational structure in regards its commercial districts. 18 ity of Rehoboth Beach, Delaware Description: Rehoboth Beach, Delaware is a city of 1,327 people located in southern Delaware on the Atlantic Ocean. In 2011, The Natural Resources Defense ouncil awarded Rehoboth Beach with a 5-Star rating in water quality; this award was given only to 12 other locations. Rehoboth Beach only has three commercial districts and they appear to permit a number of the same uses in all three districts. 21 Town of Jackson, Wyoming Description: Jackson, Wyoming is a town of 9,577 people located in western Wyoming near the Idaho border. Jackson is commonly referred to as Jackson Hole, which is the valley in which it is located. Jackson has by far the most commercial districts of the communities staff investigated. Of these districts; however, two of the six mirror another district with only a few minor discrepancies between the two. Nags Head is a popular vacation destination and has a number of structures listed on the National Register of Historic laces.
