ABOUT US The "Hotel of the Year 2018/2019" is on a hillside not far from the city centre and boasts magnificent views of Lake Lucerne, the city of Lucerne and the mountains of Central Switzerland. 42 Art Deco rooms and 19 penthouse rooms, outstanding food at the Scala Restaurant (15 Gault&Millau points) and the Kitchen Club, all kinds of events in the Louis Bar and the Hemingway Rum Lounge and a day spa for a pampering massage - you'll find all this and more at "the happening hotel". You'll be bowled over by the unique ambience and sensational location. Our staff work hard to make your stay with us a memorable experience, and their excellent service is the icing on the cake. 2. GETTING HERE Getting here on public transport From Lucerne station take bus no. 6, 8 or 24 and in about 5 minutes you reach the Casino/Palace stop. Just across the road, you'll see the hotel's own funicular railway, which carries you directly into the hotel lobby, free of charge. The little MONTANA train is the shortest funicular railway in Switzerland and runs when a guest presses the button. Travelling by car From Zurich Airport, it is about 65 km or 50 minutes' drive on the A4 motorway. If you come by car, it is best to park at the Casino car park. Then you just need to cross the road and take the little funicular railway up to the MONTANA. For larger groups, we recommend booking in advance at the Casino car park (basic charge of CHF 5.50 per space, charges depend on length of stay). Parking spaces There are a limited number of parking spaces in front of the hotel which cannot be reserved. There are more spaces in the blue disc zone nearby. For guests attending a seminar who are staying the night, we are happy to reserve a parking space in our indoor car park just opposite the main entrance to the hotel, at a cost of CHF 25 per night. There are also three parking spaces for e-cars. Page 2

FOOD & DRINK & SPECIAL VENUES Food and drink Scala Restaurant (70 seats) with fireside area (40 seats), Scala terrace (100 seats) The MONTANA restaurants have been awarded 15 Gault&Millau points. The food has a Mediterranean flavour and reflects the joie de vivre of the south. For our head chef Johan Breedijk, excellent ingredients, freshly prepared, are the key to success. Whenever possible, he uses seasonal produce from the local region. Johan Breedijk and his team put passion into their cooking that you can veritably taste. Kitchen Club The mantra here is "At the heart of the action, not just outside". In the Kitchen Club, guests are immersed in the hotel's culinary world. An escalator takes you into the very heart of the hotel kitchen, where you can watch our chefs in action as they create your meal. Pull up a chair at the Kitchen Table (seating up to 26 people) in the middle of our award-winning kitchen (15 Gault&Millau points), and you will see, smell, hear, feel and taste everything the ultimate experience for all your senses. Ideal for a dinner with a difference. Beach Club / Winter Wonderland Leave the stresses and strains of the seminar behind you and, afterwards, enjoy that summer beach feeling above the roofs of Lucerne. At the MONTANA Beach Club, we treat you to refreshing drinks and dainty canapés outdoors, with stunning views of Lake Lucerne and the mountains of Central Switzerland. In winter the Beach Club is transformed into the cosy Winter Wonderland, where you can start your Christmas meal with mulled wine and canapés. Louis Bar & Hemingway Rum Lounge The smoke-free Louis Bar has 130 different whiskies and is well-known far beyond Lucerne as a meeting place for fans of old-time jazz, blues, Dixie and swing. In the adjacent Hemingway Rum Lounge, you can enjoy some stylish down-time surrounded by one of the biggest rum collections in Switzerland and a selection of fine cigars, complete with modern smoke extractor. 13 9. GENERAL TERMS AND CONDITIONS These terms and conditions of business govern the contractual relationship between you as the event organiser and the (referred to below as the ADHM). 1. Scope of validity These terms and conditions of business apply to the provision by the ADHM of conference, banqueting and seminar facilities and all associated services and supplies, including the letting of hotel rooms, to the event organiser and event participants. The terms and conditions of the ADHM shall apply exclusively. The event organiser's terms and conditions do not form part of the contract, even where this is not explicitly stated. 2. Reservations A contract between the organiser and the ADHM comes into effect when a) a price quotation from the ADHM is confirmed in writing by the organiser or b) an enquiry by the organiser is confirmed in writing by the ADHM. Amendments to the contents of the contract are not binding unless confirmed in writing by the ADHM. 2.1 Price quotations The period for acceptance of price quotations from the ADHM is 14 days unless agreed otherwise. After that period, the ADHM is no longer bound to honour that price quotation. The ADHM reserves the right to withdraw a price quotation before the period for acceptance has expired, where there is compelling reason. The ADHM always recommends viewing the proposed facilities in advance before making a reservation Options Options are binding on both parties during the agreed options period. On expiry of the options period, the ADHM reserves the right to allocate the reserved dates and services elsewhere. 3. Changes to the number of participants or the time of the event The event organiser is obliged to notify the ADHM of any changes to the number of participants as soon as possible. In principle, the ADHM will endeavour to find another client for the unused reserved facilities on the same terms. If these efforts are successful, the costs will not be charged to the event organiser. 3.1 The ADHM should be notified of the exact number of participants no later than 48 hours before the event. This figure will form the basis for invoicing. If more participants attend an event than were expected, the hotel will invoice for the actual number of participants. The ADHM guarantees to provide the agreed services for up to 5% more participants than expected, on the agreed terms. 3.2 If the number of participants varies by more than 10%, the hotel is entitled to apply different prices from those agreed, and to provide different facilities, provided this is acceptable to the organiser. The organiser cannot claim that the alternative facilities are unacceptable if they are required on account of compelling circumstances such as legal requirements or safety reasons. 3.3 If the number of participants (for a seminar or banquet) is reduced by more than 10% compared with the confirmed number, the ADHM will make the following charges for each no-show participant: - Up to 30 days before the event No charge - From 29 to 10 days before the event 50% of the agreed services - 9 days before the event or less 100% of the agreed services If some services had not yet been confirmed at the time when the number of participants changed, a flat rate of up to CHF per person may be charged. If the number of rooms booked is reduced, the terms given under paragraph 5.1 apply. Up to 4 rooms can be cancelled free of charge up to 48 hours before arrival (except during the Lucerne Festival Summer) At least 10 days before the event, the organiser will send the ADHM the detailed programme, information about how the rooms should be set up, the type and amount of technical equipment required and all the information that the ADHM needs in order to ensure that the event runs smoothly. Any additional information requested by the ADHM must be provided by the organiser If the agreed start and finish times of the event change, the ADHM may charge for any additional costs thereby incurred. This does not apply if the ADHM is responsible for the change of time. 4. Booking of hotel rooms The organiser must tell the ADHM at least ten days before the event how many hotel rooms will be required in connection with the event. The organiser is only entitled to expect rooms to be made available if that formed part of the booking for the event as a whole. The ADHM may charge for the cost of the room if reserved rooms are not used and cannot be assigned to other guests. Page 12
14 5. Withdrawal by the organiser The ADHM must be notified in writing as soon as possible if an event is cancelled. 5.1 If the event is entirely cancelled by the organiser, the ADHM will apply the following cancellation charges: - Up to 90 days before the agreed date: free cancellation - 89 to 60 days before the date: 25% of the booked services - 59 to 30 days before the date: 50% of the booked services - 29 to 15 days before the date: 75% of the booked services - 14 to 3 days before the date: 95% of the booked services - 2 days before the date of the event: 100% of the booked services 5.2. For partial cancellations (of seminars or banquets), the conditions of paragraph 3.3 apply. Charges are based on the date on which the written cancellation reaches the ADHM If the reserved services (meals & drinks) had not yet been specified, the cancellation charges will be based on a sum of CHF per person. 6. Bringing your own food and drinks Under no circumstances may the organiser bring their own food or drinks to the event. Any exceptions require written agreement from the ADHM. In such cases a sum will be charged to cover overheads (service charge). 7. Terms of payment Payment of invoices from the ADHM is due in full within 10 days of the date of invoice. The invoiced services are regarded as having been provided properly and in full if the event organiser does not register a complaint during the period allowed for payment. 7.1 The ADHM reserves the right to request an advance payment amounting to 50% of the agreed services. In the case of reservations with a billing address abroad or reservations made from abroad, an advance payment of 100% of the cost of the booked services may be charged. If the event organiser is late in making the advance payment, the ADHM is entitled to withdraw from the contract in accordance with paragraph 8.1 of these terms and conditions. In cases where paragraphs 3 to 5 of these terms and conditions apply, the advance payment will be offset against the costs. 7.2 The ADHM reserves the right to charge for any costs incurred in the event of late payment, such as the cost of issuing reminders, finding addresses and carrying out credit checks, and also including solicitor's fees. The organiser hereby confirms that they agree to the levying of these charges, even where these are not, or not entirely, recoverable under statutory provisions. 8. Withdrawal by the ADHM The ADHM is entitled to withdraw from the contract at any time where there is compelling reason. Compelling reasons would be, in particular, official requirements or prohibitions, safety issues, cases of force majeure and other circumstances for which the ADHM is not responsible or which are beyond its control. In such cases the ADHM will assist the organisation in finding suitable alternative facilities. 8.1 The ADHM can also withdraw from the contract in the following circumstances: a) There is good reason to suppose that the event or its participants would put at risk the smooth operation, safety or reputation of the hotel or its guests. b) The ADHM ascertains that important information given when an event was booked was misleading or incorrect, or that the booking is for a purpose other than that stated. c) Third parties that are called in by the ADHM at the request of the event organiser to help with organising the event are prevented from doing their work either properly or at all. 8.2 The ADHM will announce their withdrawal as soon as they learn of the circumstances justifying that decision and will inform the event organiser promptly. The organiser is not entitled to make any claim for compensation against the ADHM in any of the above circumstances. 9. Additional provisions 9.1 Extensions: The official closing time is a.m. from Monday to Sunday. We are happy to apply for an extension (until no later than 4 a.m.) for your event. The cost of the licence and the staff overtime will be charged to the guest by the ADHM as follows: From to 2 a.m. a flat-rate fee of CHF 600 Each subsequent hour up to max. 4 a.m. CHF 450 Please note that the Scala Restaurant cannot stay open until later than 2 a.m. If third parties complain about the noise, or the enjoyment of other guests is put at risk, the ADHM is entitled to issue instructions to the event organiser which must be strictly observed. Failure to comply with these instructions may result in additional charges being made. 9.2 Additional services: Additional services by ADHM employees at the hotel which go beyond the norm for the restaurant or hotel industry or which are unexpected may be charged for at a rate of CHF 15 per employee per quarter of an hour or part thereof. These include in particular tasks such as tidying up, rearranging chairs, waste disposal, cleaning or IT support, unless these were included in the booking confirmation. 9.3 All prices are in CHF (Swiss francs) and include VAT at the legal rate. 15 10. Liability 10.1 The organiser is liable for the entire invoiced amount, including all services used by their employees and helpers and the participants in the event. Any exceptions must be agreed in writing The organiser is liable for any damage or losses incurred by the ADHM for which the organiser, their employees or helpers or the participants in the event were responsible. No proof of culpability is required. The ADHM is entitled to ask the organiser for evidence of appropriate security (e.g. insurance, deposit, credit guarantee) The ADHM is not liable for the theft of or damage to property brought in by the event organiser, their employees and helpers or by participants in the event. The same applies to vehicles parked in the hotel's parking spaces or indoor car park If the ADHM provides technical or other equipment for the event organiser, or obtains it from third parties, the ADHM does so on behalf of and at the expense of the event organiser. The organiser is liable for the careful handling and return of such equipment and exempts the ADHM from all claims by third parties arising from its loan The ADHM is liable only in cases of intent or gross negligence. 11. Closing provisions Any amendments or additions to the contract, any supplementary agreements or these Terms and Conditions of Business must be made in writing. The same applies to the waiving of the requirement for written form. Unilateral amendments by the event organiser are not valid The place of fulfilment and payment is the ADHM's head office The parties agree that the sole place of jurisdiction for any disputes regarding the contractual relationship or preparations for it, supplementary agreements or these General Terms and Conditions of Business is Lucerne. Swiss law applies Any advertisements in the media referring to an event booked at the ADHM require previous written permission from the ADHM Should any provisions of these General Terms and Conditions of Business be ineffective or null and void, that does not affect the validity of the remaining provisions. The ineffective provision will be replaced by a valid one which comes closest to the spirit and purpose of the ineffective provision.
