14 Validity These terms and conditions apply to deliveries, services and offers of Colella's Catering. The owner of the catering is Adriano R. Colella, Paintweg 1, Grafenwoehr OT Hütten. Price All prices are in Euro including VAT. Terms of Service Prices for delivery Delivery times: -By arrangement and offer -Equipment delivery separately if required Delivery up to 35 Km -From a value of free of charge Delivery more than 35 km -Per kilometer driven 0.50 from km 35 Order Acceptance Until the order is accepted, all offers are non-binding. The acceptance must be in writing. The written form is preserved by countersignature on the offer. The acceptance of the offer must take place within a period of one week-7 days from receipt. An acceptance declared by the client after the week-end is considered a new offer, which has to be accepted by Colella's Catering. Attendance The client undertakes to notify Colella's Catering, the exact number of participants and the defined choice of food and drink at least 5 working days before the event. These details are considered as guaranteed contract contents and are considered accordingly in the final bill. Any additional orders for food, drinks or additional material will still be invoiced separately from the list price. Claim Upon receipt, the buyer must inspect the delivered goods for obvious and recognizable defects with regard to their condition and notify the seller of any defects. Warranty claims of the buyer are not affected by this. Food and beverage, which were ordered by the buyer wrong, are excluded from the exchange. Payment Our deliveries are payable without deduction within 14 days from receipt of the invoice, unless otherwise agreed. Colella's Catering reserves the ownership of the delivered goods until full payment of the purchase price (reserved goods). Furthermore, default interest will be charged in case of late payment. From an order value of 2,500, a down payment of 50% of the expected total costs is due. Lass or damage of rental Property For leased objects, the customer is responsible for the duty of care from the time of the takeover until return. In the event of damage or loss due to the fault of the client, the costs of replacement or repair shall be charged Cancelation The contract can only be terminated for good cause. If the client terminates the contract no later than 4 working days before the agreed delivery or pick-up date, he will be invoiced in full for the costs incurred until then. Until a later suitability to pay, the client is obliged to pay 80% of the order sum as damages. The client is free to prove that Colella's Catering, no or less damage has occurred. Written Form Deviating agreements or additional agreements must be made in writing in order to be valid. The contract is subject to German law.
