5 TERMS AND CONDITIONS 2. confirmation of booking; bookings will only be regarded as confirmed upon receipt of signed terms & conditions and a deposit of 100% of the minimum spend. any changes to the contract and booking details must be made in writing and will be of no effect unless acknowledged in writing by bluebird. in the event that this agreement is signed in the name of a company, partnership, agency, firm, club or similar society, the person signing represents to bluebird that he has full authority to sign such a contract. in the event that he is not so authorised he will be personably liable for the complete performance of this contract. 3. minimum spends, deposit, pre-payments and settlement the minimum spend quoted to you will include vat at 20% however, the spend will exclude the service charge with is added at 12.5% the customer shall be required to pay a deposit to bluebird to secure the date of the event. 100% of the minimum spend will be required. your bill must be settled in full at the end of your meal. at this time your deposit will be deducted. No account facilities are available therefore should any client not pay the final amount on the night of the event the payment will then be charged to the Credit card details submitted to pay the deposit. in the event of unpaid bills by the organiser or individuals attending the event, interest will be payable by the customer on all sums due calculated on a day to day base rate of 2% per calendar month from the due date of payment until the actual date of payment. the interest is to be paid before, as well as after, any judgement (such obligation to be an independent judgement). any queries concerning the accounts or complaints must be submitted in writing within seven days of the date stated on the invoice. 4. final numbers final numbers for any event must be confirmed in writing at least 2 working days prior to the event date. we reserve the right to charge for the full number of people booked if we have not been provided with notice of a reduction in numbers at least 48 hours prior to the event. Bluebird store ltd will make every reasonable endeavour to accommodate any increase in numbers and will charge accordingly for providing this service, but cannot be held responsible for failure to provide such accommodation or service. 8. prices 12.5% discretionary service charge will be added to your bill, however, payment of this remains at the discretion of the customer. the customer agrees to the minimum spends stated, this includes vat at 20% and excludes service we reserve the right to charge in full for anything (including house flowers) removed from the restaurant and for any damages sustained to the room or furniture within. all prices are current at the time of going to print and includes vat or other government taxes where appropriate. bluebird reserve the right to amend prices and take into account any changes in the rate of vat or other taxes. 9. signage the fixing of signs, displays, posters etc may only be carried out with the consent of bluebird store ltd. 10. loss or damage bluebird store ltd will not be liable to the customer or any person claiming through the customer for any loss or damage caused by, or arising from, its failure to carry out any obligation under this agreement due to anything beyond our control of bluebird store ltd. bluebird store ltd will not be responsible to the customer or any person, claiming through the customer, for any loss of business or profit, or any other consequential loss however arising, including delay or failure to carry out any of its obligations under this agreement. the customer agrees to be responsible and shall indemnify bluebird store ltd against all damages occasional to the restaurant, the fixtures and fittings caused by an act, default, or negligence of the customer or staff, agents or guests of the customer. bluebird store ltd hereby exclude any liability to the customers resulting from any negligent act or omission of bluebird store ltd or its agents or employees in connection with this agreement or otherwise, except that bluebird liability to the customer shall not be limited to death or personal injury resulting from its own negligence or that of its agents. bluebird store ltd shall not be held responsible for the death or bodily injury arising from any cause whatsoever to: person visiting the allocated space on behalf of, at the invitation of, or the request of, the customer, or 5. cancellation by bluebird store ltd bluebird may cancel a booking without any liability being incurred whatsoever if:- person employed by the customer whether such death or injury occurs within the allocated space or in any part of the restaurant unless caused by the neglect of bluebird store ltd. bluebird is closed down due to events and circumstances beyond our control such as fire, staff dispute, lock out or by order of public authority or any circumstances outside the control of bluebird store ltd. 11. bluebird store ltd reserve the right to decline the employment by the client or any of its guests to any photographer, toastmaster, band, musician or any other person in connection with the event, but will without obligation be pleased to give the client and it s guests the benefit of bluebird s advice or recommendations in the respect. any such person so objected by bluebird store ltd shall not be employed by the client of any of it s guests. the customer becomes insolvent or enters into liquidation/receivership the customer is in breach of any of the terms and conditions the customer fails to pay the requested deposit 6. cancellation by the customer all cancellations by the customer must be made in writing by bluebird as the address stated, and formally acknowledged. bluebird store ltd will refund deposits where notification has been received 28 days in advance of the function date. 7. menu we offer the set menus enclosed with these terms and conditions and require that you choose the same menu for all members of your party. your choice of menu and wines must be submitted at least three weeks prior to the event. only wines and spirits supplied by bluebird store ltd are permitted for consumption on our premises. if requested, bluebird store ltd would be able to offer a choice of 3 different dishes including a vegetarian dish. this applies to parties up to 30 guests. For parties over 30 guests and up to 39 guests a 2 choice set menu will need to be chosen. for parties over 40 guests it will be a menu with 1 starter, 1 main and 1 dessert- we will cater for any dietaries and vegetarians. occasionally certain dishes and wines become unavailable at short notice due to difficulties of supply. in this event, we will contact you immediately to propose an alternative. therefore menus are subject to changes dependant on seasonality and availability. 12. on the occasions when the client arranges any third party supplier or contractor direct, it is the responsibility of the client to ensure that bluebird store ltd is fully informed of all arrangements. furthermore, the client must ensure that the third party provides adequate insurance and observed all health and safety requirements. 13. filming to protect the privacy of our club members, filming is not permitted in the bluebird store ltd club. filming in the restaurant, café or forecourt is allowed by permission only. please sign and return in order to confirm your reservation: in note these terms and conditions and agree to them date of event name signed.. date address.. contact number please sign and return this contract to bluebird events, bluebird, 350 kings road, london sw3 5uu or bbevents@danddlondon.com
