13 Function Contract Terms and Conditions 1. i) The customer will advise the Club 72 hours prior to the event the confirmed number of guests. ii) iii) iv) The Club will charge for the confirmed number of guests or the actual number of guests in attendance, whichever is the greatest number. The Club will set and prepare food for 5% above the confirmed number. Should an overflow occur beyond the control of the customer, the Club will accommodate the guests to the best of its ability. 2. Gratuities are charged on the total of all food and beverage as stated in this contract. Gratuity 15% plus 5% GST. 3. i) A $ deposit is required upon confirmation of your booking date. ii) iii) Seven (7) days prior to the function 75% of the estimated final payment is due. And the balance to be paid Seven 7 days after the function date. CANCELLATION POLICY: The deposit for functions will only be refunded if the Club is able to contract another group for the date that you had booked. 4. The customer is responsible for any damages to the Club premises by his/her guests, agents or independent contractors on his/her behalf during the period the club premises are under his/her control. Due to fire regulations open flames are prohibited. 5. The Club will not be responsible for damage or loss of any articles left in the Club, prior to, during, or following any function by the customer or their guests. 6. Use of the Club name or logo in advertising is prohibited without approval of The Highwood Golf and Country Club. 7. Doorways must not be obstructed in any way at any time. Bands and other entertainment may not bring equipment through the main doors and must use the Westside entrance of the building. 8 Starting and ending times of all functions are to be adhered to. Space is only booked for the time indicated. 13

14 Function Contract Terms and Conditions Continued 9. Wedding photos, etc. are only permitted in areas of non-play or areas where disruption of play to members will not occur. 10. Strict dress codes are adhered to by all members and apply to any guests using the Club facilities. As per REGULATION XI Page 25 of the Rules and Regulations which states: XI. Men s Shirts must have sleeves. Ladies Shirts must have sleeves without a collar or be sleeveless with a collar or be with sleeves and a collar. Shorts and Slacks must be tailored with a zipper or buttons. Shorts are not to be shorter than mid thigh in length. Anyone not complying with the above dress code policy will not be allowed on the golf course. 11 i) Highwood Golf and Country Club will be the sole supplier of all food and beverage items, wedding cakes being the exception. ii) iii) iv) All food must be consumed on the Club premises. Due to health regulations no food may leave the premises under any conditions. Food items will remain on buffets for a maximum of two (2) hours. 12. Alcoholic beverages will be served in accordance with the regulations of the Alberta Gaming and Liquor Commission. The HIGHWOOD GOLF AND COUNTRY CLUB HAS ADOPTED a responsible Alcohol Service Policy which states: If an intoxicated patron does not have a responsible person to drive, then the management is directed to ensure that the patron is offered a free cab or driving alternative services (which takes both the driver and car home) and to make sure they use that service. In the event the Club determines a patron of your function is required the use of a taxi or driving alternative, it is fully understood by you, the customer, that the cost of this service will be charged to your function. 13. The performance of this agreement is contingent upon the ability of the management of The Highwood Golf and Country Club, High River Alberta; to complete the same, and is subject to Acts of God, labour troubles, disputes or strikes, accidents, government 14

15 Function Contract Terms and Conditions Continued restrictions, transportation of foods, beverages, or supplies and other causes whether enumerated hereto or not beyond the control of management preventing or interfering with the performance. Under no circumstances shall The Highwood Golf and Country Club be liable for the loss of profit or for other similar consequential damages, whether based or breach of contact warranty or otherwise.
