Beach Street. Wine me is a new wine bar and retail shp prpsing t ccupy the frmer lcatin f the Michael s Phtgraphy. The applicant is prpsing t perate a wine bar with accessry retail sales with beer and wine (2-COP) alchl beverage service. The applicant is prpsing t change the use f the lcatin frm retail sales t butique bar. The new business will have t cnfrm t all current regulatins fr butique bars, including alchl beverage service, in the RDD-1 zning district. ANALYSIS: The subject prperty is lcated in the RDD-1 (Beach Street Retail) zning district, which allws butique bars as a cnditinal use. A descriptin f Wine Me, prepared by the applicant, is attached. Alchl Beverage Service by a Butique Bar must cmply with the cnditins in Article (70) f the Land Develpment Cde (LDC). Butique bars may als have utdr table service n a public sidewalk as a cnditinal use. Article b.5 f the LDC requires all cnditinal uses in the redevelpment area t be apprved by the Redevelpment Area Bard. Alchl Beverage Service. Butique bar is a cnditinal use in the RDD-1 zning district. Article (70) identifies the fllwing cnditins that apply t butique bars in Dwntwn: (a) The establishment shall nly serve beer r wine. (b) The custmer service area fr cnsumptin, including bar, shall be limited t 1,000 sq. ft. (c) The establishment may have adjacent retail package wine r beer sales. (d) The establishment may have live entertainment. (e) Live utdr entertainment, as permitted by Daytna Beach Cde f Ordinances, must cease by 10PM n Sunday thrugh Thursday r midnight n Friday and Saturday.

2 Page 2 The intent f the butique bar cnditins is t allw small, unique bars, such as wine bars, that will nt negatively impact the surrunding retail businesses r residents. The attached flr plan frm the applicant prpses a wine bar (butique bar) with accessry retail sales. The prpsed custmer service area is 798 sq. ft, within the cnditinal use limits. The applicant is prpsing live entertainment in the custmer service area. Any utdr live entertainment will have t cmply with the time limits fr the cnditinal use criteria. The applicatin meets all the criteria fr a butique bar. Outdr Table Service. Article (22) identifies the fllwing cnditins that apply t utdr table service. (a) A sidewalk cafe license agreement must be apprved and executed. (b) N permanent encrachment shall be permitted n r abve the sidewalk. (c) Pedestrian flw thrugh the cafe shall be prvided. (d) Only as an accessry use t a restaurant, fd service establishment, r similar primary use. (e) All requirements f law must be met, including liability insurance. City staff has prepared an agreement with Sheridan East Hldings, LLC that meets all the criteria listed abve. Exhibit C shws the prpsed area fr the sidewalk café. The prpsed area permits tables within furteen feet frm the building. Six feet will be prvided frm the curb fr pedestrian flw. The City Cmmissin will have t apprve the agreement. RECOMMENDATION: Staff recmmends that the Dwntwn/Ballugh Rad Redevelpment Area Bard APPROVE the cnditinal use fr Ashley Sheridan t perate a butique bar and prvide utdr table service n a public sidewalk at 204 Suth Beach Street, subject t any utstanding technical review cmments.
